Justice M.SASIDHARAN NAMBIAR\n\n Dated :08\/09\/2010\n\n O R D E R\n            M.SASIDHARAN NAMBIAR,J.\n          ===========================\n           W.P.(C)No. 24321 &amp; 23440\n                     OF 2010\n          ===========================\n\n   Dated this the 8th day of September,2010\n\n                   JUDGMENT\n<\/pre>\n<p>    W.P.(C)24321\/2010 is filed by the husband<\/p>\n<p>of deceased Rekha who committed suicide on<\/p>\n<p>10.4.2010  by  hanging.    Crime   433\/2010  is<\/p>\n<p>registered under section 306 and 498A read with<\/p>\n<p>section 34 of Indian Penal Code.   Case is now<\/p>\n<p>being investigated by the Deputy Superintendent<\/p>\n<p>of Police, (Narcotic Cell), Alappuzha.     Writ<\/p>\n<p>Petition 24321\/2010 is filed seeking transfer<\/p>\n<p>of the investigation to the CBCID contending<\/p>\n<p>that it is to be investigated by a superior<\/p>\n<p>officer as the accused is a Police Constable.<\/p>\n<p>W.P.(C)23440\/2010 is filed by the wife of that<\/p>\n<p>Police  Constable   seeking  a   direction   to<\/p>\n<p>constitute a special team headed by the Senior<\/p>\n<p>Officer of Crime Branch to carry out a fair and<\/p>\n<p>W.P.(C)24321 &amp; 23440 of 2010      2<\/p>\n<p>impartial investigation. A statement is filed by<\/p>\n<p>the Investigating officer in both the cases. From<\/p>\n<p>the statement of the Investigating officer, it is<\/p>\n<p>revealed that though the accused Police Constable<\/p>\n<p>was suspended, he was not arrested.             The progress<\/p>\n<p>of the investigation reveals that the case is not<\/p>\n<p>being        properly         investigated.
