JUSTICE RAJIVE BHALLA<\/p>\n<p>Present: Mr. Harsh Aggarwal, Advocate<br \/>\n         for the appellant<\/p>\n<p>          Mr. A.K.Chopra, Senior Advocate with<br \/>\n          Mr. Rajneesh Chauhan, Advocate<br \/>\n          for the respondent<\/p>\n<p>RAJIVE BHALLA, J (Oral).\n<\/p>\n<p>          The appellant-firm though its partner, challenges the judgment<\/p>\n<p>and decree dated 31.10.2003, passed by the Additional District Judge,<\/p>\n<p>Yamuna Nagar at Jagadhri, accepting the appeal filed by the respondent-<\/p>\n<p>landlord, setting aside the judgment and decree dated 02.12.1999, passed<\/p>\n<p>by the Civil Judge (Junior Division), Jagadhri and as a consequence<\/p>\n<p>decreeing the suit for possession and damages.<\/p>\n<p>          During the pendency of this appeal, and with the able assistance<\/p>\n<p>of their counsel, parties have resolved their differences. In furtherance<\/p>\n<p>thereto, the appellant filed an affidavit dated 07.07.2009 setting out the<\/p>\n<p>terms and conditions of the settlement. However, a fresh affidavit dated<\/p>\n<p>08.07.2009 has been filed in court today and is taken on record.<\/p>\n<p>          Counsel for the parties are ad-idem that the appeal be disposed<\/p>\n<p>of in terms of the affidavit dated 08.07.2009 and the affidavit dated<\/p>\n<p>07.07.2009 be struck off the record. A relevant extract from the affidavit<\/p>\n<p>dated 08.07.2009, filed by Ranbir Singh son of Shri Naurata Ram, reads<\/p>\n<p>as follows:-\n<\/p>\n<p><span class=\"hidden_text\"> Regular Second Appeal No. 175 of 2004                   -2-<\/span><\/p>\n<blockquote><p>          &#8220;3.    That the deponent\/appellant filed the above mentioned<\/p>\n<p>                 Regular Second Appeal and the same is listed for<\/p>\n<p>                 motion hearing on July 8, 2009.\n<\/p><\/blockquote>\n<blockquote><p>          4.     That the deponent\/appellant accepts the correctness of<\/p>\n<p>                 the judgment and decree dated October 31, 2003<\/p>\n<p>                 passed by the Appellate Court.\n<\/p><\/blockquote>\n<blockquote><p>          5.     That the deponent\/appellant undertakes to vacate the<\/p>\n<p>                 premises on or before January 7, 2011 and further<\/p>\n<p>                 undertakes to hand over the vacant possession of the<\/p>\n<p>                 premises to the owner, Neeraj Kumar.\n<\/p><\/blockquote>\n<blockquote><p>          6.     That the deponent\/appellant undertakes to deposit an<\/p>\n<p>                 amount     of   Rs.2,550\/-    in   advance     to   the<\/p>\n<p>                 owner\/respondent within seven days from today and<\/p>\n<p>                 further sum of Rs.2,550\/- shall be paid to the land-<\/p>\n<p>                 owner Neeraj Kumar on or before January 13, 2010<\/p>\n<p>                 and to pay further sum of Rs.2,550\/- to the owner<\/p>\n<p>                 Neeraj Kumar on or before July 12, 2010.<\/p>\n<\/blockquote>\n<blockquote><p>          7.     That in case the vacant possession is not handed over<\/p>\n<p>                 to the owner Neeraj Kumar on or before January 7,<\/p>\n<p>                 2011, for any reason whatsoever and\/or if default in the<\/p>\n<p>                 payment of the amount as aforesaid is made, the<\/p>\n<p>                 owner shall be entitled to execute the decree dated<\/p>\n<p>                 October 31, 2003 for possession and recovery against<\/p>\n<p>                 the deponent\/appellant and\/or any one claiming under<\/p>\n<p>                 or through him, shall have no right whatsoever to file<\/p>\n<p>                 any objection or to resist the decree in any manner.<\/p>\n<p>                 Further, in case of non-delivery of vacant possession<\/p>\n<p>                 as aforesaid, or in default in any manner, the<\/p>\n<p>                 deponent\/appellant shall straightway be liable for<br \/>\n<span class=\"hidden_text\"> Regular Second Appeal No. 175 of 2004                        -3-<\/span><\/p>\n<p>                      contempt of this Hon&#8217;ble Court.\n<\/p><\/blockquote>\n<blockquote><p>             8.       That the deponent\/appellant, his legal representatives,<\/p>\n<p>                      assignees or any one claiming under or through him in<\/p>\n<p>                      any manner, shall not have any right to stay in the<\/p>\n<p>                      premises after January 6, 2011.&#8221;<\/p><\/blockquote>\n<p>          In addition, Mr. Ranbir Singh son of Naurata Ram, who is present<\/p>\n<p>in court and has been duly identified by his counsel, states that he has no<\/p>\n<p>objection if the amount deposited by him pursuant to orders passed by the<\/p>\n<p>Executing Court, is released to respondent no.1. He further states that<\/p>\n<p>respondent no.2, the other partner has since passed away. Shri Neeraj<\/p>\n<p>Kumar, the landlord-respondent no.1 accepts the aforementioned affidavit<\/p>\n<p>and statement and states that he would not execute the judgment and<\/p>\n<p>decree upto 06.01.2011.\n<\/p>\n<p>          In view of the settlement between the parties, the appeal is<\/p>\n<p>dismissed as withdrawn. However, the judgment and decree passed by<\/p>\n<p>the    Additional District Judge, Yamuna Nagar at Jagadhri, dated<\/p>\n<p>31.10.2003 shall remain in abeyance upto 07.01.2011. The appellant shall<\/p>\n<p>vacate the premises on or before 06.01.2011. The terms and conditions of<\/p>\n<p>his affidavit dated 08.07.2009 shall be read as a part of this order. In case<\/p>\n<p>the appellant does not vacate the possession, respondent no. 1 would be<\/p>\n<p>free to execute the decree in terms of the affidavit dated 08.07.2009 filed<\/p>\n<p>by Ranbir Singh son of Naurata Ram. Respondent no.1 shall be entitled to<\/p>\n<p>withdraw the amount deposited by the appellant, pursuant to orders passed<\/p>\n<p>by Executing Court.\n<\/p>\n<p>          It is made clear that this order shall have no bearing on any other<\/p>\n<p>litigation that may be pending inter-parties.
