Hence, the petitioners are before this Court.\n<\/p>\n<p>3.\tMr.\n<\/p>\n<p>K.M.Parikh, learned advocate for the respondents, wants to file<br \/>\naffidavit.\n<\/p>\n<p>4.\tThe<br \/>\npetition involving the aforesaid limited contention is pending since<br \/>\nSeptember 2010. As it emerges from the record that the learned<br \/>\ntribunal has declined to condone the delay, the petition requires<br \/>\nconsideration. Hence, RULE. Mr. K.M.Parikh, learned advocate, waives<br \/>\nservice of notice of rule on behalf of the respondents.\n<\/p>\n<p>5.\tMr.\n<\/p>\n<p>K.M.Parikh, learned advocate for the respondents, has submitted that<br \/>\nduring the pendency of the petition, the respondent &#8211; Bank has<br \/>\ngone into liquidation and the Liquidator has been appointed. The<br \/>\npetitioners have subsequently amended the petition to implead the<br \/>\nLiquidator as party to the proceedings and the respondent &#8211;<br \/>\nBank is now being represented by the Liquidator.
