Justice T.R.RAMACHANDRAN NAIR\n\n Dated :17\/02\/2009\n\n O R D E R\n                T.R.RAMACHANDRAN NAIR,J.\n                       -------------------------\n                  W.P ( C) No. 2849 of 2009\n                      --------------------------\n             Dated this the 17th February,2009\n\n                        J U D G M E N T\n<\/pre>\n<p>      Petitioner retired from service           of Agriculture<\/p>\n<p>Department       as a Principal Agriculture Officer on<\/p>\n<p>30.4.2006. Pursuant to disciplinary action taken against<\/p>\n<p>him and some others, Exhibit-P5 order has been passed<\/p>\n<p>by the Government by which the Government finalised the<\/p>\n<p>disciplinary proceedings against the accused officers by<\/p>\n<p>awarding recovery of 80% of the total loss of Rs.1,58,990\/-<\/p>\n<p>from the DCRG of the petitioner and 10% of the loss<\/p>\n<p>each from the pay and allowances of Sri. K.K. Chandran,<\/p>\n<p>Deputy Director of Agriculture and Sri.Kurian Mathew,<\/p>\n<p>Assistant Director of Agriculture.\n<\/p>\n<p>      2.    In view of the disciplinary proceedings pending<\/p>\n<p>against him so far the retirement benefits have not been<\/p>\n<p>quantified and no order of sanction has been issued.<\/p>\n<p>Petitioner on receipt of Exhibit-P5 has filed Exhibit P6<\/p>\n<p>before the Agriculture Production Commissioner seeking<\/p>\n<p>W.P ( C) No. 2849 of 2009<br \/>\n<span class=\"hidden_text\">                                  2<\/span><\/p>\n<p>for a reconsideration of the matter. Petitioner has sought<\/p>\n<p>cancellation of the      order contending     that there is no<\/p>\n<p>dereliction of duties on his part and he has not caused any<\/p>\n<p>loss to the Government.\n<\/p>\n<p>       3.      Petitioner has a further contention that since<\/p>\n<p>the disciplinary proceedings have been finalised after<\/p>\n<p>retirement no punishment could have been imposed against<\/p>\n<p>him and the order now passed is not           pursuant to any<\/p>\n<p>judicial proceedings also.\n<\/p>\n<p>       4.    There will be a direction to the 2nd respondent to<\/p>\n<p>consider and pass orders on Exhibit-P6 within a period of<\/p>\n<p>two months from the date of receipt of a copy of this<\/p>\n<p>judgment, after hearing the petitioner. Second respondent<\/p>\n<p>will see whether Exhibit-P6 is maintainable before him and<\/p>\n<p>if it is not maintainable, the matter will have to be referred<\/p>\n<p>to the Government treating it as a review under Rule 35 of<\/p>\n<p>the     Kerala Civil Services (Classification, Control and<\/p>\n<p>Appeal) Rules, 1960 and in that event the Government will<\/p>\n<p>consider      it on merits and pass orders       thereon after<\/p>\n<p>hearing him. Petitioner has got a contention that so far the<\/p>\n<p>W.P ( C) No. 2849 of 2009<br \/>\n<span class=\"hidden_text\">                                 3<\/span><\/p>\n<p>DCRG and other benefits have not been sanctioned to him.<\/p>\n<p>It is pointed out that the admissible amount of DCRG could<\/p>\n<p>be disbursed without any delay.
