P.C. in<br \/>\nconnection with CR No. I-117 of<br \/>\n2011 registered with Kalavad Police Station, Jamnagar for the<br \/>\noffences punishable under Sections 463, 465, 467, 468, 464, 466, 474,<br \/>\n416, 417, 418, 419, 420 and 120-B of the<br \/>\nIndian Penal Code.\n<\/p>\n<p>2.\tLearned<br \/>\nAdvocate,  appearing for the applicant has contended that this is a<br \/>\ncase of documentary evidence.  He has contended that FIR is filed<br \/>\nafter period of one year. He has contended that the applicant is a<br \/>\nGovernment servant and the allegation against her is only to the<br \/>\neffect that after relying on the identification by the advocate and<br \/>\nrelying on the true copy of election card of that dummy person<br \/>\nstating his name as of complainant, the applicant, being the<br \/>\nRegistrar, registered the agreement to sell. He has contended that<br \/>\nthe documents in question have not been utilized for any purpose.<br \/>\nLearned Advocate has contended that this court vide orders dated<br \/>\n22.9.2011 passed in Misc. Criminal Application No.12715 of 2011 and<br \/>\nvide order dated 23.9.2011 passed in Misc. Criminal Application 13451<br \/>\nof 2011 granted anticipatory bail to the co-accused. He has also<br \/>\ncontended that, prima facie, the applicant have not played any role<br \/>\nin the offences alleged against him.\n<\/p>\n<p>3.\tHeard<br \/>\nMr. Pandya, learned APP for the respondent State. He has vehemently<br \/>\nopposed this application.\n<\/p>\n<p>4.\tHeard<br \/>\nlearned Counsel for the parties and perused the documents produced on<br \/>\nrecord in detail. Looking to the facts of the case, I am  of the<br \/>\nopinion that, prima facie, this is a fit case to grant anticipatory<br \/>\nbail.  Learned Counsel for the parties do not press for reasoned<br \/>\norder.\n<\/p>\n<p>5.\tIn<br \/>\nthe result, this application is allowed by directing that in the<br \/>\nevent of the applicant herein being arrested pursuant CR<br \/>\nNo. I-117 of 2011, registered with Kalavad Police<br \/>\nStation, Jamnagar, he shall be released on Bail on furnishing a Bond<br \/>\nof Rs.10,000\/- (Rupees ten thousand only) with one surety of like<br \/>\namount on condition that &#8211;\n<\/p>\n<p>a)\tshe<br \/>\nshall co-operate with the investigation and make himself available<br \/>\nwhenever required;\n<\/p>\n<p>b)\tShe<br \/>\nshall remain present before the Investigating Officer, Kalavad Police<br \/>\nStation, Jamnagar, on 30th September,<br \/>\n2011 at 11.00 a.m. <\/p>\n<p>c)\tShe<br \/>\nshall not hamper the investigation in any manner nor shall directly<br \/>\nor indirectly make any inducement, threat or promise to any witness<br \/>\nso as to dissuade them for disclosing such facts to the Court or to<br \/>\nany Police Officer;\n<\/p>\n<p>d)\tAt<br \/>\nthe time of execution of Bond, she shall furnish his address to the<br \/>\nI.O. and the Court concerned and shall not change the residence till<br \/>\nthe final disposal of the case or till further orders;\n<\/p>\n<p>e)\tthat<br \/>\nshe will not leave India without the permission of the Court and, if<br \/>\nare holding Passport, surrender the same before the trial Court<br \/>\nimmediately;\n<\/p>\n<p>f)\tIt<br \/>\nwould be open to the Investigating Officer to file an application for<br \/>\nremand, if considers it just and proper and the concerned Magistrate<br \/>\nwould decide it on merits;\n<\/p>\n<p>g)\tthis<br \/>\norder will be operative if the applicant is arrested at any time<br \/>\nwithin a period of 90 days;\n<\/p>\n<p>h)\twithin<br \/>\na period of ten days from the date of arrest, the applicant shall<br \/>\napply for regular bail which application shall be decided by the<br \/>\ncompetent Court in accordance with law without being influenced by<br \/>\nthe fact that anticipatory bail was granted.\n<\/p>\n<p>6.\tLearned<br \/>\nadvocate for the applicant assured that applicant will appear before<br \/>\nconcerned police station as per direction of this Court.\n<\/p>\n<p>7.\tWith<br \/>\nthese directions, this Criminal Miscellaneous Application is disposed<br \/>\nof. Rule is made absolute.
