Rule. Mr.L.R.Poojari, learned<br \/>\nAdditional Public Prosecutor and Mr.H.M.Prachak,  learned advocate<br \/>\nwaive service of rule on behalf of  respondent Nos.1 &#8211; State<br \/>\nand 2 respectively.\n<\/p>\n<p>2.\t\tThe<br \/>\npresent application under Sec.482 of the Code of Criminal Procedure<br \/>\nhas been filed for quashing of complaint \/ FIR registered as<br \/>\nC.R.No.I-44 of 2011 before Vanthali Police Station, District Junagadh<br \/>\nfor the offences punishable under Sections 386 and 34  of Indian<br \/>\nPenal Code.\n<\/p>\n<p>3.\t\tIt<br \/>\nis jointly submitted by the learned Advocates for the parties that<br \/>\nthe dispute is settled between the parties and a compromise has been<br \/>\narrived at between the parties.   Complainant is present before  the<br \/>\nCourt and he is identified by the learned Advocate. It is submitted<br \/>\nby complainant that the matter is settled between the parties and he<br \/>\nhas no grievance against present applicant. Affidavit of complainant<br \/>\nto this effect is also placed on record. It is further submitted by<br \/>\ncomplainant to quash the complaint.\n<\/p>\n<p>4.\t\tIt<br \/>\nis submitted by learned APP that he has verified the settlement terms<br \/>\nand it is requested to pass appropriate order.\n<\/p>\n<p>5.\t\tThe<br \/>\nApex Court in the case of Madan Mohan Abbot Vs. State of Punjab<br \/>\nreported in (2008)4  Supreme Court Cases page 582 has<br \/>\nobserved as under in paras 5 and<br \/>\n7 of the judgment:\n<\/p>\n<p>&#8220;5.\tIt<br \/>\nis on the basis of this compromise that the application was filed in<br \/>\nthe High Court for quashing of proceedings which  has been dismissed<br \/>\nby the impugned order.  We notice from a  reading of the FIR and the<br \/>\nother documents on record that the  dispute was purely a personal one<br \/>\nbetween two contesting  parties and that it arose out of extensive<br \/>\nbusiness dealings  between them and that there was absolutely no<br \/>\npublic policy  involved in the nature of the allegations made against<br \/>\nthe accused.   We are, therefore, of the opinion that no useful<br \/>\npurpose would be served in continuing with the proceedings in the<br \/>\nlight of the compromise and also in the light of the fact that the<br \/>\ncomplainant has, on 11th January 2004,  passed away and the<br \/>\npossibility of a conviction being recorded has thus to be ruled out.&#8221;\n<\/p>\n<p>&#8220;7.\n<\/p>\n<p>We see from the impugned order that the learned Judge has confused a<br \/>\ncompounding of an offence with the quashing of  proceedings.  The<br \/>\nouter limit of Rs.250\/- which has led to the dismissal of the<br \/>\napplication is an irrelevant factor in the later case.  We<br \/>\naccordingly allow the appeal and in the peculiar facts of the case,<br \/>\ndirect that  FIR No.155 dated 17th November 2001 P.S. Kotwali,<br \/>\nAmritsar and all proceedings connected therewith shall be deemed to<br \/>\nbe quashed.&#8221;\n<\/p>\n<p>6.\t\tConsidering<br \/>\naforesaid decision of the Hon&#8217;ble Supreme Court and settlement<br \/>\narrived between the parties, in opinion of this Court, no useful<br \/>\npurpose would be served in continuing with the criminal proceedings<br \/>\nand it will be harassment to the parties.  Hence, a case is made out<br \/>\nto exercise powers under section 482 of Criminal Procedure Code.\n<\/p>\n<p>7.\t\tIn<br \/>\nthe result, present application is allowed.  FIR being C.R.No.I-44 of<br \/>\n2011 registered with Vanthali Police Station, District Junagadh and<br \/>\nthe proceedings therein are required to be quashed and are<br \/>\naccordingly quashed.
