DENESAN, J.\n\n\n\n                 = = = = = = = = = = = = = = =\n\n                 W.P.(C)  No. 18646 OF 2005 T\n\n                 = = = = = = = = = = = = = = =\n\n\n\n               Dated this the 8th November, 2006\n\n\n\n                          J U D G M E N T\n<\/pre>\n<p>     After retirement from the Army, the petitioner was<\/p>\n<p>sponsored   through   the   soldier&#8217;s   cell   as   well   as   the<\/p>\n<p>Employment   Exchange   for   job   opportunity   under   the<\/p>\n<p>respondents.  He was offered an appointment.  He joined<\/p>\n<p>duty   in   November,   1995   in   the   establishment   of   the<\/p>\n<p>respondents and  retired from service on 31-3-2005.  He<\/p>\n<p>has not been granted pensionary benefits as he did not<\/p>\n<p>have   10   years   service   under   the   respondents   which   is<\/p>\n<p>the minimum period prescribed for the grant of pension.\n<\/p>\n<p>The claim made by the petitioner for pension was turned<\/p>\n<p>down   by   the   respondents   as   seen   from   Exts.   P1   and   P2<\/p>\n<p>orders.\n<\/p>\n<p>     2.   Counsel   for   the   petitioner   submits   that   the<\/p>\n<p>petitioner   has   not   sought   for   any   relief   directly<\/p>\n<p>against   Exts.   P1   and   P2   since   he   has   moved   the   same<\/p>\n<p>authority   for   a   re-consideration   of   the   earlier   orders<\/p>\n<p>by filing Ext. P4 representation before the Chairman of<\/p>\n<p>the   Corporation.     The   contention   of   the   petitioner   is<\/p>\n<p>that   the   Corporation   had   accepted   the   option   made   by<\/p>\n<p><span class=\"hidden_text\">WPC No. 18646\/2006                 -2-<\/span><\/p>\n<p>the   petitioner   for   pension   and   it   may   not   fit   in   with<\/p>\n<p>the   principles   of   justice   to   go   back   from   the   earlier<\/p>\n<p>stand taken by the Corporation.\n<\/p>\n<p>     3.   A   detailed   counter   affidavit   has   been   filed   by<\/p>\n<p>the   respondents  maintaining  the  stand  taken  by  them  as<\/p>\n<p>per Exts. P1 and P2.\n<\/p>\n<p>     4.   It   is   unnecessary   for   this   Court   to   consider<\/p>\n<p>the   contentions   taken   by   the   petitioner   in   the   writ<\/p>\n<p>petition   or   those   by   the   respondents   in   the   counter<\/p>\n<p>affidavit   since   the   limited   relief   prayed   for   by   the<\/p>\n<p>petitioner   is   for   a   direction   to   the   1st  respondent   to<\/p>\n<p>consider     Ext.   P4   representation.     I   feel   that   the<\/p>\n<p>relief thus prayed for can be granted in the facts and<\/p>\n<p>circumstances of this case.\n<\/p>\n<p>     5.   The   writ   petition   is   disposed   of   directing   the<\/p>\n<p>1st  respondent to consider Ext. P4 and pass appropriate<\/p>\n<p>orders   within   three   months   on   the   petitioner   producing<\/p>\n<p>a copy of the judgment.\n<\/p>\n<p>                                                    K.K.
