PUBLIC PROSECUTOR for\nRespondent(s) : 1, \nNone for Respondent(s) : 2 -\n3. \n=========================================\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE RAJESH H.SHUKLA\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 13\/05\/2010 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>\tThe<br \/>\npresent application has been filed by the applicant convict-prisoner<br \/>\nthrough jail for grant of furlough.\n<\/p>\n<p>2.\tThe<br \/>\nconvict-prisoner has been convicted for offences under sec. 307 r\/w<br \/>\nsec. 120B, 302  of IPC as well as under sec. 25(1)(a) of the Arms Act<br \/>\nas well as for offence under the TADA  Act in TADA Case No. 8\/93 by<br \/>\nthe designated Court No. 3, City Civil &amp; Sessions Court,<br \/>\nAhmedabad, against which an appeal was preferred before the Hon&#8217;ble<br \/>\nApex Court which came to be dismissed vide order dated 12.5.2009.<br \/>\nThere are other offences as stated in the jail remark sheet including<br \/>\nthe cases pending at the Rajasthan court.\n<\/p>\n<p>3.\tIt<br \/>\nis contended in this application that the orders under sec. 268(1) of<br \/>\nCr.P.C. have not been issued qua him by the Government and he has not<br \/>\nenjoyed  the furlough and therefore he may be granted furlough to<br \/>\nsupport his family.\n<\/p>\n<p>4.\tThough<br \/>\nit is stated that the orders under sec. 268(1) of Cr.P.C. have not<br \/>\nbeen issued by the State Government,  as it appears from the jail<br \/>\nremark sheet, such orders have been issued.  Further, as it appears<br \/>\nfrom the jail remark sheet, he has been convicted by the Designated<br \/>\nTADA Court No. 3 at Ahmedabad for the alleged offences and his appeal<br \/>\nalso came to be dismissed  by the Hon&#8217;ble Apex Court and, therefore,<br \/>\nsuch an application is first required to be considered by the<br \/>\ncompetent authority.  As per the provisions of sec. 389 of Cr.P.C.,<br \/>\nthis Court can, in pending appeal, suspend or pass an order for<br \/>\ntemporary bail.\n<\/p>\n<p>5.\tIt<br \/>\nis not in dispute that it was a TADA case against which the appeal<br \/>\npreferred before the Hon&#8217;ble Apex Court has also been decided and<br \/>\ndismissed. Therefore, as per the provisions of the special statute &#8211;<br \/>\nTADA Act or the Criminal Procedure Code, there is no occasion for<br \/>\nthis Court to exercise the jurisdiction.  A useful reference can be<br \/>\nmade to the judgment of the Hon&#8217;ble Apex Court in the case of<br \/>\n<a href=\"\/doc\/1894355\/\">Usmanbhai Dawoodbhai Memon and ors. v. State of Gujarat,<\/a><br \/>\nreported in AIR 1988 SC 922 and also to the judgment of this Court in<br \/>\nthe case of <a href=\"\/doc\/957615\/\">Latif Chhmtumiya Shaikh v. State of Gujarat and ors.<\/a>,<br \/>\nreported in 2000(3) GLH 601 as well as to the judgment of the Hon&#8217;ble<br \/>\nApex Court reported in 1994 (2) JT S.C. 423  in the case of Kartar<br \/>\nSingh v. State of Punjab.\n<\/p>\n<p>6.\tFurther,<br \/>\neven if there is no lack of jurisdiction under Art. 226 and 227 of<br \/>\nthe Constitution of India to examine such an application in a given<br \/>\ncircumstance, whether the applicability of TADA Act is justified or<br \/>\nnot, is an aspect to be considered.   However, in the facts of the<br \/>\npresent case, as the Hon&#8217;ble Apex Court has also dismissed the<br \/>\nappeal, there is no question of considering the justification for<br \/>\napplicability of TADA Act.  Therefore, once the Hon&#8217;ble Apex Court<br \/>\nhas dismissed the appeal, this Court cannot entertain any such<br \/>\napplication under Art. 226 or 227 of the Constitution and an<br \/>\napplication made for furlough or parole is required to be considered<br \/>\nby the competent authority.\n<\/p>\n<p>7.\tTherefore,<br \/>\nit is directed that the competent authority, Inspector General<br \/>\n(Prisons), Gujarat State, Ahmedabad shall decide the application for<br \/>\nfurlough referred to him by the Superintendent, Central Jail,<br \/>\nSabaramti vide his letter No. 3864\/09 dt. 15.10.2009 which is<br \/>\nreferred to in the jail remark sheet.\n<\/p>\n<p>\tAccordingly,<br \/>\nthe application stands dismissed.
