\nSessions in  which came to be dismissed on<\/p>\n
 Aggrieved  impugned orders, this Criminal<\/p>\n
Revi’sioi1,_s.Petit.io.n is ‘filed.\n<\/p>\n
 gburing’ the pendency of the proceedings, the petitioner<\/p>\n
  steps were taken to bring the legal representatives<\/p>\n
th_e___petitioner on record, this Criminal Revision Petition was<\/p>\n
V”\u00ab:.:d’*i-srnissed as abated on 15.6.2009. Thereafter two applications<\/p>\n
W”\n<\/p>\n
in Misc.Crl.3897\/2009 and Misc.Crl.38’98\/2009 were filed by the<\/p>\n
legal representative of the petitioner, one for condoni’ng’t.the<\/p>\n
delay in filing the application to bring the legal  _<\/p>\n
deceased petitioner on record, and another.~et–o.._:’:’b.,rVin.q \u00ab.iegal’~. <\/p>\n
representative of deceased petitionerT__ <\/p>\n
applications were dismissed for non\u00bb-.prose’celJv_tion on”2?g~.34_,_2O1i\u00a7O.Vh<\/p>\n
4. Thereafter by an order ‘26.7.2\u00e9()’1’Cv, the order
\ndated 15.6.2009 dismissing’the”petit’io’n ablated came to be
\nrecalled by allowing   Thereafter an<\/p>\n
application in  ‘ifi:le,d’ to recall the order<\/p>\n
dated 24.3r.2()lV1’_’O’iv.j’_.,disvIfnis::.i:f1\u00a7l’–..VV’_ l_VliscH.Crl.Nos.3897\/2009 and
\n3898\/2009 for i non~.p’rcisel\u00a2’u.tfi’\u00a7nt;” Misc.Crl.2979\/2010 was
\nallowed on.  and blothhthe applications were restored to<\/p>\n
file.’ <\/p>\n

also filed an application for condoning the delay in filing the said<\/p>\n
application. These applications are opposed by the responid.ent.<\/p>\n

way as to  right is excluded by the<\/p>\n
Code.\n<\/p>\n

brought on record as legal heirs.\n<\/p>\n

\n  attention to Salmond’s observations in his
\n“””3urisprudence’ Eleventh Edition, page 442: That<\/p>\n
it criminal responsibility must die with the wrongdoer<\/p>\n
himself, and has urged that as all criminal
\n5\/<\/p>\n
proceedings are personal actions, proceedings in<\/p>\n
connection with a Crime can, in the absence of any5.__7,<\/p>\n
statutory provision, neither be commenced..__’44’or’~.7. <\/p>\n
continued against an accused person or on  <\/p>\n
unless he is in existence. It may be ,noteg”‘h’owfev\u00e9’r   <\/p>\n
that Salmond himself goes on to.,A_say.inj; <\/p>\n

\ncan be taken in the respect thereof. On this<\/p>\n
ques\u00e9tglonthecommon law maxim is of little, if any,<\/p>\n
 “Vuse’*andi.,’tvhe”answertothe question must be found in<\/p>\n
 oth’er.priovisioris~ of law.\n<\/p>\n
r  v.(3ia)R.5fhe,:..C’rimina| Procedure Code gives a right<\/p>\n
of ap–pea.,i’to. the convicted person in certain cases. If,<\/p>\n
C7-‘\u00ab4.__”-after the__’3conviction and before an appeal has been<\/p>\n
‘\ufb02lfiledlthe convicted person dies, there is no provision<\/p>\n
 for any appeal on his behalf. What will happen when<\/p>\n
-after an appeal has been filed by the convicted<\/p>\n
person, he dies, is provided for in 8.431 of the<\/p>\n
Criminal Procedure Code. That section provides that
\nbx<\/p>\n
every appeal against acquittal and every other
\nappeal under Chapter XXXI except an appeal from
\nsentence of fine shall finally abate on the deaVt.h_”-of”-the-.V”‘~<\/p>\n
the appellant. The High Court or the Court <\/p>\n
Sessions cannot therefore exercise its_-‘a’p~pie~:vla’t’e <\/p>\n
jurisdiction in favour of a dead jpers_onge’ven_ if<\/p>\n

\ndeath cannot discharge any Learned
\nCounser for the re..SP\u00a7m’d.e”ti;AA\u00e9ubhdii\u00e9l’t:l”,3’tW\\\u00bbi1e;..iV’intends to recover
\nthe remainingi.  provisions of
\nprocedure of liberty to recover the
\nremaining  _;with law. Learned counsel for<\/p>\n

for recovery’ of rernai’n.in_g__amount before the Court below. The<\/p>\n
