Srivastava, learned counsel for the petitioner and Sri S.R.<br \/>\nPandey , learned counsel appearing on behalf of the opposite parties.\n<\/p>\n<p>      The facts , in brief, as stated by the learned counsel for the petitioner are<br \/>\nthat the mother of the petitioner who was working on the post of Sweeper in<br \/>\nNagar Palika Parishad, Ujhani Budaun died on 27.3.2004 during the tenure of<br \/>\nhis service and after her death , on 1.5.2004 an application has been moved by<br \/>\nthe petitioner, the daughter of the deceased Smt.Anguri Devi to consider her<br \/>\ncase for giving appointment under dying in harness rules.\n<\/p>\n<p>      It was further submitted by the learned counsel for the petitioner that<br \/>\nwhen her case has not been considered by the respondents, the present writ<br \/>\npetition has been filed for redressal of his grievance with the prayer that the<br \/>\nrespondent no.2 may be directed to consider her case for employment on<br \/>\ncompassionate ground.\n<\/p>\n<p>      I have heard the learned counsel for the parties and perused the record.\n<\/p>\n<p>       In respect to the matter relating to appointment under dying in harness<br \/>\nrules on compassionate ground, the Apex Court very clearly said that no one<br \/>\ncan ask to consider his case in a manner not provided in the scheme for<br \/>\ncompassionate appointment . It is incumbent upon the authorities concerned to<br \/>\nconsider the claim of compassionate appointment strictly in accordance with<br \/>\nthe relevant parameters provided in the scheme or the rules and regulations<br \/>\napplicable in this regard . The Apex Court in the case of Union Bank of<br \/>\nIndia and others Vs. M.T. Latheesh, 2006(7) SCC 350 has held as under:-\n<\/p>\n<p><span class=\"hidden_text\">                                                                              2<\/span><\/p>\n<blockquote><p>                     &#8220;In the present case, by declining the<br \/>\n            application submitted by the respondent after the<br \/>\n            proper consideration of the same in the light of the<br \/>\n            relevant parameters the appellant-Bank cannot be<br \/>\n            said to have acted in an arbitrary manner regardless<br \/>\n            of the constitutional principles.\n<\/p><\/blockquote>\n<blockquote><p>                   It is also settled law that the specially<br \/>\n            constituted authorities in the rules or regulations like<br \/>\n            the competent authority in this case are better<br \/>\n            equipped to decide the cases on facts of the case an<br \/>\n            their objective finding arrived on the appreciation of<br \/>\n            the full fact should not be disturbed. Learned single<br \/>\n            Judge and the Division Bench by directing<br \/>\n            appointment has fettered the discretion of the<br \/>\n            appointing and selecting authorities the Bank had<br \/>\n            considered the application of the respondent in terms<br \/>\n            of the statutory scheme framed by the Bank for such<br \/>\n            appointment. After that even though the Bank found<br \/>\n            the respondent ineligible for appointment to its<br \/>\n            service, the High Court has found him eligible and<br \/>\n            has ordered his appointment. This is against the law<br \/>\n            laid down by this Court. It is settled law that the<br \/>\n            principles regarding compassionate appointment<br \/>\n            that compassionate appointment being an exception<br \/>\n            to the general rule the appointment has to be<br \/>\n            exercised only in warranting situations and<br \/>\n            circumstances existing in granting appointment and<br \/>\n            guiding factors should be financial condition of the<br \/>\n            family. The respondent is not entitled to claim relief<br \/>\n            under the new scheme because the financial status of<br \/>\n            the family is much above the criterion fixed in the<br \/>\n            new scheme&#8221;.<\/p><\/blockquote>\n<p>      In the case of State Bank of India and another Vs. Somvir Singh<br \/>\n(2007) 4 SCC 778 the Hon&#8217;ble Apex Court has held that mere hardship does<br \/>\nnot entitle the legal heirs of the deceased employee for compassionate<br \/>\nappointment unless it is provided under the scheme or the Rules. The<br \/>\ncompassionate appointment can be made applicable only strictly in<br \/>\naccordance with the scheme and not beyond that.(see also Mumtaz Yunus<br \/>\nMulani Vs. State of maharashtra and others, 2008 (11) SCC 384)<\/p>\n<p>      Admittedly, in the present case , the petitioner is a married daughter of<br \/>\n<span class=\"hidden_text\">                                                                              3<\/span><\/p>\n<p>the deceased Smt. Anguri Devi who died in harness as such she is not entitled<br \/>\nfor compassionate appointment under U.P. Recruitment of Dependents of<br \/>\nGovernment Servants Dying in Harness Rules , 1974 , so no mandamus or<br \/>\ndirection should be issued for giving compassionate appointment.\n<\/p>\n<p>       Keeping in view the said facts , the present writ petition filed by the<br \/>\npetitioner lacks merit and deserves to be dismissed.
