PATTANAIK (J)\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t O R D E R<br \/>\n     This special leave petition arises against the order of<br \/>\nthe Central Administrative Tribunal, Allahabad Bench made on<br \/>\nJuly 15,1996  in Original  Application No.959  of 1995.\t The<br \/>\nadmitted position  is that  for the recruitment to Group &#8216;C&#8217;<br \/>\nposts, a  notification was  issued on July 19, 1994 inviting<br \/>\napplications  for  selection  of  48  Ticket  Collectors  in<br \/>\nLucknow Division  in the  pay scale  of Rs.950-1500\/- Out of<br \/>\n800  candidates\t  who  appeared\t  in  the  examination,\t 106<br \/>\ncandidates  got\t  place\t in   the  select   list  which\t was<br \/>\nsubsequently cancelled\ton the\tground that mal-practice was<br \/>\ncommitted in  writing the  examinations as  the papers\twere<br \/>\nleaked\tout   earlier  to   the\t date  of  examination.\t The<br \/>\ncancellation came  to be  challenged in\t the  Tribunal.\t The<br \/>\nTribunal in  impugned order  has  upheld  the  cancellation.<br \/>\nThus, this special leave petition.\n<\/p>\n<p>     Shri Sanyal,  learned senior  counsel appearing for the<br \/>\npetitioners,  raised  three-fold  contention.  Firstly,\t the<br \/>\nDeputy Divisional Manager was not the competent authority to<br \/>\ncancel the  select  list,  the\tGeneral\t Manager  being\t the<br \/>\ncompetent  authority.\tWe    find  no\tforce  in  the\tsaid<br \/>\ncontention. The Divisional Manager can also be authorised by<br \/>\nthe General Manager to discharge the function of the General<br \/>\nManager. Therefore,  he could be said to have discharged the<br \/>\nfunction of  cancellation of  the select  list. It  is\tthen<br \/>\ncontended  that\t since\tthe  order  does  not  indicate\t any<br \/>\nreasons, it  is bad  in law.  In support  thereof, he placed<br \/>\nstrong reliance\t on the\t decision of  this Court in <a href=\"\/doc\/1831036\/\">Hohinder<br \/>\nSingh Gill  &amp; Anr.  vs. The Chief Election Commissioner, New<br \/>\nDelhi &amp;\t Ors.<\/a>[(1978) 1\tSCC 4051,in  particular, paragraph 8<br \/>\nof the judgment. It is true that when an order is passed, be<br \/>\nit administrative  or quasi-judicial  in nature, necessarily<br \/>\nit would  contain grounds  or reasons  for invalidating\t the<br \/>\naction taken.  The authorities\tcannot subsequently  explain<br \/>\ntheir actions  by way  of Affidavit or otherwise. Therefore,<br \/>\nthis Court  insisted upon the public orders made in exercise<br \/>\nof the statutory power, should contain reasons and the order<br \/>\nshould contain the kind of action taken 4 by them. Therefore<br \/>\nthey cannot  be permitted  to substitute  their\t actions  or<br \/>\ncontents of  orders by\treference to any affidavits or other<br \/>\nactions which did not find place in the order. In this case,<br \/>\nthe authorities\t simply cancelled  the\tselection  list.  In<br \/>\nMaharashtra State  Board of  Secondary and  Higher Secondary<br \/>\nEducation Vs,  K.S. Gandhi  &amp; Ors.  [1991) 2  SCC 716], this<br \/>\nCourt had  held that if the order cancelling the examination<br \/>\ncame to\t be passed,  the record\t should indicate the reason,<br \/>\nthough order  may not  contain the  reasons as\tindicated in<br \/>\nparagraphs 21  of the  judgment. In  that case,\t it was held<br \/>\nthat the  order did  not contain  the reasons but the record<br \/>\nindicated the  same. The administrative order cancelling the<br \/>\nexamination  in\t  which\t mass\tcopying\t was   alleged,\t was<br \/>\nsustained,<br \/>\n     It is  seen that  after the  allegations were made that<br \/>\nmal-practices were committed, the matter was referred to CBI<br \/>\nfor enquiry.  The CBI  has submitted  his preliminary report<br \/>\nwhich indicated\t in writing the examination, They need await<br \/>\nthe final  report which\t would be  to  take  further  action<br \/>\nagainst erring\tofficers. Therefore,  it is a case where the<br \/>\nauthorities have  taken the  decision on  the basis  of\t the<br \/>\nreport submitted  by the  investigating\t agency,  containing<br \/>\nproof in support of the allegations of malpractice committed<br \/>\nin writing  the examination.  It cannot,  therefore, be said<br \/>\nthat the order of cancellation does not contain any reasons.\n<\/p>\n<p>     It\t is   then  contended\tthat  though   the  selected<br \/>\ncandidates have\t no vested  right, they had got a legitimate<br \/>\nexpectation for\t appointment when  they had got a legitimate<br \/>\nexpectation for\t appointment when  they\t were  selected\t for<br \/>\nbeing appointed.  They should be given prior opportunity and<br \/>\nalso know  the reasons\tfor cancellation. In support of this<br \/>\ncontention,  he\t placed\t reliance  on  paragraph  8  of\t the<br \/>\njudgment of  this Court\t in <a href=\"\/doc\/806441\/\">Asha  Kaul &amp;  Anr. vs.  State of<br \/>\nJammu  &amp;   Kashmir  &amp;\tOrs.<\/a>[(1993)  2\t SCC  573].   It  is<br \/>\nunexceptionable\t that\twhen  duly   constituted   selection<br \/>\ncommittee  makes   recommendation  for\tappointment  of\t the<br \/>\nselected candidates  they candidated  do not  get any vested<br \/>\nright or  legitimate expectation  until they  are  appointed<br \/>\naccording to  the Rules;  they have a chance to be appointed<br \/>\nas have\t been selected\tby the\trecruitment agency.  In that<br \/>\ncase, the  Government had  cancelled the select list without<br \/>\nany reasons.  This Court  has laid  the above  rule in\tthat<br \/>\nbackdrop. The  ratio therein  has  no  application  for\t the<br \/>\nreason that after the perusal of the report submitted by the<br \/>\ninvestigating agency,  the competent authority had cancelled<br \/>\nthe selection  so that\tthe regular  and proper\t examination<br \/>\ncould be  conducted giving opportunity to everyone in a fair<br \/>\nmanner. No  prior opportunity  need be\tgiven in the case of<br \/>\nmass copying.  It is  not the  case where  a named candidate<br \/>\ncommitted  copying.
