DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 14\/11\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>\tHeard<br \/>\nthe learned advocates for the parties.\n<\/p>\n<p>\tLearned<br \/>\nadvocate for the petitioner would submit that the recovery of arrears<br \/>\nof salary pursuant to grant of first higher pay-scale is illegal in<br \/>\nas much as no hearing was afforded to the petitioner and, in addition<br \/>\nto the above, the petitioner had not misrepresented or influenced the<br \/>\nAuthorities to grant the higher pay-scale.\n<\/p>\n<p>\tIn<br \/>\nview of the above, the matter deserves consideration.\n<\/p>\n<p>\tRule<br \/>\nreturnable on 21.12.2011.\n<\/p>\n<p>\tIn<br \/>\nthe meanwhile, no recovery be effected pursuant to the impugned<br \/>\norder.\n<\/p>\n<p>\tLearned<br \/>\nadvocate Mr. Arpit A.
