Mr.A.Saravanan\n\t\t\n\t\t\n\n:JUDGMENT\n<\/pre>\n<p>\tThis appeal is focussed as against the Judgement and Decree dated<br \/>\n29.06.1999 passed in M.C.O.P.No.14 of 1996 by the learned Motor Accidents Claims<br \/>\nTribunal-cum-the Subordinate Judge, Tiruchirappalli.\n<\/p>\n<p>\t2. Heard both sides.\n<\/p>\n<p>\t3. The Tribunal vide Judgement dated 29.06.1999 awarded compensation to a<br \/>\ntune of Rs.2,74,000\/- (Rupees two lakhs and seventy four thousand and sixty<br \/>\nonly) under the following sub-heads:\n<\/p>\n<p>\tFor loss of income\t-Rs.2,72,000\/-\n<\/p>\n<p>\tFor funeral expenses\t-Rs.   2,000\/-\n<\/p>\n<blockquote><p>\t\t\t\t&#8212;&#8212;&#8212;&#8212;&#8211;<br \/>\n\t\t\tTotal\t-Rs.2,74,000\/-\n<\/p><\/blockquote>\n<blockquote><p>\t\t\t\t&#8212;&#8212;&#8212;&#8212;&#8211;\n<\/p><\/blockquote>\n<p>\t4. During arguments, it transpired that the challenge in this appeal is<br \/>\nonly relating to the quantum of compensation.\n<\/p>\n<p>\t5. According to the appellant\/Tamil Nadu State Transport Corporation, the<br \/>\nTribunal awarded a total compensation of Rs.2,74,000\/- (Rupees two lakhs and<br \/>\nseventy four thousand and sixty only), even though the claimants are the parents<br \/>\nof the deceased unmarried son.\n<\/p>\n<p>\t6. The point for consideration is as to whether the Tribunal awarded &#8216;just<br \/>\ncompensation&#8217;?\n<\/p>\n<p>7. On point:\n<\/p>\n<p>\tThe learned counsel for the appellant\/Tamil Nadu State Transport<br \/>\nCorporation by placing reliance on the grounds of appeal would develop his<br \/>\narguments to the effect that the Tribunal simply had chosen the multiplier 17,<br \/>\neven though the claimants are the parents, aged about 59 and 48 respectively,<br \/>\nwhereas the learned counsel for the claimants would contend that the parents are<br \/>\naged about 50 and 48 only; even though the multiplier 17 chosen might appear to<br \/>\nbe on the higher side, nevertheless the Tribunal has chosen the multiplicand as<br \/>\nRs.2000\/- (Rupees two thousand only), which is very low by any standard.\n<\/p>\n<p>\t8. The Tribunal gave a finding to the effect that the deceased at the time<br \/>\nof his death, was running an egg shop.  No doubt, the Tribunal was constrained<br \/>\nto give such a finding in the absence of evidence, whereas the learned counsel<br \/>\nfor the claimants would submit that before the Tribunal voluminous documents<br \/>\nwere filed as found set out in the list of documents to prove that the deceased<br \/>\nwas doing egg business.\n<\/p>\n<p>\t9. It is common knowledge that legal representative the deceased, egg shop<br \/>\nowner, might not be able to prove precisely the actual income of the egg shop<br \/>\nowner and as such some amount  of guess work is contemplated.  However, it is a<br \/>\ntrite proposition of law that the entire estimation of compensation should not<br \/>\nbe based on mere guestimation, but it should be on some solid grounds.  Here,<br \/>\nthe factual aspect of the case would reveal that the accident occurred while the<br \/>\ndeceased was riding his vehicle with his servant as pillion rider.  In fact,<br \/>\nboth of them died in the accident.\n<\/p>\n<p> \t10. Citing the very nature of the accident, the learned counsel for the<br \/>\nclaimants would develop his argument to the effect that the very fact of the<br \/>\ndeceased had a sales boy in his egg shop, would connote and denote that he was<br \/>\nhaving sufficient income as otherwise he might not have had the financial<br \/>\nwherewithal to engage a servant to sell eggs.  I could see considerable force in<br \/>\nthat submission.  Accordingly, if viewed certainly the deceased egg shop owner<br \/>\nmight have earned somewhat more than a sum of Rs.2500\/- (Rupees two thousand and<br \/>\nfive hundred only) per month, but less than Rs.3000\/- (Rupees three thousand<br \/>\nonly) per month and after deducting 1\/3rd towards the expenditure which the<br \/>\ndeceased would have incurred for maintaining himself had he been alive<br \/>\nirrespective of the fact whether the deceased lead the life of a Bohemian or<br \/>\nthat of a Spartan, the monthly contribution to his parents would have been more<br \/>\nthan what the Tribunal assessed.  However, in such a case the proper multiplier<br \/>\nwould be 11 only.  If accordingly, the compensation under the caption loss of<br \/>\nincome\/ dependency the quantum would more or less remain at the same level as<br \/>\nassessed by the Tribunal itself.\n<\/p>\n<p>\t11. Furthermore, the Tribunal has not awarded any compensation under the<br \/>\ncaption loss of love and affection as well as transport expenses.  If<br \/>\ncompensation is assessed and awarded, then certainly it would not be less than<br \/>\nthe total compensation arrived at by the tribunal and  accordingly there is no<br \/>\nmerit in this appeal.\n<\/p>\n<p>\t12. In the result, the Civil Miscellaneous appeal is dismissed and the<br \/>\naward of the Tribunal is confirmed.
