Engineer, Irrigation Department, Kharagpur - Respondents.\n\n\n\n2       13.4.2011<\/pre>\n<p>                       The petitioner who was working as a daily wager<\/p>\n<p>                            &#8220;Nahar Mazdoor&#8221; in the Irrigation Department, Tarapur Division,<\/p>\n<p>                            Munger prays for regularization of his service. It is admitted that<\/p>\n<p>                            there was break in the petitioner&#8217;s service. However, it is also<\/p>\n<p>                            admitted that he had worked as daily wage earner for a pretty long<\/p>\n<p>                            time.\n<\/p>\n<p>                                        The question of regularization now has to be<\/p>\n<p>                            considered in accordance with paragraph 53 of the decision in the<\/p>\n<p>                            case of Secretary, State of Karnatka vs. Uma Devi and others,<\/p>\n<p>                            2006 (4) SCC 1.\n<\/p>\n<p>                                        In case the department is going to consider the<\/p>\n<p>                            regulation of such daily wage earner, they should prepare a panel<\/p>\n<p>                            which would contain the number of years for which the petitioner<\/p>\n<p>                            and others similarly situated have worked and also indicate their<\/p>\n<p>                            age and continuity in service before any decision is taken in this<\/p>\n<p>                            matter.\n<\/p>\n<p>                                        This writ petition is, thus, disposed of with the<\/p>\n<p>                            aforesaid observation.\n<\/p>\n<\/p>\n<pre>          haque                                                  ( Sheema Ali Khan, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Rajendra Prasad Singh vs The State Of Bihar &amp;Amp; Ors on 13 April, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA CWJC No.3818 of 2008 Rajendra Prasad Singh, son of Late Shaudi Pd.
