JAKHARWAL, PRINCIPAL, MUZAFFARPUR INSTITUTE OF\n TECHNOLOGY, MUZAFFARPUR------------------------------------OPP.PARTIES\n                                      -----------\n<\/pre>\n<p>            For the petitioners :M\/S Shyama Prasad Mukherjee,Sr.Advocate<br \/>\n                                     Shanti Pratap, Advocate<br \/>\n            For the State       :M\/S Sheojee Prasad, G.P.2<br \/>\n                                     P.Bharti, A.C. to G.P.2\n<\/p>\n<p>                                        &#8212;&#8212;\n<\/p>\n<p>4.    24.11.2010                 Heard learned counsel for the petitioners and learned<\/p>\n<p>                          counsel for the State.\n<\/p>\n<p>                                The present contempt application has been filed for<\/p>\n<p>                          initiating proceeding of contempt against opposite party<\/p>\n<p>                          No.3, the Director, Science and Technology, Bihar for<\/p>\n<p>                          willfully and deliberately swearing false affidavit by filing<\/p>\n<p>                          supplementary show cause in the connected MJC No.3013<br \/>\n<span class=\"hidden_text\">                  2<\/span><\/p>\n<p>of 2007 stating that the Principal of the college is not<\/p>\n<p>competent authority for making any type of appointment in<\/p>\n<p>case of the petitioners and others.\n<\/p>\n<p>      Learned counsel for the petitioners in support of their<\/p>\n<p>stand has sought to rely upon a Circular No.539 dated<\/p>\n<p>6.2.1964 issued by the Department of Industries and<\/p>\n<p>Mines, Technical Education, Government of Bihar under<\/p>\n<p>which power have been delegated to the Principal of MIT,<\/p>\n<p>Muzaffarpur, among others, for the purpose of fixing<\/p>\n<p>wages and making appointment of daily rated workers<\/p>\n<p>which was mentioned as full powers subject to the marked<\/p>\n<p>conditions but not exceeding Rs.2.50 per day in the case of<\/p>\n<p>unskilled labourers and Rs.5\/- per day in the case of skilled<\/p>\n<p>workers and semi-skilled workers and further subject to the<\/p>\n<p>condition of the expenditure being made out of the existing<\/p>\n<p>budget allotment.\n<\/p>\n<p>      It is submitted that in view of the said Circular of<\/p>\n<p>1964 the statement made by the Director in his<\/p>\n<p>supplementary show cause filed in the earlier contempt<\/p>\n<p>application is a deliberate attempt to mislead this Court by<\/p>\n<p>making false statement.\n<\/p>\n<p><span class=\"hidden_text\">                 3<\/span><\/p>\n<p>      Various show causes have been filed on behalf of the<\/p>\n<p>opposite party. Apart from others, reliance is placed on a<\/p>\n<p>letter dated 18.9.1973 issued by the Industries and<\/p>\n<p>Technical Department, Government of Bihar in which<\/p>\n<p>reference is made to the power of appointment of the<\/p>\n<p>Director, Technical Education, Bihar with respect to all<\/p>\n<p>non-gazetted posts under the administrative control of the<\/p>\n<p>Director. The opposite party also relies upon a letter dated<\/p>\n<p>20.9.1995 by the Director, Science and Technology<\/p>\n<p>Department, Bihar which is addressed to, among others, all<\/p>\n<p>Principals\/Directors of Engineering Colleges in which it is<\/p>\n<p>stated that the competent appointing authority of the non-<\/p>\n<p>gazetted employees and daily rated workers is the Director,<\/p>\n<p>Science and Technology and since 1985 the Personnel<\/p>\n<p>Department had put a stop upon appointing daily rated<\/p>\n<p>employees yet such illegal appointments are being made by<\/p>\n<p>them and, accordingly, they were directed not to make such<\/p>\n<p>appointments.\n<\/p>\n<p>      Learned counsel for the petitioners submits that<\/p>\n<p>nothing has been brought on the record to show that such<\/p>\n<p>powers have been taken away from the Principal. Even if<\/p>\n<p>the said submission is accepted, in view of the letters dated<br \/>\n<span class=\"hidden_text\">                         4<\/span><\/p>\n<p>        18.9.1973 and specially the letter dated 20.9.1995 it is<\/p>\n<p>        evident that no deliberate attempt has been made to<\/p>\n<p>        mislead the Court by filing false statement in the earlier<\/p>\n<p>        contempt application by stating that the Principals did not<\/p>\n<p>        have any power of appointment.\n<\/p>\n<p>              In that view of the matter, the contempt application<\/p>\n<p>        is not fit to be proceeded with.
