Justice ANTONY DOMINIC\n\n Dated :04\/02\/2009\n\n O R D E R\n                   ANTONY DOMINIC,J.\n              -----------------------\n                W.P.(C).No.3672 OF 2009\n              ------------------------\n          Dated this the 4th day of February, 2009.\n\n                         JUDGMENT\n<\/pre>\n<p>      Against  Ext.P4     order  demanding      penalty,   the<\/p>\n<p>petitioner fled Ext.P5 appeal. Obviously the appeal was<\/p>\n<p>belated   and   therefore    he  filed  an   application   for<\/p>\n<p>condonation of delay also. It is also seen that he has filed<\/p>\n<p>an application for stay of Ext.P4 as well. It is stated that in<\/p>\n<p>the meanwhile the amount due under Ext.P4 is sought to be<\/p>\n<p>realized.\n<\/p>\n<p>      2. However, the Government Pleader points out that<\/p>\n<p>Ext.P6 communication demanding payment was issued on<\/p>\n<p>24.12.2008 and that the appeal was filed much later on<\/p>\n<p>27.1.2009.\n<\/p>\n<p>      3. Irrespective of the merits of the contentions raised,<\/p>\n<p>since the petitioner has filed Ext.P5 appeal with an<\/p>\n<p>application for condonation of delay and also          a stay<\/p>\n<p>WP(c).No.3672\/09               \/2\/<\/p>\n<p>petition, I feel that the the appellate authority shall consider<\/p>\n<p>the appeal and the Interlocutory applications that have been<\/p>\n<p>filed.\n<\/p>\n<p>      4. Accordingly, the writ petition is disposed of directing<\/p>\n<p>that   the appellate authority shall consider the petition for<\/p>\n<p>condonation of delay and also the stay petition filed along<\/p>\n<p>with Ext.P5 appeal.
