PUBLIC\nPROSECUTOR for\nApplicant(s) : 1, \nNone for Respondent(s) : 1 -\n2. \n=========================================\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE RAJESH H.SHUKLA\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 21\/04\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>\tRule.\n<\/p>\n<p>\tThe<br \/>\npresent application has been filed by the applicant-State under Sec.<br \/>\n439(2) read with sec. 482 of the Code of Criminal Procedure for<br \/>\ncancellation of bail granted to the respondents-accused as per the<br \/>\norder passed in Criminal Misc. Application No. 557 of 2010 by the<br \/>\nSessions Court vide judgment and order dated 10.1.2011 on the grounds<br \/>\nstated in the Memo of the petition.\n<\/p>\n<p>2.\tLearned<br \/>\nAPP Mr. Kartik Pandya ha stated that the offence is under sec. 302 of<br \/>\nIPC and all the accused including the present applicants-accused have<br \/>\nbeen attributed with the role and they have indiscriminately<br \/>\nassaulted the deceased and therefore the present application may be<br \/>\nallowed.\n<\/p>\n<p>3.\tThough<br \/>\nthe submissions have been made, as can be seen from the impugned<br \/>\norder passed by the Sessions Court itself, the investigation is over<br \/>\nand the weapon which has been recovered from the respondents accused<br \/>\ndoes not have any bloodstains matching with the blood group of the<br \/>\ndeceased as per the FSL report.  Further, it is a case of<br \/>\ncross-complaint.\n<\/p>\n<p>4.\tTherefore,<br \/>\nhaving regard to the facts and also considering the guidelines with<br \/>\nregard to cancellation of bail, the court is not inclined to<br \/>\nentertain the present application.\n<\/p>\n<p>5.\tIt<br \/>\nis well-settled that the criteria for grant of bail and cancellation<br \/>\nof bail are different. The Hon&#8217;ble Apex Court in a judgment in the<br \/>\ncase of <a href=\"\/doc\/238832\/\">Savitri Agarwal and ors. v. State of Maharashtra and<\/a> anr.,<br \/>\nreported in (2009) 8 SCC 325, has observed that the<br \/>\ncriteria\/parameters for cancellation of bail are different than grant<br \/>\nof bail and cogent and convincing circumstances are necessary for<br \/>\ndirecting cancellation of bail already granted.  In the case of<br \/>\n<a href=\"\/doc\/1935147\/\">Dinesh M.N. (S.P.) v. State of Gujarat,<\/a> reported in AIR 2008<br \/>\nSC 2318, the Hon&#8217;ble Apex Court has laid down parameters for<br \/>\ncancellation of bail observing that the criteria for cancellation of<br \/>\nbail is more stringent and unless necessary ingredients or parameters<br \/>\nare fulfilled, the bail cannot be cancelled.\n<\/p>\n<p>6.\tTherefore,<br \/>\nconsidering these aspects the court is not inclined to entertain the<br \/>\npresent application and the same deserves to be rejected and<br \/>\naccordingly stands rejected.
