1.The respondent retired from the service of BSNL.<\/p>\n
 As stated in the impugned decision of the Central<\/p>\n
 Administrative   Tribunal,  different   attachment<\/p>\n
 orders\/prohibitory orders were issued either by<\/p>\n
 the civil courts or by the competent authorities<\/p>\n
 under  the  Kerala  Revenue  Recovery   Act,  1968<\/p>\n
 requiring the respondent’s employer   BSNL and the<\/p>\n
 disbursement  officer   to  satisfy  the   demands<\/p>\n
 covered by those attachment orders\/prohibitory<\/p>\n
 orders.   Those    prohibitory   orders\/attachment<\/p>\n
 orders ran to a total amount more than the Death-<\/p>\n
 Cum-Retirement-Benefit that could be released to<\/p>\n

 the respondent at the time of his retirement. The<\/p>\n
 Communication Accounts Officer(Pension) of the<\/p>\n
 Office of the CCA, Trivandrum issued a sanction<\/p>\n
 order for payment of gratuity and commuted value<\/p>\n
 of pension after withholding the total amount<\/p>\n
 covered    by   the attachment  orders\/prohibitory<\/p>\n
 orders. The respondent challenged it by filing a<\/p>\n
 writ petition before this Court which, in turn,<\/p>\n
 was transferred to the CAT when BSNL was brought<\/p>\n
 under the jurisdiction of that Tribunal.<\/p>\n
2.The plea of the respondent was that the order<\/p>\n
 withholding gratuity is illegal and no dues other<\/p>\n
 than     Government dues    are recoverable   from<\/p>\n
 gratuity or commuted value of pension in terms of<\/p>\n
 the provisions of the CCS(Pension) Rules, 1972<\/p>\n
 read with the Government of India orders issued<\/p>\n
 thereunder and that no gratuity or commuted value<\/p>\n
 of pension is liable for attachment in terms of<\/p>\n
 the provisions of the Code of Civil Procedure.<\/p>\n
3.The establishment, in opposition, contended that<\/p>\n

 amounts are withheld in view of the various<\/p>\n
 attachment orders\/prohibitory orders issued by<\/p>\n
 the civil courts and by the competent authorities<\/p>\n
 under the RR Act, and the DCRG and commuted value<\/p>\n
 of pension due to the officer is less than the<\/p>\n
 total     amount  covered    by    the  attachment<\/p>\n
 orders\/prohibitory orders.\n<\/p>\n<\/p>\n
4.With the aforesaid, the Tribunal proceeded to<\/p>\n
 decide the question whether the establishment was<\/p>\n
 legally permitted to withhold DCRG and commuted<\/p>\n
 value of pension. It proceeded on the basis that<\/p>\n
 recovery from DCRG and commuted value of pension<\/p>\n
 can be done only in terms of the provisions of<\/p>\n
 the CCS(Pension) Rules and the judgments of the<\/p>\n
 Apex     Court  in that     regard.  The Tribunal<\/p>\n
 accordingly held that the recoveries\/attachments<\/p>\n
 are not in conformity with the law and thereby<\/p>\n
 held    that  the establishment   could not  have<\/p>\n
 recovered or withheld any gratuity or commuted<\/p>\n
 value of pension on account of dues other than<\/p>\n
 Central Government dues. The establishment is<\/p>\n

 directed to release the withheld gratuity and the<\/p>\n
 commuted value of pension to the officer with 9%<\/p>\n
 interest from the date of his retirement till the<\/p>\n
 date of payment.\n<\/p>\n<\/p>\n
5.The establishment is before us challenging the<\/p>\n
 aforesaid decision as one without jurisdiction<\/p>\n
 and contrary to law.\n<\/p>\n<\/p>\n
6.We  have  heard  the   learned   counsel for  the<\/p>\n
 establishment and the learned counsel for the<\/p>\n
 respondent officer.\n<\/p>\n<\/p>\n
7.The learned counsel for the establishment argued<\/p>\n
 that the action taken by it and its officers were<\/p>\n
 strictly  in   conformity    with  the  prohibitory<\/p>\n
 orders\/attachment  orders    issued  by  the civil<\/p>\n
 courts as also by the authorities under the RR<\/p>\n
 Act and that in terms of the provisions of the<\/p>\n
 Code of Civil Procedure and the RR Act, the<\/p>\n
 establishment was bound to obey such attachment<\/p>\n
 orders\/prohibitory orders. It was also argued<\/p>\n

