Mr.Vakil, learned Counsel<br \/>\n\tfor the respondents &#8211; original claimants waives service of<br \/>\n\tnotice of rule.\n<\/p>\n<p>The present applications are for<br \/>\n\tinterim injunction pending the First Appeals against the judgement<br \/>\n\tand awards passed by the Reference Court in the concerned Land<br \/>\n\tReference Cases, which are the subject matter of the First Appeals.\n<\/p>\n<p>Considering the facts and<br \/>\n\tcircumstances, there shall be interim injunction against the<br \/>\n\texecution and implementation of the judgement and awards passed by<br \/>\n\tthe Reference Court, which are challenged in the concerned First<br \/>\n\tAppeals on condition that the applicant &#8211; original appellant<br \/>\n\tdeposits the entire awarded amount together with the cost and<br \/>\n\tinterest with the Reference Court within a period of eight weeks<br \/>\n\tfrom today.\n<\/p>\n<p>We have heard the learned Counsel<br \/>\n\tfor both the sides on the aspects of withdrawal.\n<\/p>\n<p>Considering the facts and<br \/>\n\tcircumstances, out of the amount, which may be deposited by the<br \/>\n\tapplicant by way of compliance of the condition, 50% of the amount<br \/>\n\tshall be permitted to be withdrawn to the original claimants and the<br \/>\n\tremaining 50% of the amount shall be invested by the Reference Court<br \/>\n\tin FDRs with a nationalized Bank, in the cumulative scheme,<br \/>\n\tinitially<br \/>\n\tfor a period of three years and such investment shall be renewed<br \/>\n\tfrom time to time, until the first appeals are finally disposed of.<br \/>\n\tThe original<br \/>\n\tFDRs shall be kept with the Nazir Department of the Court.\n<\/p>\n<p>\tThe<br \/>\n\tapplications are allowed to the aforesaid extent.
