No.838 of 2008\n          ------------------------------------------------\n          Dated this the 14th day of January, 2009\n\n                            ORDER\n<\/pre>\n<p>    This    is          an          application              seeking<\/p>\n<p>condonation of delay of as much as 250 days in<\/p>\n<p>filing the C.R.P. The impugned order is one<\/p>\n<p>passed   on     26\/09\/07               on        E.P.219\/03       in<\/p>\n<p>L.A.R.450\/1988 wherein the petitioner was the<\/p>\n<p>second  judgment        debtor.            Though         order  was<\/p>\n<p>passed on 26\/09\/07, copy was applied for only<\/p>\n<p>on 24\/11\/07, after about two months. Stamp<\/p>\n<p>papers called for on 16\/01\/08 were produced on<\/p>\n<p>21\/01\/08  and      though          copy         was       ready  and<\/p>\n<p>14\/02\/08 was fixed as the date to appear to<\/p>\n<p>receive copy, copy was taken delivery of only<\/p>\n<p>on 12\/11\/08. The delay sought to be explained<\/p>\n<p>(though not satisfactory) is only the delay in<\/p>\n<p>submitting    copy           application.                 There   is<\/p>\n<p>absolutely no explanation in the affidavit<\/p>\n<p>C. M. Appl. No.1041 of 2008 &amp;<br \/>\n<span class=\"hidden_text\">C. R. P. No.838 of 2008              -2-<\/span><\/p>\n<p>         accompanying the C.M. Application as to why no<\/p>\n<p>         enquiry was made as to whether the copy was<\/p>\n<p>         ready and copy was taken delivery of only on<\/p>\n<p>         12\/11\/08, almost after nine months of the date<\/p>\n<p>         fixed         to    receive   the  copy.   In   the<\/p>\n<p>         circumstances, there is no reason or just and<\/p>\n<p>         sufficient cause to condone the delay of 250<\/p>\n<p>         days       in      filing  the  C.R.P.   This  C.M.<\/p>\n<p>         Application is hence, dismissed.
