2. This is    filed challenging the
\nJudgment  12.04.2006 passed in
\n the file of the Civil Judge
\n[Sr.Dn.),  Judgment and Decree dated<\/p>\n
28.11.1987 passed pin__OA’.~Sl.i*5.ol.83\/1986 on the file of the Munsiff 81<\/p>\n
.~ .J_MFC_’:,’ 5′.5riarapanahaI1i,…is. confirmed.<\/p>\n
  V0 the parties are referred to by their ranking in<\/p>\n

 gThe-essential facts leading to this appeal are that the<\/p>\n
  a”pVpel.1afnt herein, who is plaintiff in ().S.No.83\/ 1986 \ufb01led the same<\/p>\n
 “‘-ljsleelgling possession of plaint schedule property, which is a<\/p>\n
W<\/p>\n
residential house situated in Uchangidurga Village, Within the
\nregistration district of Bellary and sub-registration district of
\nHarapanahalli. Plaint schedule property is not identifiedjllpbylvhouse<\/p>\n
list number, kaneshumari number or survey nurzlipber.-._lt= is .s_liovvn<\/p>\n
to be measuring East to West 30 cubits ‘and _N”om;.  >9 <\/p>\n
cubits within the boundaries referredto   <\/p>\n
5. The plaintiff claims that hexto. of  of
\nUchangidurga Temple, the  has llseveral immovable
\nproperties spread over in   of same village.
\nThe plaint of Sy.No.41, which
\nbelongs to  ::\u00ablfi’he’lplaintiff claims to be in
\npossession of  cents of land in the said survey<\/p>\n
number. Ac’cQ__rdi.ng”to.lllriinillieelhad built a cattle shed and a “kana”<\/p>\n
 (harvest field) adjacent to: that for use and enjoyment of his family.<\/p>\n
in  says  the said portion is suit schedule property which<\/p>\n
was  the defendant for his use and occupation as<\/p>\n
V his reside–ncev,’llon a condition that as and when requested, the<\/p>\n
:”.v.4*~defeI?.clant””should vacate and return the same to the plaintiff.<\/p>\n
 Alccord*ing to plaintiff, defendant has entered into an agreement<\/p>\n
 him accepting that the plaint schedule property belongs to the<\/p>\n
‘W<\/p>\n
plaintiff, that neither he nor any members of his family have any
\nright, title or interest to claim over the same. He..’would=_be in<\/p>\n
possession of the same until he gets__–*anA'”*alter’1eati.Ve<\/p>\n
accommodation. That he would vacatethe said”property’_’anyV’tirn\u00a2”~..<\/p>\n
when he is asked to vacate the same-.’by;’th.e’ plaintijff. ‘\ufb01.C–3po’i?dingly””A ”<\/p>\n
the plaintiff requested the defendant tloaizacaterbvithepvsuitschediile ‘<\/p>\n
property for his use and enjoy4rn’ent–.Vfor  the defendant<\/p>\n
refused to do so. Hence Vthe:f’s_ui”t._ se:.;_c:king”re’coyery of possession.<\/p>\n
6. In the said.::suit,  a defence that he
\nbelongs to   earlier he was assisting
\nplaintiffsfather.fir1;:*Qondi.1jcting’ Uchangidurga temple, he
\nhas beenxin  of plaint schedule property,<\/p>\n
which is a residential’ in a portion of Sy.No.41. He has<\/p>\n
 been possession. and enjoyment of the same in his individual<\/p>\n
  more than twenty–fiVe years. The said property now<\/p>\n
standspin”l1i’s.,_na.rne in the municipal records. He has been paying<\/p>\n
6 6 tax to”~the\u00bb–._’saz’n’e from the year 1966-67, his possession for the past<\/p>\n
 “years in his individual capacity is well within the<\/p>\n
 a.i(noVwledge of the plaintiff and as well as his father.<\/p>\n
Mi<\/p>\n
knowledge and also that of his father for past twenty–five years and<\/p>\n
as such he has perfected his title over the plaint schedule property.<\/p>\n
8. With this rival contention, the Trial “the<\/p>\n
following issues:\n<\/p>\n
1} Whether the plaintiff proves”rthat’rr.he.’ is   ‘f<\/p>\n
owner of suit property?\n<\/p>\n
2} Whether the defendant\ufb01fnrovesl’thatihe  the
\nowner of 0, cents  300 “cents in
\nSy.No.41 (out'”of}pofilcihangidiurga.Village and
\nhe constructed.iafhousigg said 0.15<\/p>\n

