Deceasedfg &#8211;Veeifrabh_a:dra,iCah_:_w~__&#8217;wjas accused in<\/p>\n<p>C.C.No.254\/2005&#8243;for.Vti&#8217;:ie&#8217;?V&#8217;.._o.fferi-c\u00a7e&#8221;&#8211;pufnis.ha.ble under Section 138<\/p>\n<p>of Negotiable&#8221; .pt&#8217;ct&#8217;_.vv&#8217;and_. was convicted by the trial<br \/>\nCourt. Thervefore,  appeal before the Court of<br \/>\nSessions in  which came to be dismissed on<\/p>\n<p> Aggrieved  impugned orders, this Criminal<\/p>\n<p>Revi&#8217;sioi1,_s.Petit.io.n is &#8216;filed.\n<\/p>\n<p> gburing&#8217; the pendency of the proceedings, the petitioner<\/p>\n<p>  steps were taken to bring the legal representatives<\/p>\n<p>th_e___petitioner on record, this Criminal Revision Petition was<\/p>\n<p>V&#8221;\u00ab:.:d&#8217;*i-srnissed as abated on 15.6.2009. Thereafter two applications<\/p>\n<p>W&#8221;\n<\/p>\n<p>in Misc.Crl.3897\/2009 and Misc.Crl.38&#8217;98\/2009 were filed by the<\/p>\n<p>legal representative of the petitioner, one for condoni&#8217;ng&#8217;t.the<\/p>\n<p>delay in filing the application to bring the legal  _<\/p>\n<p>deceased petitioner on record, and another.~et&#8211;o.._:&#8217;:&#8217;b.,rVin.q \u00ab.iegal&#8217;~. <\/p>\n<p>representative of deceased petitionerT__ <\/p>\n<p>applications were dismissed for non\u00bb-.prose&#8217;celJv_tion on&#8221;2?g~.34_,_2O1i\u00a7O.Vh<\/p>\n<p>4. Thereafter by an order &#8216;26.7.2\u00e9()&#8217;1&#8217;Cv, the order<br \/>\ndated 15.6.2009 dismissing&#8217;the&#8221;petit&#8217;io&#8217;n ablated came to be<br \/>\nrecalled by allowing   Thereafter an<\/p>\n<p>application in  &#8216;ifi:le,d&#8217; to recall the order<\/p>\n<p>dated 24.3r.2()lV1&#8217;_&#8217;O&#8217;iv.j&#8217;_.,disvIfnis::.i:f1\u00a7l&#8217;&#8211;..VV&#8217;_ l_VliscH.Crl.Nos.3897\/2009 and<br \/>\n3898\/2009 for i non~.p&#8217;rcisel\u00a2&#8217;u.tfi&#8217;\u00a7nt;&#8221; Misc.Crl.2979\/2010 was<br \/>\nallowed on.  and blothhthe applications were restored to<\/p>\n<p>file.&#8217; <\/p>\n<p>&#8216;.5;pi&#8217;-halveu7heard&#8217; the learned counsel for the petitioner as<\/p>\n<p>i\ufb02weliyas the learned counsel for the respondent<\/p>\n<p> &#8220;Learned counsel for legal heirs of the deceased<\/p>\n<p>.A&#8217;-4&#8243;_&#8217;-peti\u00abt&#8211;ion&#8217;\u00a7er has filed an application to bring legal representatives<\/p>\n<p>.all*&#8211;._of&#8221;d.e.ceased petitioner on record to contest the matter. He has<\/p>\n<p>2\/&#8217;<\/p>\n<p>also filed an application for condoning the delay in filing the said<\/p>\n<p>application. These applications are opposed by the responid.ent.<\/p>\n<p>7. The point that arises for my conside_ra-tionftirif\u00e9<\/p>\n<p>petition is:    &#8216;<br \/>\n&#8220;Whether the LV:R.s<br \/>\nVeerabhadraiah be brought ohxrecoprd   if<\/p>\n<p>8. MY answer to above.pointAui.s.VVas._u&#8217;nderi.i <\/p>\n<p>The nature of this  is same as that<br \/>\nof Court of Appeal,  such prevent gross or<\/p>\n<p>palatable failure  &#8216;._Il:_g_.shou._l&#8217;o'[not  exercised in such a<\/p>\n<p>way as to  right is excluded by the<\/p>\n<p>Code.\n<\/p>\n<p>9. It isl&#8221;co_n&#8217;te.n&#8217;.dedv.  the learned counsel for the<\/p>\n<p>:_responderi&#8217;t sthaigx.afterth&#8217;e&#8221;&#8216;abatement, the amount in deposit has<\/p>\n<p> rei_ea.sevd;:to'&#8221;the:,legaI heirs of the accused. It is difficult to<\/p>\n<p>&#8216; &#8220;\u00bb._..