Public Prosecutor waives service of<br \/>\n\tnotice of rule on behalf of the respondent &#8211; State of Gujarat.\n<\/p>\n<p>2.\tHaving<br \/>\n\tregard to the facts of the case, the application is taken up for<br \/>\n\thearing today.\n<\/p>\n<p>3.\tHaving<br \/>\nheard Mr. VN Mapara, learned advocate for the applicant and Mr. RC<br \/>\nKodekar, learned APP for the respondent &#8211; State of Gujarat and<br \/>\non perusal of the averments made in the application, which have<br \/>\nremained uncontroverted, it is seen that the applicant has<br \/>\nsufficiently explained delay of 54 days caused in filing the above<br \/>\nnumbered criminal appeal.\n<\/p>\n<p>4.\tSince<br \/>\nthe applicant has shown sufficient cause for not filing the appeal in<br \/>\ntime, we deem it expedient to condone the delay, as prayed for, by<br \/>\nallowing this application.\n<\/p>\n<p>5.\tFor<br \/>\nthe foregoing reasons, the application succeeds and it is accordingly<br \/>\nallowed.  Delay of 54 days in filing the above numbered criminal<br \/>\nappeal, is hereby condoned.
