No.34184 of 2010\n                                  MD.IDRIS KHAN\n                                         Versus\n                               THE STATE OF BIHAR\n                                       -----------\n<\/pre>\n<p>2   15.9.2010             This is an application for modification<\/p>\n<p>                of order dated 13.1.2010 passed in Cr.Misc.No.<\/p>\n<p>                45466 of 2009 in which petitioner was allowed<\/p>\n<p>                anticipatory bail in the event of his arrest or<\/p>\n<p>                surrender in the court below within one month<\/p>\n<p>                from    the    date    of   communication      of    the    order<\/p>\n<p>                dated 13.1.2010. However, it is submitted that<\/p>\n<p>                the     petitioner      failed   to     surrender      in     the<\/p>\n<p>                prescribed time for the reasons that during that<\/p>\n<p>                period    he    was    in   Punjab    for    his    livelihood.<\/p>\n<p>                After    the    said    order,   he    was    informed      by   a<\/p>\n<p>                family member but due to illness he could not<\/p>\n<p>                reach to his village in time and his stipulated<\/p>\n<p>                period of surrender expired.
