P (C) No. 8513 of 2009\n                =-=-=-=-=-=-=-=-=--=-=-=-=-=-=-=-=-=\n                    Dated this, the 17th March, 2009.\n\n                               J U D G M E N T\n<\/pre>\n<p>      The petitioner is an establishment, which was sought to be<\/p>\n<p>covered under the Employees Provident Funds and Miscellaneous<\/p>\n<p>Provisions Act.      Ext. P1 order was passed by the 2nd respondent<\/p>\n<p>assessing contributions payable by the petitioner under the Act. The<\/p>\n<p>petitioner claims that they have engaged an advocate to file an<\/p>\n<p>appeal     before the Tribunal against that order. But, unfortunately,<\/p>\n<p>according to the petitioner, the advocate did not file the appeal. The<\/p>\n<p>petitioner knew about the non-filing of the appeal only when<\/p>\n<p>prosecution notice was issued to the petitioner. By that time, the<\/p>\n<p>period prescribed for filing an appeal even with a petition to condone<\/p>\n<p>delay had expired.        The petitioner therefore seeks the following<\/p>\n<p>reliefs:\n<\/p>\n<\/p>\n<blockquote><p>       &#8220;i.    Issue a writ of certiorari or any other appropriate writ,<br \/>\n       direction or order calling for the records leading to Exhibit P1, P5<br \/>\n       and P7 orders and quash the same orders.\n<\/p><\/blockquote>\n<blockquote><p>       ii.    Issue a writ of mandamus or any other appropriate writ,<br \/>\n       direction or order      directing the 4th respondent Tribunal to<br \/>\n       condone the delay in filing the appeal being filed by the petitioner<br \/>\n       under Section 7-I of the EPF and MP Act and consider the appeal<br \/>\n       and the petitions filed along with the same on merits as if they<br \/>\n       were filed in time.\n<\/p><\/blockquote>\n<blockquote><p>       iii.   Issue a writ of mandamus or any other appropriate writ,<br \/>\n       direction or order declaring that the petitioner is not bound to<br \/>\n       pay any amount pursuant to Ext. P1 order passed by the 2nd<br \/>\n       respondent.\n<\/p><\/blockquote>\n<blockquote><p>       iv.    Issue a writ of mandamus or any other appropriate writ,<br \/>\n       direction or order staying the operation and implementation of<br \/>\n       Exhibit P1, P5 and P7 orders until the appeal and petitions being<br \/>\n       filed by the petitioner before the Employees provident Fund<br \/>\n       Appellate Tribunal, New Delhi are considered and order was are<br \/>\n       passed.&#8221;<\/p><\/blockquote>\n<p>      2. The petitioner&#8217;s contention is that           this Court has ample<\/p>\n<p><span class=\"hidden_text\">W.P.C. No. 8513\/09.               -: 2 :-<\/span><\/p>\n<p>powers to direct the Tribunal to entertain a time barred appeal. The<\/p>\n<p>petitioner relies on the decision of <a href=\"\/doc\/637420\/\">Danda Rajeshwari v. Bodavula<\/p>\n<p>Hanumayamma and others<\/a>, (1996) 6 SCC 199.\n<\/p>\n<p>       3.   A Division Bench of this Court           has, in <a href=\"\/doc\/1051065\/\">Assistant<\/p>\n<p>Commisioner of Central Excise v. Krishna Poduval,<\/a> 2005 (4) KLT<\/p>\n<p>947, held that this Court in exercise of powers under Article 226 of<\/p>\n<p>the Constitution of India cannot direct the Tribunal to interfere an<\/p>\n<p>appeal when the period for which the Tribunal can condone delay in<\/p>\n<p>filing of the appeal has also expired. This Court has categorically held<\/p>\n<p>that Article 226 cannot be invoked to resurrect a time barred appeal.<\/p>\n<p>The decision relied on by the petitioner is not applicable to the facts of<\/p>\n<p>this case. If the petitioner has a grievance against the advocate, it is<\/p>\n<p>for them to proceed against the advocate appropriately. The default<\/p>\n<p>on the part of the advocate, even if true, is no ground to direct<\/p>\n<p>consideration of a time barred appeal by the Tribunal for considering<\/p>\n<p>which Tribunal has no power under law.\n<\/p>\n<p>       In the above circumstances, the writ petition is dismissed.<\/p>\n<p>                                         Sd\/- S.