3)  “”” “\\’fhejiher:1\u00a7:.;the”‘-defendant”proves that he got
\n0 constructed_a’*eat’:.le—shed in the area of 0.15
\n0′ cents,’ tbel–oAng:_ii;gpp”‘to the father of plaintiff —<\/p>\n
Kenchappa for that Kenchappa?\n<\/p>\n
  Wl{1etherVthe’Vp1aintiff proves that he and his
\n=.__”*fath:e’r._delivered the possession of suit house<\/p>\n
  leave and licence to the defendant?\n<\/p>\n

\n.0  Lby practising fraud upon him, has got order
\nof occupancy rights over the entire area of
\n0.30 cents in Sy.No.-41 {out of]?\n<\/p>\n

9. Matterevlrent into”tAria.1:::\u00bbBoth the parties to the suit adduced<\/p>\n
V evidehcge ‘pe.rsona1lyl_gaVnd through their Witnesses and relied upon<\/p>\n
in’cdocunfienetsfiirisupport of their case. In the said proceedings, two<\/p>\n
do’cui1*1ep1itsv,4iwhiclhvxirere filed by the plaintiff, are crucial to the suit.<\/p>\n
 The first ohe  Ex.P–I which is copy of the order passed by the<\/p>\n
 I TI*ib’u1ia1 in proceedings No.40\/1979 granting occupancy<\/p>\n
  plaintiff in respect of four items of property of<\/p>\n
ti Ue.h.ar1gidu.rga Temple. In the said order, item No.4 is Sy.No.41.<\/p>\n
Wt<\/p>\n
When the said EX.P–1 is looked into with bare eyes, pit.___cou1d be<\/p>\n
noticed that the extent mentioned as against Sy.No.ell’ to<\/p>\n
be altered. On close observation, it could be seen was<\/p>\n
written against Sy.No.41 was 15 cent_s,~which   h_ave’.bee1j1 <\/p>\n
tampered with and modified as 30 cents ” o:rert:vriting”‘fgives if<\/p>\n
credence to the theory of defendan-t..thatA’the had “informed
\nthe defendant that he  applyi_n\u00a7p’~for’=_occ1ipaney  only in
\nrespect of 15 cents and he’-yvlolilltlpnn\u00a71ELlte’ajniapplication on behalf of
\nplaintiffs yvife for- remaining::’vp  far as another
\ndocument, llliiasfrelied before the Trial
\nCourt is the ifkararu, which is admittedly
\non a plain’ white’  the document is styled as kararu,
\nthe contents lofthel ‘islrafofrelhor less similar to declaration. as if<\/p>\n
defendant is  thatvplaintiff is owner of plaint schedule<\/p>\n
 lI.3fopertyC,. neith”er_ defendant nor any member of his family has any<\/p>\n
  over any portion of said property and that<\/p>\n
  defendant  in possession of the same with the permission<\/p>\n
-plaintiffvand he would vacate and deliver the same to plaintiff.<\/p>\n
if \u00abaft-e_riseci,1ring alternative accommodation.<\/p>\n

