Mr. J. K. Shah,<br \/>\n\tlearned APP waives service of rule on behalf of respondent<br \/>\n\tState.\n<\/p>\n<p>\t This<br \/>\n\tis an application preferred by convict prisoner through jail praying<br \/>\n\tfor temporary bail for a period of 30 days on the ground that his<br \/>\n\tdaugther   Taybabanu aged about 10 is suffering from Thalesemia<br \/>\n\tMajor (Blood Cancer). There is a certificate issued by the<br \/>\n\tSuperintendent, Referral Hospital, Radhanpur, Dist. Patan,<br \/>\n\tcertifying that the patient has  to come for blood transfusion every<br \/>\n\tmonth at the hospital. The accused applicant is undergoing sentence<br \/>\n\tpassed 1 year and 7 months. He has been sentenced to undergo R.I.<br \/>\n\tfor a period of 7 years for the offence punishable under Sections<br \/>\n\t395 and 397 of the Indian Penal Code. Taking<br \/>\n\tinto consideration the fact that the accused   applicant hails<br \/>\n\tfrom poor strata of the society and daughter aged about 10 years is<br \/>\n\tsuffering from very severe ailment like Thalesemia Major requires<br \/>\n\tblood transfusion practically every month at the hospital, I deem it<br \/>\n\tfit and proper to order release of the applicant on temporary bail<br \/>\n\tfor a period of 20 days to enable him to take care of his daughter.\n<\/p>\n<p>\t In<br \/>\n\tthe facts and circumstances of the case the accused   applicant is<br \/>\n\tordered to be released on temporary bail on his furnishing personal<br \/>\n\tbond of Rs.10,000\/- (Rupees Ten Thousand Only) with the jail<br \/>\n\tauthority for a period of 20 days from his actual date of release.<br \/>\n\tHe shall surrender with the jail authority on expiry of temporary<br \/>\n\tbail period. During his period on temporary bail he shall mark his<br \/>\n\tpresence once in a week on every Sunday at Varahi Police Station,<br \/>\n\tDist. Patan.
