Taimni, Member  <\/p>\n<p> 1. Petitioner was the complainant before the State Commission where he had filed a complaint alleging deficiency in service on the part of the respondent HUDA.\n<\/p>\n<p> 2. Brief facts of the case are that complainant was allotted a plot in August, 1991 but possession of which was offered only, in December, 1997, that too during the pendency of the complaint before the State Commission. In view of possession having been given, State Commission did not grant any relief. It is the complainant who had filed this appeal before us for grant of interest and direction to the respondent HUDA not to charge interest for the period taken for delivery of possession.\n<\/p>\n<p> 3. We heard the learned Counsel for the parties and perused the material on record. This Commission has severally held that Public Agencies should hand over possession of plot\/ house after about two years of allotment. In the present case, time taken to offer possession is over six years, which cannot be justified. Following the principle on the subject laid down by the Commission, we direct the respondent, HUDA to pay interest @ 18% p.a. on the deposited amount from two years after the date of deposit. In view of this we are not inclined to grant any other relief. This appeal is allowed in above terms with cost of Rs. 2,000\/- payable by the respondent to the appellant\/complainant.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>National Consumer Disputes Redressal S.K.
