Respondents.\n                                            ----\n              CORAM :             HON'BLE THE CHIEF JUSTICE\n                                HON'BLE MR.JUSTICE R.R.PRASAD\n                                            ---\n              For the Appellant:              Mr. A.K.Sahani.\n              For the respondents:            Mr. R.Krishna, Sr.S.C.I.\n                                      -----\n02\/17.02.2010<\/pre>\n<p>               This appeal has been preferred against the order dated<br \/>\n                21.12.2009 passed by the learned Single Judge in W.P(S)<br \/>\n                NO.5849\/2009 by which the writ petition was summarily dismissed<br \/>\n                observing therein that the impugned order of suspension was not fit<br \/>\n                to be interfered with and consequently the writ petition was<br \/>\n                dismissed as no merit was found in the same.\n<\/p>\n<p>                            The aforesaid order has been assailed on the ground<br \/>\n                that the appellant is on the verge of retirement and is due to retire<br \/>\n                on 31.07.2010. It has been stated that the appellant neither has<br \/>\n                been served with a show cause nor any enquiry still has been<br \/>\n                initiated but he has been compelled to report to a person junior to<br \/>\n                him.\n<\/p>\n<p>                                In so far as interference with the order of suspension is<br \/>\n                concerned, we find no reason to entertain this appeal against the<br \/>\n                same but we deem it just and appropriate to observe that as the<br \/>\n                appellant is on the verge of retirement, the enquiry should either be<br \/>\n                initiated expeditiously or dropped, if the charges are found<br \/>\n                unsustainable.\n<\/p>\n<p>                                If the enquiry has already been initiated, we expect<br \/>\n                the respondent-authority to complete the same by 31.04.2010.\n<\/p>\n<p>                                  The appeal is dismissed subject to the aforesaid<br \/>\n                observations.\n<\/p>\n<p>                                                         (Gyan Sudha Misra,C.J.)<\/p>\n<p>                                                               ( R.R.Prasad,J )<br \/>\nBiswas\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Jharkhand High Court Parma Nand Pandit vs State Of Jharkhand &amp; Ors on 17 February, 2010 IN THE HIGH COURT OF JHARKHAND AT R A N C H I &#8212;- L.P.A.