9. Infact, in the Written Statement itself the defendant has
\ntaken a specific plea that he has not entered into anyifagrepement<\/p>\n
with the plaintiff accepting his ownership over  “the<\/p>\n
evidence he denies the signature on .Ex_._P~5_’asl’riotjV\u00bbhi’s .sign’ature. <\/p>\n
The Trial Court while discussing this   ::’:_5e.1j”i’s’onaII37″” 3<\/p>\n
compared the same with tha=\u00e9jfV_o~f__the”‘adrnitted:vlplisigriature of*the
\ndefendant on Vakalath,  has   conclusion
\nthat there is lot of variation  ‘signatures mentioned in
\nEx.P-5 and adrnitteij siglviat-tir\u00e9pfs  Based on the said
\nObservation   and circumstances of
\nthe case the   signature on Ex.P–~5 is
\nnot  proceeded to dismiss the claim.\n<\/p>\n
However,   seen that the admitted signatures<\/p>\n
of the _ defendant and the? signatures at Ex.P~5 were sent to<\/p>\n
 Science Laboratory on an application filed by the parties<\/p>\n
and a_ ‘reporth was secured. Though the said report expressed an<\/p>\n
  opinion  signature on Ex.P–5 could be that of the<\/p>\n
vf”‘\u00ab.._defendan”t,V phased on the detailed report where it refers to<\/p>\n
 ._desc.ripti_ve variations observed by the experts in comparing the<\/p>\n
 ..__”signat’ure, the First Appellate Court has come to the conclusion<\/p>\n
“”1<\/p>\n
that there is no reason to disbelieve the observation of the Trial
\nCourt, which is further confirmed by the descriptive observation of<\/p>\n
exhibits, wherein the hand writing expert tjh_,a”t._ the<\/p>\n
signatures could be same, the First Appellate  isA_l.g2i4ided~lTnore<\/p>\n
by the opinion of the Trial Court  and <\/p>\n
circumstances of the case, has prodceedeyd  :i\u00a7c\ufb01n\u00a7\u00a2:;:at
\nEX.P–5 is not executed by the deferidanthami tii’\u00a24’V156s’\u00a7ess:\u00a7\ufb01 of
\nthe defendant over pla.irit schedule; pmpertylis  permissive
\npossession as claimed   the defendant is in
\npossession of the.:;su_i,t   capacity. With<\/p>\n
this, the First  C–o__urtVh\u00e9astdconfirmed the Judgment and<\/p>\n
Decree of the”T’ri.al\n<\/p>\n
10. On perusal’ of eritirelilrecord consisting of pleadings, oral<\/p>\n
and t’1oc:1mentaryd”evid-ence led by both the parties, more<\/p>\n
  thedocuments, which are marked as Exs.P–i and P5<\/p>\n
  made by both the Courts in that behalf as<\/p>\n
._  refermfd t’0’Sii~pAra, this Court strongly believes that there is no<\/p>\n
 to interfere with the well reasoned Judgment and<\/p>\n
A  yrbecreeitof both the Courts giving concurrent findings regarding the<\/p>\n
  l.rpo_s\u00a7session, enjoyment of defendant over plaint schedule property<\/p>\n
“*1<\/p>\n
in his individual capacity and refusing to accept the claim of the
\nplaintiff that the plaint schedule property belongs and<\/p>\n
defendant is in permissive possession thereof, th’e”e.ritire5 dispute<\/p>\n
between the parties herein is the one which thy<\/p>\n
both the Courts looking into the  preposition’:  the <\/p>\n
documentary and oral evidence of thepartiess:~*\ufb01e’refore.thereois
\nno scope for framing substantiaiitpi.Vquestioizdof:iau;1\u00bb$.;qdecideVthe
\ncorrectness or otherwise   of both the
\nCourts. Hence this Court Vishot  there is no scope
\nfor framing any  and further that there<\/p>\n
is no infirrnit\ufb01 o:r”‘il:iegia1ity’-vifr,-rA’the”:AJu’r1grnent and Decree passed by<\/p>\n
both the ”  iriterference in this appeal.\n<\/p>\n
Therefore, there is  appeal and hence the same<\/p>\n
does not _ require’  ‘  a-drriitted. Accordingly, the appeal is<\/p>\n
dis’n1issed Witiiout. any order as to costs.<\/p>\n
