THE BLOCK DEVELOPMENT OFFICER, RUNNI SAIDPUR,\n         DISTT.- SITAMARHI\n                                      -----------\n<\/pre>\n<p>2.   22.02.2011                 Heard learned counsel for the petitioner and<\/p>\n<p>                  the State.\n<\/p>\n<p>                                The petitioner is stated to be the Mukhiya of<\/p>\n<p>                  the Bahilbada @ Gadha Gram Panchayat, Block-Runi<\/p>\n<p>                  Saidpur, District-Sitamarhi. He is aggrieved by the order<\/p>\n<p>                  dated 27.8.2010 unseating him from the post of Mukhiya<\/p>\n<p>                  in exercise of powers under Section 18(5) of the Bihar<\/p>\n<p>                  Panchayat Raj Act, 2006 (hereinafter called the &#8216;Act&#8217;)<\/p>\n<p>                  passed   by     the   Principal   Secretary,   Department   of<\/p>\n<p>                  Panchayati Raj.\n<\/p>\n<p>                                Relying upon A.I.R. 2001 SC 2524 (Tarlochan<\/p>\n<p>                  Dev Sharma Vs. State of Punjab &amp; Ors.) it is submitted<\/p>\n<p>                  that removal of an elected Mukhiya in exercise of<\/p>\n<p>                  executive powers as distinct from a no-confidence motion<\/p>\n<p>                  and debarring him from contesting election for the next<\/p>\n<p>                  five years is a serious matter.         The impugned order<br \/>\n<span class=\"hidden_text\">                   2<\/span><\/p>\n<p>suffers   from   serious   procedural   infirmities.   The<\/p>\n<p>comments of the District Magistrate on the cause shown<\/p>\n<p>by the petitioner was not made available to the petitioner<\/p>\n<p>with opportunity to rebutt the same. The Secretary has<\/p>\n<p>relied upon these comments to reject the defence of the<\/p>\n<p>petitioner for indicting him. Evidence has therefore been<\/p>\n<p>admitted behind his back denying him reasonable<\/p>\n<p>opportunity to defend himself as enshrined in Section<\/p>\n<p>18(5) of the Act. It is next submitted in so far as charge<\/p>\n<p>no. 1 is concerned, the impugned order recites that the<\/p>\n<p>District Magistrate had found the cause shown by the<\/p>\n<p>petitioner to be unsatisfactory. There is no finding of the<\/p>\n<p>statutory authority by his own independent application of<\/p>\n<p>mind.     The order therefore suffers from the vice of<\/p>\n<p>abdication of statutory power acting at the dictates of the<\/p>\n<p>District Magistrate.   With regard to charge no. 2, it is<\/p>\n<p>submitted that the comments furnished by the District<\/p>\n<p>Magistrate themselves did not satisfy the Secretary when<\/p>\n<p>he holds that it was not clear as to what exactly was the<\/p>\n<p>amount sanctioned, the amount which was allegedly mis-<\/p>\n<p>utilized to arrive at a speculative finding on assumptions<\/p>\n<p>and presumptions.\n<\/p>\n<p>            Counsel for the State finds it difficult to<\/p>\n<p>satisfy the Court from the recitals in the order dated<\/p>\n<p>27.8.2010 of independent application of mind by the<br \/>\n<span class=\"hidden_text\">                   3<\/span><\/p>\n<p>statutory authority on charge no. 1 or that the comments<\/p>\n<p>of the District Magistrate relied upon by the Secretary to<\/p>\n<p>indict the petitioner were furnished to the petitioner.<\/p>\n<p>Likewise, the Court finds that in so far as charge no. 2 is<\/p>\n<p>concerned, the Secretary himself states that the facts<\/p>\n<p>were not clear with regard to the allocation made and the<\/p>\n<p>alleged amount of diversion etc. Counsel for the State<\/p>\n<p>submits that the matter may be remitted to the Secretary<\/p>\n<p>to pass fresh orders in accordance with law.<\/p>\n<p>            The Court in C.W.J.C. No. 10659 of 2009<\/p>\n<p>(Narayan Pd. Viswas) and C.W.J.C. No. 18905 of 2010<\/p>\n<p>(Vijay Singh Vs. State of Bihar) has already discussed the<\/p>\n<p>issues at length of the nature of power and its manner of<\/p>\n<p>exercise under Section 18(5) of the Act.\n<\/p>\n<p>            If a statutory authority passes an order in<\/p>\n<p>exercise of statutory powers, such an order has to be<\/p>\n<p>passed within the confines of the statutory jurisdiction.<\/p>\n<p>If the authority exceeds the jurisdiction or abdicates it<\/p>\n<p>and the order visit an elected person with serious<\/p>\n<p>consequence of the nature noticed above, it is not for the<\/p>\n<p>Court to give any directions.        When an order is<\/p>\n<p>challenged before a Court it is required to pronounce on<\/p>\n<p>its validity\/invalidity.   The principal followed in a<\/p>\n<p>departmental proceeding to remand the matter for<\/p>\n<p>passing fresh orders in accordance with law from the<br \/>\n<span class=\"hidden_text\">                              4<\/span><\/p>\n<p>           stage of illegality shall not apply in the present facts. The<\/p>\n<p>           order dated 27.8.2010 is therefore set aside. What the<\/p>\n<p>           respondents may wish to do is their statutory jurisdiction<\/p>\n<p>           and not for the Court to direct.\n<\/p>\n<p>                       The writ application stands allowed.\n<\/p>\n<\/p>\n<pre>P.
