Nutan Sahay, learned A.C. to<\/p>\n<p>                     Standing Counsel No. 1 appearing on behalf of respondent<\/p>\n<p>                     no. 1 &amp; 2\/State, Sri Shivendra Kishore, learned counsel<\/p>\n<p>                     appearing on behalf of respondent no. 3 to 5 &amp; 10 \/ J.P.<\/p>\n<p>                     University, Chapra and Sri Harendra Kumar Tiwari, learned<\/p>\n<p>                     counsel appearing on behalf of respondent no. 6 to 9\/ Baba<\/p>\n<p>                     Saheb    Bheem    Rao    Ambedkar     Bihar    University,<\/p>\n<p>                     Muzaffarpur.\n<\/p>\n<p>                                The petitioner, who retired in the year 1995 as<\/p>\n<p>                     &#8216;Reader&#8217; has prayed for directing the respondents to pay<br \/>\n<span class=\"hidden_text\">                        2<\/span><\/p>\n<p>remaining amount of retiral dues. At the very outset Sri<\/p>\n<p>Shivendra Kishore has raised preliminary objection on the<\/p>\n<p>point of maintainability of the writ petition. It was<\/p>\n<p>submitted by Sri Kishore that the petitioner has earlier<\/p>\n<p>approached this court by filing a writ petition for retiral<\/p>\n<p>dues which was disposed of by a common order on<\/p>\n<p>21.12.2000 vide &#8216;Annexure &#8211; 1&#8217; to the writ petition, and<\/p>\n<p>thereafter, since that order was not fully complied with, the<\/p>\n<p>petitioner had filed a contempt petition vide MJC No. 1170<\/p>\n<p>of 2001, which too was disposed of on 03.05.2002. It was<\/p>\n<p>submitted that for the same relief the petitioner is not<\/p>\n<p>entitled to file second writ petition.\n<\/p>\n<p>             Learned counsel for the petitioner has drawn my<\/p>\n<p>attention to last paragraph of the order dated 03.05.2002 in<\/p>\n<p>MJC No. 1170 of 2001 and it has been argued that while<\/p>\n<p>disposing of the contempt petition this court had granted<\/p>\n<p>liberty to the petitioner for pursuing his further claim, if<\/p>\n<p>any, before the appropriate authority, and as such, the<\/p>\n<p>petitioner for remaining grievances has approached the<\/p>\n<p>authority concerned.\n<\/p>\n<p>             Sri Shivendra Kishore has further argued that he<\/p>\n<p>has specifically stated in its counter affidavit that difference<\/p>\n<p>of arrear of pension has also been paid and nothing is<\/p>\n<p>pending with the J.P. University, Chapra.<\/p>\n<p>             Learned counsel for the petitioner submits that<br \/>\n<span class=\"hidden_text\">                       3<\/span><\/p>\n<p>the writ petition may be disposed of granting liberty to the<\/p>\n<p>petitioner to approach the authority concerned by filing<\/p>\n<p>representation. It has not been disputed by learned counsel<\/p>\n<p>for the petitioner that payment has been made by J.P.<\/p>\n<p>University, Chapra, but a claim has been made that<\/p>\n<p>calculation chart has not been supplied by the J.P.<\/p>\n<p>University, Chapra.\n<\/p>\n<p>            Sri Harendra Kumar Tiwari, learned counsel for<\/p>\n<p>respondent \/ B.R.A. Bihar University, Muzaffarpur, does<\/p>\n<p>not dispute the prayer made by learned counsel for the<\/p>\n<p>petitioner for approaching the authority concerned by filing<\/p>\n<p>representation.\n<\/p>\n<p>            In view of the facts and circumstances, the writ<\/p>\n<p>petition stands disposed of granting liberty to the petitioner<\/p>\n<p>to file a fresh representation regarding his remaining<\/p>\n<p>grievance along with relevant documents before respondent<\/p>\n<p>no. 8 \/ Registrar, Bheem Rao Ambedkar Bihar University,<\/p>\n<p>Muzaffarpur, within a period of eight weeks from today. If<\/p>\n<p>such representation is filed, the respondent no. 8 is required<\/p>\n<p>to examine the same and pass appropriate order in<\/p>\n<p>accordance with law within a period of four months from<\/p>\n<p>the date of filing of such representation. Even in case of<\/p>\n<p>refusal, the respondent no. 8 is required to pass a speaking<\/p>\n<p>order and communicate the same to the petitioner within<\/p>\n<p>four months from the date of filing of such representation.<br \/>\n<span class=\"hidden_text\">                                4<\/span><\/p>\n<p>         The petitioner is further granted liberty to approach the<\/p>\n<p>         respondent no. 3 \/ J.P. University, Chapra, through its<\/p>\n<p>         Registrar by filing a representation regarding the claim for<\/p>\n<p>         providing calculation chart. The said representation must be<\/p>\n<p>         filed within a period of six weeks from today.
