Petitioner has<br \/>\n\tchallenged award passed by Labour Court Palanpur District<br \/>\n\tBanaskantha in Reference NO. 253\/96 (Old No. 1949\/91) Exh. 47 dated<br \/>\n\t11.12.2009 wherein labour court has granted only 30 per cent back<br \/>\n\twages for a period from the date of termination till date of<br \/>\n\tretirement of workman to concerned workman.\n<\/p>\n<p>Learned<br \/>\n\tAdvocate Mr. Munshaw raised contention that the respondent was<br \/>\n\tappointed on ad hoc basis for maintenance and repairs of Road,<br \/>\n\tsubject to receiving grant from the Government. Respondent has not<br \/>\n\testablished 240 days continuous service before labour court. As per<br \/>\n\tAnnexure D page 25\/A, working days of workman have been given<br \/>\n\twherein for none of year from 1982 to 1987, workman has been<br \/>\n\tcompleting 240 days continuous service and, therefore, labour court<br \/>\n\thas committed gross error while coming to conclusion as per page 22<br \/>\n\tthat workman has completed 240 days continuous service by drawing<br \/>\n\tadverse inference on the ground that total and complete record has<br \/>\n\tnot been produced by petitioner. He submitted that labour court has<br \/>\n\tnot granted reinstatement because workman has reached the age of<br \/>\n\tsuperannuation and, therefore, 30% back wages granted for which<br \/>\n\tlabour court is having no jurisdiction to pass such award,<br \/>\n\ttherefore, according to him, labour court has committed gross error<br \/>\n\twhich would require interference of this Court.\n<\/p>\n<p>I<br \/>\n\thave considered submissions made by learned Advocate Mr. Munshaw. I<br \/>\n\thave also perused award passed by labour court. I have also<br \/>\n\tconsidered statement of claim filed by workman who was working as<br \/>\n\tlabourer with effect from 1975 with petitioner panchayat and his<br \/>\n\tservice was terminated on 1st November, 1988. Written<br \/>\n\tStatement was filed by petitioner before labour court denying<br \/>\n\taverments made by workman in his statement of claim. Thereafter,<br \/>\n\toral evidence of witness for establishment Shri PJ Balia was<br \/>\n\trecorded at Exh. 30. He was also cross examined by representative<br \/>\n\tfor workman. Labour court has considered statement of claim, written<br \/>\n\tstatement and evidence of witness for petitioner. Dispute has been<br \/>\n\treferred to for adjudication on 25.9.1991. As per the statement of<br \/>\n\tclaim filed by workman, he was earlier in service with petitioner<br \/>\n\tfor about thirteen years from 1975 to 1988. Written statement was<br \/>\n\tfiled at Exh. 22.Thereafter, vide Exh. 13 and Exh. 17, certain<br \/>\n\tdocuments were produced by workman before labour court. Workman was<br \/>\n\texamined vide Exh. 12 and for petitioner, certain documents are<br \/>\n\tproduced on record vide Exh. 31 and one witness Shri PJ Balia was<br \/>\n\texamined at Exh. 30 before labour court and thereafter, issues have<br \/>\n\tbeen framed by labour court and issues no.1 and 2 are decided by<br \/>\n\tlabour court in para 6.\n<\/p>\n<p>After<br \/>\n\tconsidering evidence on record, labour court has rightly come to<br \/>\n\tconclusion that workman was appointed on 15th December,<br \/>\n\t1975 and he remained in service upto 1988 and therefore, workman has<br \/>\n\tworked as daily wager with petitioner. Labour Court has considered<br \/>\n\tevidence of workman Exh. 12. Labour court considered evidence of<br \/>\n\twitness for petitioner at Exh. 30 wherein it was deposed by him that<br \/>\n\tfor the year 1987-88, workman has worked for total actual 215 days.