The petitioner has granted<br \/>\ncertificate of authority as an agent. On 20.10.2003, one<br \/>\nThakarshibhai Keshraji Dabhi filed one criminal complaint against the<br \/>\npetitioner for the alleged offences punishable under Sections 406 and<br \/>\n420 of the Indian Penal Code. The petitioner has been granted<br \/>\nanticipatory bail by the City Sessions Court. On the basis of the<br \/>\nsame set of allegations, the respondent No.2 without affording<br \/>\nreasonable opportunity to the petitioner and in violation of<br \/>\nprinciples of natural justice suspended the certificate of authority<br \/>\nof the petitioner by an order dated 08.12.2003. Hence, this petition.\n<\/p>\n<p>3.0\tThis<br \/>\nCourt initially issued notice on 16.12.2003.  It will be important to<br \/>\nnote that this Court while issuing notice, incorporated the following<br \/>\nobservations in paragraph No.6:\n<\/p>\n<p> It<br \/>\nis clarified that failure on the part of the respondents nos. 2 and 3<br \/>\nin appearing before the court and explaining the contingency brought<br \/>\nbefore this court, appropriate order of interim protection will be<br \/>\npassed o the returnable date.  DS to&#8230;&#8230;&#8230;&#8230;&#8230;\n<\/p>\n<p>3.1\tOn<br \/>\n18.12.2003, the Court passed further order.  Relevant part of which<br \/>\nreads as under:\n<\/p>\n<p> In<br \/>\nview of above, in the interest of justice, the impugned order<br \/>\nsuspending the licence dated 08.12.2003 issued by respondent no.2  is<br \/>\nhereby placed under suspension till the next date of hearing.\n<\/p>\n<p>4.0\tThe<br \/>\nmatter then came up for hearing on 28.01.2004.  On that day, the<br \/>\nCourt granted ad- interim stay in terms of paragraph No. 17(B), on<br \/>\ncondition that the petitioner shall not take up new clients.\n<\/p>\n<p>5.0\tOn<br \/>\n02.11.2004, this Court after hearing the learned advocates and after<br \/>\ntaking into consideration the affidavits filed by the respondents,<br \/>\nadmitted the matter and ordered the interim relief to continue.  The<br \/>\nCourt also observed that:\n<\/p>\n<p> &#8230;&#8230;.\n<\/p>\n<p>It will be open for the respondents to conduct inquiry against the<br \/>\npetitioner under the Rules.   It will be open for the respondents<br \/>\nto approach this Court for modification or vacating of interim<br \/>\nrelief, if the inquiry is conducted within one year from today.\n<\/p>\n<p>6.0\tAs<br \/>\nthe respondents have not moved any application either for<br \/>\nmodification or vacating the interim relief, the petitioner has filed<br \/>\nCivil Application No. 8583 of 2006 for confirmation of the ad-interim<br \/>\nrelief granted earlier.\n<\/p>\n<p>7.0\tThereafter,<br \/>\non 09.07.2007 this court has passed the following order in Civil<br \/>\nApplication No. 8583 of 2006.\n<\/p>\n<p>\t This<br \/>\napplication is filed for confirmation of\tthe ad-interim relief<br \/>\n\tgranted earlier staying\tthe order dated 25\/7\/2006.  I have heard Mr.<br \/>\n\tUmesh Trivedi, learned advocate for the\tapplicant and Mr. Jadeja,<br \/>\n\tlearned advocate for\tnewly added respondent. Mr. Trivedi<br \/>\nhas\tsubmitted that after due inquiry carried out by\trespondent no. 2<br \/>\n  the Postal \tAuthority, the\tapplicant has been given a clean-chit<br \/>\nand it is \theld that the applicant has not committed any\tirregularity<br \/>\nas alleged against her. Mr. Jadeja, \thowever, opposes the report. He<br \/>\nfurther states\tthat newly\tadded respondent wishes to\tchallenge the<br \/>\nsaid report by filing\tappropriate \tproceedings. However, in view of<br \/>\nthe report, the \tad-interim\trelief is required to be confirmed\tand<br \/>\nhence this application is granted\tand ad-\tinterim relief granted<br \/>\nearlier is confirmed and\tthe applicant is \tnow at liberty to have<br \/>\nnew\tclients.\n<\/p>\n<p>\t\tIt<br \/>\nis also clarified that if any proceedings \tare taken up by<br \/>\nnewly\tadded respondent to\tchallenge the report of respondent no. 2,<br \/>\nit\twill be\topen for the said respondent to move\tapplication for<br \/>\nvacation of the\tinterim relief in \tthe event of his succeeding in<br \/>\nproceedings\tchallenging\tthe said report.  The said report\tis taken on<br \/>\nrecord.\n<\/p>\n<p>8.0\tPursuant<br \/>\nto the above order passed by this Hon&#8217;ble Court as per the<br \/>\ninformation of the applicant, Postal authority as well as the<br \/>\nrespondent No.2 herein, have already concluded the inquiry.  If at<br \/>\nall the result of inquiry would have been against the applicant, the<br \/>\nPostal authority would have immediately filed an application for<br \/>\nmodification or vacating interim relief, as the liberty was reserved<br \/>\nfor them. This is one of the reasons that no irregularity is found<br \/>\nagainst the applicant.  Furthermore,<br \/>\nthe agency of the applicant was valid upto 30\/06\/2006 which has been<br \/>\nfurther extended upto 30\/06\/2009.\n<\/p>\n<p>9.0\tIn<br \/>\nview of the fact that after 02.11.2004, the respondents have not<br \/>\nmoved either for modification or for vacating the interim relief,<br \/>\nthere is a reason for this Court to accept the request of the<br \/>\napplicant   original petitioner and grant the relief as prayed for.\n<\/p>\n<p>10.0<br \/>\nAfter impleading the newly added party as respondent No.4 in the main<br \/>\npetition, immediately thereafter the reply was filed by the<br \/>\nrespondent No.4 stating that the civil application filed by the<br \/>\npetitioner is required to be rejected.\n<\/p>\n<p>11.0<br \/>\nIt is clear that as there is no irregularity found against the<br \/>\npetitioner, there is no application filed by the respondent for<br \/>\nvacation of interim-relief granted to the petitioner. The agency<br \/>\nof the applicant was valid upto 30\/06\/2006 which has been further<br \/>\nextended upto 30\/06\/2009 and further it was extended upto 30.06.2012.<br \/>\nIn that view of the matter, nothing is pointed out not to grant the<br \/>\nprayers made in this petition. I am also of the view that the<br \/>\npetition can be disposed of in terms of interlocutory order.\n<\/p>\n<p>12.0<br \/>\nFor the foregoing reasons the petitioner will be governed by the<br \/>\ninterlocutory order passed by this Court. Rule is made absolute<br \/>\naccordingly with no order as to costs.
