KRISHNAN, J.\n              = = = = = = = = = = = = = =\n                INS.APPEAL NO. 51 OF 2008\n             = = = = = = = = = = = = = = =\n        Dated this the 7th day of December, 2009.\n\n                       J U D G M E N T\n<\/pre>\n<p>      This appeal is preferred against the order of the<\/p>\n<p>Employees Insurance Court, Alappuzha in I.C.69\/03.          An<\/p>\n<p>application was filed before the Court below seeking for a<\/p>\n<p>declaration that the applicant&#8217;s establishment is not liable to<\/p>\n<p>be covered under the E.S.I.Act. It was contended that there<\/p>\n<p>was not more than 9 employees at any point of time and<\/p>\n<p>some ITC students were permitted to take practical training<\/p>\n<p>in motor workshop from there and that is why the insurance<\/p>\n<p>official was able to find 11 persons and so the order passed<\/p>\n<p>by the Corporation ordering coverage of the institution was<\/p>\n<p>sought to be set aside. The learned Insurance Court after<\/p>\n<p>exhaustive consideration of the materials held against the<\/p>\n<p>applicant and it is against that decision the appplicant has<\/p>\n<p>come up in appeal.      The two substantial questions of law<\/p>\n<p>raised are as follows.\n<\/p>\n<p>INS.APPEAL NO. 51 OF 2008<br \/>\n<span class=\"hidden_text\">                                 -:2:-<\/span><\/p>\n<p>                  &#8220;(A) Whether the findings of the<\/p>\n<p>            E.I.Court are based on the evidence on<\/p>\n<p>            record?\n<\/p>\n<p>                  (B) Whether          the     students<\/p>\n<p>            undergoing training in the establishment<\/p>\n<p>            can be treated as workmen under the<\/p>\n<p>            Employees State Insurance Act for the<\/p>\n<p>            purpose of coverage?&#8221;\n<\/p>\n<p>      2.    It is the definite contention of the establishment<\/p>\n<p>that there can be never more than 9 employees in the<\/p>\n<p>establishment.     According to it from the neighboring ITC<\/p>\n<p>institution some students have come up for training and they<\/p>\n<p>had been counted along with the employees and thereby the<\/p>\n<p>Corporation had directed coverage of the institution. DW1<\/p>\n<p>an   insurance    inspector   visited  the  establishment  on<\/p>\n<p>9.5.2001.    He was able to find 11 persons employed for<\/p>\n<p>wages in the establishment. He prepared a report and the<\/p>\n<p>said   report    was  signed    by    the supervisor   of  the<\/p>\n<p>establishment. DW1 had interviewed the persons, obtained<\/p>\n<p>their names, parentage and address, nature of work period<\/p>\n<p>of service, wages drawn and also their signatures. It is there<\/p>\n<p>INS.APPEAL NO. 51 OF 2008<br \/>\n<span class=\"hidden_text\">                                 -:3:-<\/span><\/p>\n<p>after the supervisor of the establishment counter signed it.<\/p>\n<p>Now the contention is that from the neighbouring institution<\/p>\n<p>some students have come for training. Except the assertion<\/p>\n<p>there are no materials produced before the Court to show<\/p>\n<p>that who are all those trainees and their particulars. On the<\/p>\n<p>contra a respectable officer of the Corporation had visited the<\/p>\n<p>establishment and in the presence of their supervisor he<\/p>\n<p>counted the number and given all particulars regarding the<\/p>\n<p>employees.   Such a report establishes the presence of 11<\/p>\n<p>employees, employed for wages and it has become final and<\/p>\n<p>that decision does not suffer from any material infirmity or<\/p>\n<p>on misappreciation of evidence. Therefore the questions of<\/p>\n<p>law formulated by the counsel for the appellants has to be<\/p>\n<p>found against the establishment and it has to be held that<\/p>\n<p>the finding of the E.I.Court does not suffer from any<\/p>\n<p>infirmity. So the appeal lacks merit and the same is<\/p>\n<p>dismissed.\n<\/p>\n<\/p>\n<p>                           M.N.
