D.S. \tpermitted.\n<\/p>\n<p>2.0\tThe<br \/>\nmatter was admitted vide order dated 30.06.1995.\n<\/p>\n<p>3.0\tIt<br \/>\nis required to be noted that the Special Civil Application No. 1301<br \/>\nof 1995 is rejected of by this Court ( Coram: S.K. Keshote, J.) vide<br \/>\norder dated 24.08.1999 which is reproduced as under:\n<\/p>\n<blockquote><p>          1.    The   petitioner,   a   retired   employee  of  the<br \/>\n        respondents, by this Special  Civil  Application  praying<br \/>\n        for  declaration  of  the  service  rules  framed  by the<br \/>\n        respondent at Annexure-D as  ultravires  to  the  Gujarat<br \/>\n        Cooperative  Societies  Employees  (Condition of Service)<br \/>\n        Rules, 1993 (hereinafter referred to as  &#8220;Rules,  1993&#8221;).<br \/>\n        The  next  prayer  has been made for the declaration that<br \/>\n        the age of superannuation of employees of the Cooperative<br \/>\n        Societies  will  be  governed   only   by   Rules,   1993<br \/>\n        aforestated.   Further  prayer  has  been made to declare<br \/>\n        that the age  of  retirement  of  the  employees  of  the<br \/>\n        Society  is  to  be  taken  to  be of 58 years as per the<br \/>\n        Rules, 1993.   Lastly,  the  prayer  has  been  made  for<br \/>\n        quashing  and setting the order at Annexure-F under which<br \/>\n        the petitioner was ordered to be retired from the service<br \/>\n        on 28\/2\/95 at the age of 55 years.\n<\/p><\/blockquote>\n<blockquote><p>        2.  The learned counsel for the petitioner contended that<br \/>\n        the  age  of superannuation of the petitioner should have<br \/>\n        been taken to be 58 years as per the Rules, 1993.  It has<br \/>\n        next been contended that as per the appointment order  of<br \/>\n        the  petitioner his retirement age should have been taken<br \/>\n        to be  58  years.    It  has  next  been  contended  that<br \/>\n        subsequently this retirement age has been increased to 60<br \/>\n        years  by  the  society  and even if this is not accepted<br \/>\n        then as per the Rules, 1993 of the State Government,  the<br \/>\n        age  of retirement should have been taken to be 58 years.<br \/>\n        Lastly,  it  is  contended  that  before   retiring   the<br \/>\n        petitioner  at  the  age  of  55 years the opportunity of<br \/>\n        hearing should have been given to him.    In  support  of<br \/>\n        this  contention  the  learned counsel for the petitioner<br \/>\n        placed reliance on the decision of the apex court in  the<br \/>\n        case of Abraham  Jacob  &amp;  Anr.    Vs.    Union  of India<br \/>\n        reported in 1998(4) SCC  65.    Mr.Shukla  supported  the<br \/>\n        impugned order.\n<\/p><\/blockquote>\n<blockquote><p>        3.  After  giving  my  thoughtful  consideration  to  the<br \/>\n        submissions made by learned counsel for the parties, I am<br \/>\n        of  the  considered  opinion that none of the contentions<br \/>\n        raised by the learned counsel for the  petitioner  is  of<br \/>\n        any merits  and substance.\n<\/p><\/blockquote>\n<blockquote><p>        4.  I do not find anything on the record of this  Special<br \/>\n        Civil  Application  wherefrom it can be taken that in the<br \/>\n        appointment order  of  the  petitioner  his  age  of  the<br \/>\n        superannuation is mentioned.  In respect of the documents<br \/>\n        at  Annexure-C,  I  find  under  some  resolution  of the<br \/>\n        Society, the age of the retirement of  the  employees  of<br \/>\n        the Society  was  raised  from  58-60 years.  The copy of<br \/>\n        that resolution has  not  been  produced  nor  any  other<br \/>\n        document  has  not  been  produced  in  support  of  this<br \/>\n        document.  Even if it is taken to be correct then too  it<br \/>\n        is  of little help to the petitioner because the Rules of<br \/>\n        the Society were amended  from  1\/4\/1990.    Under  these<br \/>\n        Rules at Annexure-D, I find that the age of retirement is<br \/>\n        provided at  the age of 55 years.  This is the Rule which<br \/>\n        has to be taken care of by the Society and the employees<br \/>\n        are to be retired at the age of 55 years.\n<\/p><\/blockquote>\n<blockquote><p>        5.   Validity  of  the  Rules  of  the  Society have been<br \/>\n        challenged on the ground as are  being  contrary  to  the<br \/>\n        Rules framed  by  the State Government.  The Rules framed<br \/>\n        by the State Government are produced  on  the  record  of<br \/>\n        this Special  Civil Application at Annexure-C.  These are<br \/>\n        only draft rules and the same cannot be acted upon.  The<br \/>\n        learned  counsel  for  the petitioner has not produced on<br \/>\n        the record of this Special Civil Application any document<br \/>\n        to show that these Rules have been finalized  ultimately.<br \/>\n        Draft  rules even if it is framed by the State Government<br \/>\n        cannot supercede the service rules framed by the  Society<br \/>\n        so  long as the same are not finalized in accordance with<br \/>\n        law.  These are  not  binding  on  the  Society  and  the<br \/>\n        service  rules  of  the  Society only on the basis of the<br \/>\n        draft rules cannot be held to be ultravires of the  same.<br \/>\n        The decision of the apex court on which reliance has been<br \/>\n        placed by the learned counsel for petitioner is of little<br \/>\n        help to  him. The  age of the superannuation has to be<br \/>\n        regulated as per  the  Rules  of  the  Society  and  what<br \/>\n        precisely it has been done in the present case.\n<\/p><\/blockquote>\n<blockquote><p>        \tIn the  result,  the  Special  Civil  Application<br \/>\n        fails and the same is dismissed.  Rule discharged.\n<\/p><\/blockquote>\n<p>3.0\tTherefore,<br \/>\nfor the reasons stated in the aforesaid judgment and order dated<br \/>\n24.08.1999, this petition is dismissed. Rule is discharged with no<br \/>\norder as to costs.