<br \/>\n\tIn year of 1984-85, completed 271 days continuous service. Then,<br \/>\n\tlabour court considered cross examination of said witness for<br \/>\n\tpetitioner Exh. 30 wherein it was admitted by him that  while<br \/>\n\tconsidering working days, Sundays and Public Holidays have not been<br \/>\n\ttaken into consideration. Therefore, labour court held that if<br \/>\n\tSundays and Public Holidays are included in total working days for<br \/>\n\tthe year 1987-88, then, workman has completed 240 days continuous<br \/>\n\tservice as per decision of this court reported in 2000(3) GLH page<br \/>\n\t322 in case of State of Gujarat versus  Navinchandra Mandavia and<br \/>\n\tanotehr decision of this court in case of St ate of Gujarat versus<br \/>\n\tJM Raval, 2005 (1) GLH page 340.\n<\/p>\n<p>In<br \/>\n\tview of these facts, labour court has rightly come to conclusion<br \/>\n\tthat workman has established completion of 240 days continuous<br \/>\n\tservice and his service was terminated in breach of section 25F of<br \/>\n\tID Act, 1947, on the basis of evidence on record and, therefore,<br \/>\n\tconsidering evidence of workman, at the time of giving evidence, age<br \/>\n\tof workman was 55 years and complaint was made on 25th<br \/>\n\tJuly 1991, he was aged about 40 years. In view of this back ground,<br \/>\n\tlabour court has considered evidence of workman wherein workman has<br \/>\n\tstated that he has remained unemployed but it has not been stated<br \/>\n\twhether he has made effort for getting job at any place or not.<br \/>\n\tDeposition was given by workman on 30.11.2000. Labour court has come<br \/>\n\tto conclusion that because of carelessness of both parties,<br \/>\n\tadjudication of reference has been delayed. Considering these<br \/>\n\taspects, labour court granted only 30 per cent back wages for<br \/>\n\tinterim period from date of termination till date of retirement of<br \/>\n\tworkman. Therefore, contentions raised by learned Advocate Mr. HS<br \/>\n\tMunshaw for petitioner cannot be accepted because labour court has<br \/>\n\trightly applied mind and after this much delay from 1991 to 2010,<br \/>\n\tnatural relief of reinstatement is having no much effective meaning<br \/>\n\tbecause within short time, workman would retire and, therefore,<br \/>\n\tinstead of granting reinstatement, labour court granted 30 per cent<br \/>\n\tback wages for interim period. Labour Court is having power and<br \/>\n\tjurisdiction under section 11A of ID Act, 1947, in case, if labour<br \/>\n\tcourt is satisfied that termination order is unjustified, means not<br \/>\n\tjustified by employer, then, to pass appropriate orders on some<br \/>\n\tconditions while exercising discretionary jurisdiction in favour of<br \/>\n\tworkman, therefore, contentions raised by learned advocate MR.<br \/>\n\tMunshaw that labour court has no jurisdiction, cannot be accepted.<br \/>\n\tEntire matter has been examined by labour court on the basis of<br \/>\n\talmost undisputed facts and accordingly relief has been granted<br \/>\n\twhile keeping in mind delay occurred in deciding reference, for<br \/>\n\tthat, Apex Court has held in reported decision 2009 AIR SCW 2904<br \/>\n\tthat due to delay, if relief not granted to workman for which<br \/>\n\tworkman is entitled, then, it amounts to that workman would suffer<br \/>\n\tdouble jeopardy, therefore,according to my opinion, labour court has<br \/>\n\tnot committed any error which would require interference of this<br \/>\n\tcourt. Bhikubhai Meghjibhai Chavda<\/a><br \/>\n\t  2010 AIR SCW 542 (iv) <a href=\"\/doc\/1863297\/\">Krishan Singh v. Executive Engineer,<br \/>\n\tHaryana State Agriculture Marketting Board, Rohtak (Haryana)<\/a> &#8211; 2010<br \/>\n\t(2) Scale 848].\n<\/p>\n<p>In<br \/>\n\tview of above discussion, contentions raised by learned Advocate Mr.<br \/>\n\tMunshaw before this Court cannot be accepted and same are therefore<br \/>\n\trejected accordingly.\n<\/p>\n<p>Accordingly,<br \/>\n\tthere is no substance in this petition and same is therefore,<br \/>\n\trequired to be dismissed.
