SHAH\n\t\t\n\t\n\n \n\nDate\n: 29\/09\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\t\tThe<br \/>\npresent petition under Article 226 of the Constitution of India has<br \/>\nbeen preferred by the petitioner to quash and set aside the impugned<br \/>\norder dated 22\/07\/2011 passed by learned Gujarat State Co-Operative<br \/>\nTribunal, Ahmedabad in Civil Misc.Application No.64 of 2011, by<br \/>\nwhich, learned Tribunal has rejected the said application to condone<br \/>\nthe delay of 4 years and 3 months in preferring the appeal against<br \/>\nthe judgement and award dated 23\/01\/2006 passed by learned Board of<br \/>\nNominees, Vadodara in Lavad (Summary) Suit No.868 of 2003.\n<\/p>\n<p>2.\t\tHaving<br \/>\nheard the learned advocate appearing on behalf of the petitioner and<br \/>\nconsidering the impugned order and huge delay of 4 years and 3<br \/>\nmonths, which has not been explained satisfactorily, it cannot be<br \/>\nsaid that the learned Tribunal has committed any error and\/or<br \/>\nillegality in rejecting the aforesaid application for condonation of<br \/>\ndelay and in not condoning the delay of 4 years and 3 months in<br \/>\npreferring the appeal against the judgement and award passed by<br \/>\nlearned Board of Nominees,Vadodara. No sufficient cause has been<br \/>\nshown by the petitioner for condonation of huge delay. Even Medical<br \/>\nCertificate, which is produced on record, is of the year 2006 and<br \/>\nnothing has been produced for the period from the year 2006 to 2011.<br \/>\nUnder the circumstances, no case is made out to interfere with the<br \/>\nimpugned order passed by the learned Tribunal in refusing to condone<br \/>\nthe huge delay of 4 years and 3 months.\n<\/p>\n<p>3.\t\tIn<br \/>\nview of the above, there is no substance in the present petition and<br \/>\nthe same deserves to be dismissed and is accordingly dismissed.