 that if the establishment or its officers had<\/p>\n
 violated  the  orders    of   attachment\/prohibitory<\/p>\n
 orders issued by the civil courts, they would<\/p>\n
 have necessarily invited penal action and further<\/p>\n
 proceedings, including      for contempt, personally<\/p>\n
 against its officers. The learned counsel for the<\/p>\n
 establishment further pointed out that without<\/p>\n
 moving the competent civil courts and having the<\/p>\n
 attachments lifted, the officer could not have<\/p>\n
 sought for any direction from the Tribunal by<\/p>\n
 mulcting the responsibility for non-disbursement<\/p>\n
 of DCRG and commuted value of pension, on the<\/p>\n
 establishment.\n<\/p>\n<\/p>\n
8.Per contra, learned counsel for the respondent<\/p>\n
 officer    made    submissions       touching   the<\/p>\n
 jurisprudential quality of gratuity and pension<\/p>\n
 and argued that those elements are no more a<\/p>\n
 bounty but entitlements of an officer who has<\/p>\n
 served the establishment. He, however, could not<\/p>\n
 find his way to get over the provisions of the<\/p>\n
 Code of Civil Procedure which oblige a garnishee<\/p>\n

 to obey the attachment\/prohibitory orders issued<\/p>\n
 by the civil courts. Equally, the provisions of<\/p>\n
 the    RR Act  which  oblige    the garnishees  and<\/p>\n
 establishments holding money, have also not been<\/p>\n
 appropriately explained, to get over them.<\/p>\n
9.The   prohibitory orders\/attachment   orders  are<\/p>\n
 issued   by  the  competent    civil courts or   by<\/p>\n
 competent authorities under the RR Act. Those<\/p>\n
 attachment orders\/prohibitory orders oblige the<\/p>\n
 persons who have the custody of the money, to act<\/p>\n
 in terms of those orders. Otherwise, they would<\/p>\n
 be visited with penal consequences in terms of<\/p>\n
 the Code of Civil Procedure and RR Act. There can<\/p>\n
 be no dispute on this.\n<\/p>\n<\/p>\n
10.Now, the jurisdiction of a Tribunal established<\/p>\n
 under    the  provisions     of the  Administrative<\/p>\n
 Tribunals Act, 1985 does not in any manner extend<\/p>\n
 to sitting in judgment on the correctness or<\/p>\n
 otherwise of a judicial order of a civil court or<\/p>\n
 even an order issued by the statutory authority<\/p>\n

 under the RR Act. An officer of an establishment<\/p>\n
 within the jurisdiction of the Tribunal cannot<\/p>\n
 seek relief therefrom qua an attaching creditor.<\/p>\n
 The officer not having moved the competent civil<\/p>\n
 court or the appropriate authority under the RR<\/p>\n
 Act     for lifting   the    attachment\/prohibitory<\/p>\n
 orders, which are issued invoking the provisions<\/p>\n
 of the CPC or the RR Act, as the case may be, is<\/p>\n
 bound    by  the  effect     of  those   attachment<\/p>\n
 orders\/prohibitory orders. The Tribunal did not<\/p>\n
 have the jurisdiction to sit in judgment on the<\/p>\n
 correctness   or  otherwise    of  the  orders  of<\/p>\n
 attachments\/prohibitory orders issued under the<\/p>\n
 CPC or the RR Act. Therefore, the Tribunal acted<\/p>\n
 wholly    without  jurisdiction    in   essentially<\/p>\n
 interfering       with        those      attachment<\/p>\n
 orders\/prohibitory   orders    by   directing  the<\/p>\n
 establishment   to release    the  amounts to  the<\/p>\n
 respondent.\n<\/p>\n<\/p>\n
11.We are also surprised at the procedure adopted<\/p>\n
 by the Tribunal in having sat in judgment on the<\/p>\n
WPC2493\/10            -: 8 :-<\/span><\/p>\n
 entitlement   of  the      different  creditors   in<\/p>\n
 different   civil  suits     and   RR   proceedings,<\/p>\n
 including KSFE and a District Co-operative Bank<\/p>\n
 in a proceeding in which they were not even<\/p>\n
 parties. Even if they were made parties, the<\/p>\n
 Tribunal did not have jurisdiction to adjudicate<\/p>\n
 on any issue arising between those parties and<\/p>\n
 the officer under the terms of the contracts<\/p>\n
 between them.\n<\/p>\n
 For the aforesaid reasons, we find no ground to<\/p>\n
 sustain the impugned order of the Tribunal. The<\/p>\n
 same    is quashed. The     writ   petition  allowed<\/p>\n
 accordingly. No costs.\n<\/p>\n<\/p>\n
