RAMKUMAR, J.\n                      * * * * * * * * * * * * * *\n               Bail Application No.4548 of 2010\n                  * * * * * * * * * * * * * * * * * * *\n               DATED: 13th day of August, 2010\n\n                              O R D E R\n<\/pre>\n<p>       Petitioner, who is the 4th accused in Crime No.382\/2008 of<\/p>\n<p>Munnar Police Station for an offence punishable under Sec. 20(b)<\/p>\n<p>(ii) B of the NDPS Act, seeks his enlargement on bail.<\/p>\n<p>       2.    The learned Public Prosecutor on instructions submitted<\/p>\n<p>that no final report has been filed even after 60 days of judicial<\/p>\n<p>custody of the petitioner. If so, by virtue of the proviso to sec.167<\/p>\n<p>(2) Cr.P.C. the petitioner is entitled to be released on bail as of<\/p>\n<p>right.\n<\/p>\n<\/p>\n<p>       3. Accordingly, the petitioner is directed to be released on<\/p>\n<p>bail on his executing a bond for Rs.25,000\/- (Rupees twenty five<\/p>\n<p>thousand only) with two solvent sureties each for the like amount<\/p>\n<p>to the satisfaction of the Special Court for NDPS Act Cases,<\/p>\n<p>Thodupuzha and subject to the following conditions:-<\/p>\n<p>Bail Application No.4548 of 2010<br \/>\n<span class=\"hidden_text\">                                     2<\/span><\/p>\n<p>             1.     Petitioner   shall   report    before    the<\/p>\n<p>             Investigating Officer between 9 a.m. and 11 a.m.<\/p>\n<p>             on all Wednesdays.\n<\/p>\n<\/p>\n<p>             2. Petitioner shall not influence or intimidate the<\/p>\n<p>             prosecution witnesses nor shall he attempt to<\/p>\n<p>             tamper with the evidence for the prosecution.<\/p>\n<p>             3. The petitioner shall make himself available for<\/p>\n<p>             interrogation as and when required by the<\/p>\n<p>             investigating officer.\n<\/p>\n<\/p>\n<p>             4.
