Justice M.SASIDHARAN NAMBIAR\n\n Dated :13\/12\/2010\n\n O R D E R\n          M.SASIDHARAN NAMBIAR,J.\n\n           ---------------------------------------------\n           CRL.M.C.NO.4531 OF 2010\n           ---------------------------------------------\n           Dated 13th December, 2010\n\n\n                          O R D E R\n<\/pre>\n<p>          Petitioners are the accused and<\/p>\n<p>second respondent, the de facto complainant<\/p>\n<p>in Crime No.638\/2010 of Anthikkad Police<\/p>\n<p>Station registered for the offences under<\/p>\n<p>Sections 143, 147, 148, 448, 323, 324, 308<\/p>\n<p>read with Section 149 of Indian Penal Code<\/p>\n<p>on Annexure-I FIR. Second                       respondent      is<\/p>\n<p>the de facto complainant and the injured.<\/p>\n<p>Petition is filed under Section 482 of Code<\/p>\n<p>of  Criminal         Procedure                to        quash  the<\/p>\n<p>proceedings contending that entire disputes<\/p>\n<p>were settled amicably and consequent to the<\/p>\n<p>settlement, it is not in the interest of<\/p>\n<p>justice to continue the prosecution.<\/p>\n<pre>       2. Second                 respondent               appeared\n\n<span class=\"hidden_text\">Crmc 4531\/10              2<\/span>\n\n\nthrough      a  counsel  and  filed  an   affidavit\n\n<\/pre>\n<p>stating that entire disputes were settled with<\/p>\n<p>the    petitioners   due  to  the  intervention  of<\/p>\n<p>mediators and consequent to the settlement, he<\/p>\n<p>has no objection for releasing the petitioners<\/p>\n<p>on bail or to quash the proceedings.<\/p>\n<p>            2.  Learned  counsel appearing for the<\/p>\n<p>petitioners,      second  respondent  and   learned<\/p>\n<p>Public Prosecutor     were heard.\n<\/p>\n<p>            3. The case was registered based on the<\/p>\n<p>first      information  statement  of  the   second<\/p>\n<p>respondent, which reveals that on 27\/8\/2010     at<\/p>\n<p>about      6.50  a.m,  he  was   attacked  by   the<\/p>\n<p>petitioners who came there in a       red coloured<\/p>\n<p>car and thereafter, inflicted         hurt with a<\/p>\n<p>knife. The offence under Section 308 of Indian<\/p>\n<p>Penal Code is allegedly committed, based on the<\/p>\n<p>allegation that if second respondent has not<\/p>\n<p>evaded, when the knife was     aimed  at his neck,<\/p>\n<p><span class=\"hidden_text\">Crmc 4531\/10               3<\/span><\/p>\n<p>death      would  have  been  caused. The  offence<\/p>\n<p>alleged against the petitioners are         purely<\/p>\n<p>personal       in   nature  against   the   second<\/p>\n<p>respondent.      Affidavit  filed  by  the   second<\/p>\n<p>respondent establishes that he has settled all<\/p>\n<p>the disputes with the petitioners. As held by<\/p>\n<p>the Apex Court in <a href=\"\/doc\/1442974\/\">Madan Mohan Abbot v. State of<\/p>\n<p>Punjab<\/a> (2008 (3) KLT 19 (SC), when the offences<\/p>\n<p>alleged are purely personal in nature against<\/p>\n<p>the second respondent and second respondent has<\/p>\n<p>settled all the disputes with the petitioners,<\/p>\n<p>it    is    not  in  the  interest  of justice  to<\/p>\n<p>continue the prosecution.\n<\/p>\n<p>            Petition is allowed.
