JUSTICE DINESH MAHESHWARI\n\n     Mr. Rahul Bhati, for the petitioners.\n     Mr. O.P. Singaria, Public Prosecutor.\n                               ...\n\n           The petitioners, accused of offences under Sections 3,\n\n     5, 6, 8, 9 and 10 of the Rajasthan Bovine Animal (Prohibition\n\n     of Slaughter &amp; Regulation of Temporary Migration or Export)\n\n     Act, 1995, seek bail under Section 439 Cr.P.C.\n\n           It is submitted that the petitioners are in custody since\n\n     19.08.2009 and have not been involved in any other criminal\n\n     case; and that the challan has been filed in this matter on\n\n     25.10.2009.\n\n           Having heard the learned counsel for the petitioners and\n\n     the learned Public Prosecutor, having examined the material\n\n     placed for perusal, and having regard to the overall\n\n     circumstances,     it appears just and proper to enlarge the\n\n     accused petitioners on bail; but as the petitioners are said to\n\n     be the residents of the State of Madhya Pradesh, it appears\n\n     appropriate to put them to the condition that one of the\n\n     sureties standing for them shall be from the State of\n\n     Rajasthan.\n                                           2\n\n                Accordingly, this bail application under Section 439\n\n          Cr.P.C. is allowed and it is directed that the petitioners Rafiq\n\n          S\/o Allanoor and Mubarik S\/o Vasal Khan be released on bail\n\n          in relation to FIR No. 260\/2009, Police Station Goverdhan\n\n          Vilas, District Udaipur provided each of them executes a\n\n          personal bond in the      sum of Rs. 50,000\/- (Rupees Fifty\n\n          Thousand) with two sound and solvent sureties in the sum of\n\n          Rs. 25,000\/- (Rupees Twenty Five Thousand) each, one of\n\n          whom shall be the resident of the State of Rajasthan, to the\n\n          satisfaction of learned Trial Court for their appearance before\n\n          that court on each and every date of hearing and whenever\n\n          and wherever called upon to do so till the completion of trial.\n\n\n\n\n                                              (DINESH MAHESHWARI), J.\n<\/pre>\n<p>\/Mohan\/\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Rajasthan High Court &#8211; Jodhpur Rafiq &amp; Anr vs State on 5 November, 2009 1 41 S.B.
