Applicant no.2 is uncle of<br \/>\napplicant no.1. Applicant no.3 is brother of applicant no.1.<br \/>\nComplainant lodged complaint against present applicants for the<br \/>\noffence under section 366, 504, 506(2), 114 of the Indian Penal Code.\n<\/p>\n<p>2.\t\tIt<br \/>\nis submitted by the learned Advocate for the applicants that<br \/>\napplicants no.2 and 3 are on bail. It is submitted by learned<br \/>\nAdvocate for the applicants that applicant no.1 and victim &#8211;<br \/>\nNiloger got married and marriage certificate is placed on record<br \/>\nalong with photographers.  Affidavit of victim is also placed on<br \/>\nrecord.\n<\/p>\n<p>3.\t\tIt<br \/>\nis submitted by learned Advocate that in light of judgment of Hon&#8217;ble<br \/>\nSupreme Court when there is inter caste marriage it is duty of the<br \/>\nState agency to provide necessary protection to the couple as well as<br \/>\nrelatives of the petitioners. It is submitted that as per this<br \/>\njudgment in such type of case, to continue with criminal proceedings,<br \/>\nwould be  harassment to concerned parties and therefore, requested to<br \/>\nquash the complaint.\n<\/p>\n<p>4.\t\tOn<br \/>\nthe basis of above contentions raised by the petitioners, this Court<br \/>\npassed order on 14.10.2010 and granted ad interim relief and<br \/>\ninvestigation was stayed.  Thereafter, the matter was listed several<br \/>\ntimes but petitioner no.1 along with victim &#8211; Nilofer did not<br \/>\nremain present before this Court nor before the police agency.  On<br \/>\n18.03.2011, this Court has also passed order for securing presence of<br \/>\npresent petitioner no.1 along with victim- Nilofer.  Today, also<br \/>\npresent petitioner no.1 along with victim girl are not present.<br \/>\nNothing comes out on record to show whereabout of the petitioner no.1<br \/>\nand victim &#8211; girl.  Whether crime is committed with the victim &#8211;<br \/>\ngirl or not is also subject of investigation as victim &#8211; girl<br \/>\nis not present before this Court nor before the police. Merely<br \/>\nbecause affidavit of victim and marriage certificate is produced,<br \/>\ninvestigation cannot be stayed nor complaint can be quashed. As<br \/>\ndiscussed above, whereabout of applicant no.1 and victim is not<br \/>\navailable.\n<\/p>\n<p>4.\t\tIn<br \/>\nview of above, present application is dismissed.
