BHATT\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 06\/05\/2011 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>(Per<br \/>\n: HONOURABLE MR.JUSTICE RAVI R.TRIPATHI)<\/p>\n<p>1.0\tPresent<br \/>\napplication is filed by the applicant &#8211; convict seeking<br \/>\nextension of time of Temporary Bail, which was granted by this Court<br \/>\nby order dated 31st March 2011 in Criminal Misc.<br \/>\nApplication No. 4304 of 2011 for 30 days.\n<\/p>\n<p>2.0\tRule.\n<\/p>\n<p> Learned Additional Public Prosecutor Mr. Pandya waives service of<br \/>\nprocess of Rule.\n<\/p>\n<p>3.0\tLearned<br \/>\nAdditional Public Prosecutor made available for perusal the Jail<br \/>\nRemarks.  The convict has enjoyed four Furloughs.  He has also<br \/>\nenjoyed Temporary Bail on three different occasions, earlier to the<br \/>\nlast order of Temporary Bail.\n<\/p>\n<p>3.1\tThe<br \/>\napplicant &#8211; convict &#8211; Party in Person submitted that there is a<br \/>\nmarriage of his sister&#8217;s son and he being only brother of his sister,<br \/>\nhis presence is required.  Besides, he also submitted that the<br \/>\nconstruction of the house, which is under taken, is halfway and it is<br \/>\nrequired to be completed.  He requests that, if the Temporary Bail is<br \/>\nextended suitably, he will be able to attend the marriage of his<br \/>\nsister&#8217;s son and also will complete the construction work.\n<\/p>\n<p>4.0\tTaking<br \/>\ninto consideration the contents of the application, the application<br \/>\nis allowed.  The Temporary Bail granted by this Court by order<br \/>\ndated 31st March 2011 in Criminal Misc. Application No.<br \/>\n4304 of 2011 is extended for a period of 15 days from the date<br \/>\nof expiry of earlier Temporary Bail period on the same<br \/>\nterms and conditions.\n<\/p>\n<p>4.1\tThe<br \/>\napplicant &#8211; convict shall surrender to the jail authorities on<br \/>\nexpiry of the Temporary Bail period.\n<\/p>\n<p>4.2\tRule<br \/>\nis made absolute to the aforesaid extent.\n<\/p>\n<p>[<br \/>\nRavi R.