&#8217;accept&#8217;t_he conteintilon of the learned counsel for the respondent<\/p>\n<p>-i.f.f&#8217;j:.b.eca,use thelegal representatives of deceased accused cannot be<\/p>\n<p>brought on record as legal heirs.\n<\/p>\n<p>\u00a35<\/p>\n<p>10. Learned counsel for the petitioner submits that legal<\/p>\n<p>representatives of accused cannot be convicted upV.on_rt_he<\/p>\n<p>judgment of conviction passed by the Court below;&#8217;_:&#8217;i&#8217;n\u00ab&#8217;..;1_ievv:<\/p>\n<p>reported judgment in STATE OF KERALA 19621.sc.tA&#8217;i=\u00a7AGEf 1153;)&#8221;  <\/p>\n<p>(v 49 c 222) in the case of smrEt.lg\u00a2F7.KeRAlLAglc.g&#8217;v;2st&#8217;<\/p>\n<p>NARAYANI AMMA KAMALA DEVI -AND'&#8221;ofmaR:;;&#8217;l&#8217;%&#8217;ty:r$iereil\ufb01: thheiyi.<\/p>\n<p>Hon&#8217;ble Supreme Court has held  .\n<\/p>\n<p>(3) The principalaptinAt&#8221;.V_urgevd&#8221;~~l.rl\u00bb._\u00a7up_port of the<br \/>\nappeal is that after the &#8216;l&#8217;d.eal.th fof.&#8211;&#8216;\u00bbt.h&#8217;\u00a7.&#8217;.j&#8217;V_&#8217;a_c.cused no<br \/>\nrevision applic.a\u00ab&#8217;tiori_lay;&#8217;toyth,e HyiAg~lh_jCVo&#8217;urV\u00a7t against the<br \/>\norder of  &#8211;,C0.ur:t Vnialilntaining his<\/p>\n<p>convic%&#8217;r;&#8221;ionl.V  co;un_&#8217;sel_  the appellant has<br \/>\nbased  of this contention on<br \/>\nthe principle .  in the maxim action<\/p>\n<p>_ person&#8217;al.i.s moriturlcuni persona and has urged that<br \/>\n. Clexcept iwhe&#8217;re\u00ab_the statute has stepped in to make any<br \/>\ng_&#8217;_s*p:e_ciialT&#8217;p:_r&#8217;ov&#8217;ils.i:o&#8217;n.s no proceedings either against the<br \/>\n.accu*s&#8217;edV &#8216;   behalf of the accused can be<br \/>\nent\u00e9rtai&#8211;.nedv&#8221;&#8216;or continued in the Court in respect of<\/p>\n<p> crime said to have been committed by a person<\/p>\n<p>V&#8221;-a_af.te&#8221;r&#8221;A_\u00abthe death of such person. He has drawn our<br \/>\n  attention to Salmond&#8217;s observations in his<br \/>\n&#8220;&#8221;&#8221;3urisprudence&#8217; Eleventh Edition, page 442: That<\/p>\n<p>it criminal responsibility must die with the wrongdoer<\/p>\n<p>himself, and has urged that as all criminal<br \/>\n5\/<\/p>\n<p>proceedings are personal actions, proceedings in<\/p>\n<p>connection with a Crime can, in the absence of any5.__7,<\/p>\n<p>statutory provision, neither be commenced..__&#8217;44&#8217;or&#8217;~.7. <\/p>\n<p>continued against an accused person or on  <\/p>\n<p>unless he is in existence. It may be ,noteg&#8221;&#8216;h&#8217;owfev\u00e9&#8217;r   <\/p>\n<p>that Salmond himself goes on to.,A_say.inj; <\/p>\n<p>the matter that the modern opin..ioi1._ reje&gt;C:t1;S,&#8217;A&#8217;th&#8217;*eA*:_&#8221;&#8211;~ if<\/p>\n<p>conclusion based on the &#8216;re.cei.ved fmaxirn&#8217;-,aE:~tio&#8217;n&#8221; <\/p>\n<p>personalis moritur cum persona,-.t,ha.t_\u00bballlhactioynsgvvfor<br \/>\npenal redress must  broAug\u00a7hAtl&#8221;&#8216; &#8216;4aga&#8217;i&#8221;nst a living<br \/>\noffender and must die more<br \/>\nimportant to notice is;_&#8217;A&#8217;th:at~V:::v.:_\u00a7;\u00ab..},,e\u00a2g notfvconcerned<br \/>\nhere with the    .pro:c\u00e9edings being<br \/>\ncontinued nst  person but with<br \/>\nthe   a _cr.iVm&#8217;iVnal proceeding has<br \/>\nended  person, any action<br \/>\ncan be taken in the respect thereof. On this<\/p>\n<p>ques\u00e9tglonthecommon law maxim is of little, if any,<\/p>\n<p> &#8220;Vuse&#8217;*andi.,&#8217;tvhe&#8221;answertothe question must be found in<\/p>\n<p> oth&#8217;er.priovisioris~ of law.