For the sake of_Conv{\u00a7nienee parties are referred to\n\nas they are referred to \n\n3. Briefof theease  H \u00bb \n  1* 1  lwhenfdeceased Obalaiah was\ngoingV\"xby._ Milestone on Singatagere --\n\nBelaiir road\" in Taluk the mini lorry bearing\n\n   19 A 3697 came in a rash and\n\n'V'nle'gli_gent-4haaiiner and dashed against him, as a result\n\nhe sustained grievous injuries. Immediately he was\n\n A shifted' to Government Hospital, Kadur where he\n\n \"s_L1ro-'cumbed to injures. Hence, his wife and children\n\nd\ufb01led a claim petition before MACT, Kadur seeking\n\ncompensation of Rs.20.00,000\/-- and the Tribunal has\n\n$5\n\n\n\nawarded compensation of Rs.4.67,000\/~ (wrongly\nmentioned as Rs.5,67,000\/~ ) with interest. at 60\/9 p.a.\nand fixed t.he liability on the owner of \n\nvehicle.\n\n4. The points that arise for consideration     it\n\nWhether the Triilbunallisll jVustiiliejd..,_Hir1_:3 nae\n\nfastening the liability\"'-vagainst 'th_e'vw.in_su'rer\"'of the\noffending vehicle and \"-..whether \u00abthe quantum\ncompensation awardeid is\"j~u;st and proper or does it\n\ncall for enhance\"ment'.\u00e9?   is\n5.  insurer of the\noffending:      driver of the\n  'driving licence as on the\ndate 'of the the claimants have failed to\n\nprove that Natairajag, Sic Maridevau and Nataraja, S\/o\n\n' V'  Maidevarii @ Raj'appa in Whose name the driving licence\n\nis not one and the same person. Therefore\n\nthe  has rightly held that the owner of the\n\n AA offending vehicle is liable to pay compensation. Besides\n\n owner of the offending vehicles did not choose to\n\nxlcontest the matter before the Tribunal and be was\n\nplaced ex parte. Since. the claimants have failed to\n\n .\n<\/pre>\n
establish the identity of the driver as Nataraj, S\/o
\nMaridevaru and Natara}, 8\/0 of Maridevaru @ Rajappa<\/p>\n
is one and the same person by examining th’e”‘o.wn’er.<\/p>\n
This Court may remand the matter and <\/p>\n
Tribunal to give a \ufb01nding to the’ effect ‘Nataraja., if<\/p>\n
S\/0 Maridevaru and Nataraja;,__  <\/p>\n
Rajappa is one and the  lafterl’<\/p>\n
affording opportunity to the  . ._<\/p>\n
6. Learnedpp -.r,_jxouI1-:se’1~:..  V   the claimants
\nsubmits   2 application before
\nthe ‘ifribuna.lf”1″orI  petition to change
\nthe  of  sit’ respondent from “Nataraja,<\/p>\n
son of lliajappaf to ‘\u00ab…’l–~l\\Eataraja, son of Maridevaru @<\/p>\n
   Thatvapplication was resisted by the insurer<\/p>\n
V  vehicle by filing statement of objections.<\/p>\n
.lT,hereafterV_ the Tribunal by it’s detailed order allowed<\/p>\n
 the “said application on 27.12.2007 and permitted the<\/p>\n
 ‘.elaimants to amend the cause title of the claim petition.<\/p>\n
__\u00a7Accordingly it was amended and the name of the father<\/p>\n
%.\n<\/p>\n
of the driver was shown as Nataraj, S\/0 Maridevaru @<\/p>\n
Rajappa. The said order of the Tribunal has become<\/p>\n
final as the same has not been challenged’:Vibvfttie<\/p>\n
insurer of the offending vehicle. Therefore   <\/p>\n
has committed an error in fixing “iiabihtyg <\/p>\n
owner of the offending Vehicle on the  <\/p>\n
driver has no valid lieeneethas on*ofV the it<\/p>\n
accident. He  of
\nCompensation awarded_V’b:3_(V  also on the
\nlower side   the appeal by
\nenhancinggjspp  fixing the liability<\/p>\n
against  h~e__offe–nding vehicle.<\/p>\n
‘7. It  ~not:e’d\u00ab.:_that the Tribunal while allowing<\/p>\n
  theaiamdeiidmerit’application has observed in para 12 of<\/p>\n
 pd =it’Ts’ ‘ord.e’r _4a”S.Vdu~nder:<\/p>\n
A very important to note that, 21″ respondent<\/p>\n
 z  best person to say whether ls’ respondent is
\nthe son of Maridevaru or @ Rajappa but, he
\nremained absent and placed ex parte. 181
\nrespondent himself examined as DW–2 and his
\ndeposition shows, his father’s name is shown as<\/p>\n
Maridevaru @ Rajappa. More than that, Ex. I) 1, 7<\/p>\n

and D 8 copies of summons and bail bonds in
\nC.C. No.1291\/2006 show, name of father___ of 18′<\/p>\n
respondent is Nataraja S \/ o Rajappa. So Vlieatcis to<\/p>\n
the definite conciusion that, name of theiiof<\/p>\n
15″ respondent–Nataraja is Maridjevarauth ‘ <\/p>\n
Rajappa.”\n<\/p>\n
If the insurer of the offendingvidazethicle <\/p>\n
that Nataraja, S\/o. Marideeyaru and  S \/ 0. V<\/p>\n
Maridevaru @ Rajap.pa  ‘Voersons they
\nshould have   2 and cross
\nexamine hiin  effect. ‘proper to expect a
\nwidow and’  lost their husband
\nand  exercise. It could have
\nbeen ‘Adorie so’-if  ‘ho \ufb01nding of the Tribunal to<\/p>\n
that”cffect.  of the circumstances stated above<\/p>\n

  to-‘establish the identity of the driver of the<\/p>\n

 not have valid license and owner of the offending<\/p>\n

aside. Accordingly it is set aside.
