No.1671 of 2011\n                                     UDAY KUMHAR\n                                            Versus\n                                  THE STATE OF BIHAR\n                                          -----------\n<\/pre>\n<p>2   25.02.2011          Heard Sri Md Irshad, learned counsel for the petitioner as<\/p>\n<p>                 well as Sri M. Rab, learned Addl. P.P. for the State.\n<\/p>\n<p>                           The petitioner seeks his bail in connection with Magadh<\/p>\n<p>                 Medical P.S. Case No. 69 of 2010 initially, registered under sections<\/p>\n<p>                 341, 324, 307, 504\/34 of the Indian Penal Code and 27 of the Arms<\/p>\n<p>                 Act and subsequently, section 302 of the IPC was also added.<\/p>\n<p>                            It would appear from perusal of the fardbeyan of the<\/p>\n<p>                 informant that it was co-accused Surendra Sah who opened fire as a<\/p>\n<p>                 result of which informant&#8217; brother sustained fire arm injury on his<\/p>\n<p>                 abdomen. So far as petitioner is concerned, allegedly, he too opened<\/p>\n<p>                 fire but admittedly, firing of the petitioner did not hit to any person.<\/p>\n<p>                           Considering the aforesaid facts and circumstances as well as<\/p>\n<p>                 submissions of the parties, let the petitioner, Uday Kumhar be released<\/p>\n<p>                 on bail on furnishing bail bond of Rs 10,000\/- (ten thousand) with two<\/p>\n<p>                 sureties of the like amount each       to the satisfaction of the Chief<\/p>\n<p>                 Judicial Magistrate, Gaya in Magadh Medical P.S.
