Sahi, J<\/p>\n<p>      This writ petition has been filed against the order dated<br \/>\n19.8.2009 passed by the learned District Judge, Deoria, in Civil<br \/>\nRevision No.122 of 2009, whereby an application moved by one of<br \/>\nthe decree holders Kamla Singh, S\/o Kalpnath Singh, has<br \/>\nsucceeded in getting the order of the execution court dated<br \/>\n13.7.2009 set aside and the objection filed by the judgment<br \/>\ndebtor      under Order XXI Rule 90, who is petitioner before this<br \/>\nCourt, has been rejected as being barred by time.\n<\/p>\n<p>      The petitioner &#8211; Kamla Singh, S\/o Ghurahu Singh, contends<br \/>\nthat in view of the order of the Apex Court dated 26.10.2007, the<br \/>\napplication was maintainable and the revisional court has reversed<br \/>\nthe order of the trial court on erroneous considerations completely<br \/>\nignoring the order of the Apex Court.\n<\/p>\n<p>      Sri C.K. Parekh, learned counsel for the petitioner, has<br \/>\nrelied on the decision reported in AIR 1992 SC 1357, 2004 (3)<br \/>\nCurrent Tax Cases 671, 2004 (1) JCLR 824, 2002 (2) Current<br \/>\nRevenue Cases 591 and 1998 (2) ARC 271. Sri Parekh contends<br \/>\nthat the application moved by the petitioner can be treated to be<br \/>\nan application under Order XXI Rule 90 and could have not been<br \/>\ntreated as an application under Section 47 CPC and further the<br \/>\nbar of limitation did not apply and, as such, in view of the<br \/>\ndecisions cited herein above, the court below ought not to have<br \/>\ninterfered with the order of the executing court.\n<\/p>\n<p>      Sri     B.R.   Singh,   learned    counsel   for   the    contesting<br \/>\nrespondent, contends that the observations made by the Apex<br \/>\nCourt in the order dated 26.10.2007 is not a direction nor does<br \/>\nthe petitioner get a right to move an application in as much as<br \/>\nsuch an application was not maintainable keeping in view the<br \/>\n<span class=\"hidden_text\">                                                                    2<\/span><\/p>\n<p>previous proceedings which had attained finality against the<br \/>\npetitioner in this case up to the High Court. Sri Singh contends<br \/>\nthat even if the petitioner is aggrieved then as a matter of fact, he<br \/>\nseeks interpretation of the order passed by the Apex Court which<br \/>\ncannot be gone into by this Court.\n<\/p>\n<p>      Having heard learned counsel for the parties, it is on record<br \/>\nthat a money decree was passed against the petitioner on<br \/>\n21.4.1980. For the satisfaction of the said decree, the property<br \/>\nwas sought to be auctioned and the decree holder himself became<br \/>\nthe auction purchaser. It is during the execution proceedings that<br \/>\nan objection was filed against the auction proceedings and the<br \/>\nobjection was rejected on 4.10.1994. An application was moved<br \/>\nfor cancelling the auction in a revision filed against the said order<br \/>\nof the executing court but the revision was also dismissed on<br \/>\n17.2.1995 and the application filed at the revisional stage was<br \/>\nalso rejected. The auction was confirmed on 17.11.1998. Learned<br \/>\ncounsel contends that the confirmation was invalid as the<br \/>\nproceedings in relation to the challenge to the auction was still<br \/>\npending consideration.\n<\/p>\n<p>      The matter came up before this Court and the writ petition<br \/>\nwas ultimately dismissed. The petitioner approached the Apex<br \/>\nCourt and the Apex Court passed the following order on<br \/>\n26.10.2007:-\n<\/p>\n<blockquote><p>            &#8220;Heard learned counsel for the petitioner.\n<\/p><\/blockquote>\n<blockquote><p>            After some arguments, learned counsel for the<br \/>\n            petitioner is permitted to withdraw these petitions<br \/>\n            with liberty to the petitioner to file a petition under<br \/>\n            Order XXI Rule 90 of the Code of Civil Procedure,<br \/>\n            1908, in accordance with law. If such an application is<br \/>\n            filed, the same shall be considered by the executing<br \/>\n            court in accordance with the provisions of law.&#8221;<\/p><\/blockquote>\n<p>      A perusal of the aforesaid observations made by the<br \/>\nSupreme Court indicates that it was the petitioner himself, who<br \/>\nwithdrew his Special Leave Petition to enable him to file an<br \/>\n<span class=\"hidden_text\">                                                                    3<\/span><\/p>\n<p>application under Order XXI Rule 90 to be considered by the<br \/>\nexecuting Court in accordance with law.\n<\/p>\n<p>      The consideration in accordance with law, therefore, was to<br \/>\nbe made keeping in view the applicability of the provision, the<br \/>\nprevious litigation between the parties as well as the law of<br \/>\nlimitation. The trial court, in my opinion, over looked the aforesaid<br \/>\naspects and proceeded to pass an order directing the parties to<br \/>\nlead oral evidence. The revisional Court , therefore, rightly<br \/>\nproceeded to set aside the said order of the execution court and<br \/>\nhas also arrived at the correct conclusion that the petitioner had<br \/>\navailed of the opportunity on merits and his objections already<br \/>\nstood rejected. In such a situation, the petitioner was not found<br \/>\nentitled to the benefit of law of limitation under Section 14 of the<br \/>\nAct. The conclusion drawn by the revisional court, therefore,<br \/>\ncannot be said to be erroneous. The judgment relied upon by the<br \/>\nlearned counsel for the petitioner do not come to his aid.