\n<\/p>\n<p>r  v.(3ia)R.5fhe,:..C&#8217;rimina| Procedure Code gives a right<\/p>\n<p>of ap&#8211;pea.,i&#8217;to. the convicted person in certain cases. If,<\/p>\n<p>C7-&#8216;\u00ab4.__&#8221;-after the__&#8217;3conviction and before an appeal has been<\/p>\n<p>&#8216;\ufb02lfiledlthe convicted person dies, there is no provision<\/p>\n<p> for any appeal on his behalf. What will happen when<\/p>\n<p>-after an appeal has been filed by the convicted<\/p>\n<p>person, he dies, is provided for in 8.431 of the<\/p>\n<p>Criminal Procedure Code. That section provides that<br \/>\nbx<\/p>\n<p>every appeal against acquittal and every other<br \/>\nappeal under Chapter XXXI except an appeal from<br \/>\nsentence of fine shall finally abate on the deaVt.h_&#8221;-of&#8221;-the-.V&#8221;&#8216;~<\/p>\n<p>the appellant. The High Court or the Court <\/p>\n<p>Sessions cannot therefore exercise its_-&#8216;a&#8217;p~pie~:vla&#8217;t&#8217;e <\/p>\n<p>jurisdiction in favour of a dead jpers_onge&#8217;ven_ if<\/p>\n<p>appeal has been filed by him, exace_p&#8217;t~_ViAn an&#8221;V&#8217;:ap-p.eal&#8217;V<br \/>\nfrom a sentence offine.   A&#8217;  <\/p>\n<p>(4) As regards the revisiorialjurisdiction of the<br \/>\nHigh Court there is no tQriziyisieoiilvsgyiii?i.i._iVa\u00bbftoy S.43Vl1A.&#8221;i\\lor<br \/>\nis there any provision&#8221;  revisional<br \/>\napplication can_be__or   irflrespect of<br \/>\nan order of the :co&#8217;nvi&#8217;cted person is<br \/>\ndead. We  distinction<\/p>\n<p>that wljiillewlthieiappelllateljtirisdictlion can be exercised<br \/>\nonly after   the convicted person~<br \/>\nor against&#8217;a_niio,rder_ of&#8217;.a&#8217;ciji&#8217;i.:ittal under S.41 or S.417,<br \/>\ntheregis no sVuchV_VIiri1ita&#8217;tio.n on the Court&#8217;s revisional<br \/>\n.~-.,_ajlurisdicti,0.n.&#8221;i-  H lllll  I<\/p>\n<p>ii1.V&#8221;l&#8217;&#8211;._ApVVpi:y_i&#8217;_ng&#8217;lithe principle laid down in the above<\/p>\n<p>V&#8217;v:*ymentioned&#8221;&#8221;rulingand also when there is no specific provision to<\/p>\n<p> representatives of the deceased petitioner-<\/p>\n<p>&#8220;person on record in the Court of revision,<\/p>\n<p>&#8216;%&#8221;&#8221;&#8221;4x&#8217;__&#8217;MiscfC&#8217;rl&#8217;.3897\/2009 and Misc.Crl.3898\/2009 filed by legal<\/p>\n<p>u&#8221;~,&gt;_&#8221;&#8221;re3presentative of the deceased petitioner&#8211;convIcted person<\/p>\n<p>W&#8217;<\/p>\n<p>deserves to be rejected. Accordingly, these two applications are<\/p>\n<p>rejected.\n<\/p>\n<p>12. The amount in deposit shall be disburs\u00e9A\u00a2&#8217;:*&#8217;to:~A.f:iie 9%<\/p>\n<p>representative of the deceased pe,tition&#8217;e&gt;r&#8217;c_&#8217;o:n&#8217;~.;..,_propcer<\/p>\n<p>identification.\n<\/p>\n<p>13. Learned counsel for thei.&#8211;reSyp.o&#8217;\ufb01&#8217;dent&#8217;submits that the<br \/>\ndeath cannot discharge any Learned<br \/>\nCounser for the re..SP\u00a7m&#8217;d.e&#8221;ti;AA\u00e9ubhdii\u00e9l&#8217;t:l&#8221;,3&#8217;tW\\\u00bbi1e;..iV&#8217;intends to recover<br \/>\nthe remainingi.  provisions of<br \/>\nprocedure of liberty to recover the<br \/>\nremaining  _;with law. Learned counsel for<\/p>\n<p>the respondenti5&#8217;ijb.n~ii&#8217;ts_&#8221;t&#8217;h_a&#8217;t~.&#8217;he has already filed an application<\/p>\n<p>for recovery&#8217; of rernai&#8217;n.in_g__amount before the Court below.
