Justice K.T.SANKARAN\n\n Dated :08\/01\/2010\n\n O R D E R\n                          K.T.SANKARAN, J.\n             ------------------------------------------------------\n                 B.A. Nos.7485 &amp;7668 OF 2009\n             ------------------------------------------------------\n             Dated this the 8th day of January, 2010\n\n                                O R D E R\n<\/pre>\n<p>      B.A.No.7485 of 2009 is filed by accused Nos.1 to 3 in Crime<\/p>\n<p>No.887 of 2009 of Kasaragod Police Station, while B.A.No.7668 of<\/p>\n<p>2009 is filed by accused Nos.5 to 8 therein.<\/p>\n<p>      2.   The offences alleged against the petitioners are under<\/p>\n<p>Sections 143, 147, 148, 323, 324, 452, 427, 308 and 153A read with<\/p>\n<p>Section 149 of the Indian Penal Code.\n<\/p>\n<\/p>\n<p>      3. The date of occurrence was on 6.12.2009. Accused Nos.1<\/p>\n<p>to 3 were arrested on 6.12.2009, while accused Nos.5 to 8 were<\/p>\n<p>arrested on 12.12.2009. All of them are in judicial custody.<\/p>\n<p>      4.   Heard the learned counsel for the petitioners and the<\/p>\n<p>learned Public Prosecutor. It is submitted that the injuries noted in<\/p>\n<p>the wound certificate are not very serious injuries.<\/p>\n<p>      5. Taking into account the facts and circumstances of the<\/p>\n<p>case, the duration of the judicial custody undergone by the<\/p>\n<p>B.A. Nos.7485 &amp; 7668 OF 2009<\/p>\n<p>                                         :: 2 ::\n<\/p>\n<p>petitioners, the nature of the offence and the present stage of<\/p>\n<p>investigation, I am of the view that bail can be granted to the<\/p>\n<p>petitioners.\n<\/p>\n<\/p>\n<p>       6. The petitioners shall be released on bail on their executing<\/p>\n<p>bond for Rs.25,000\/- each with two solvent sureties for the like<\/p>\n<p>amount to the satisfaction of the Judicial Magistrate of the First<\/p>\n<p>Class-I, Kasaragod, subject to the following conditions:<\/p>\n<blockquote><p>       a)    The petitioners shall report before the investigating<br \/>\n             officer between 9 A.M.         and 11 A.M. on all Mondays,<br \/>\n             till the final report is filed or until further orders;\n<\/p><\/blockquote>\n<blockquote><p>       b)    The petitioners shall appear before the investigating<br \/>\n             officer for interrogation as and when required;\n<\/p><\/blockquote>\n<blockquote><p>       c)    The petitioners shall not try to influence the prosecution<br \/>\n             witnesses or tamper with the evidence;\n<\/p><\/blockquote>\n<blockquote><p>       d)    The petitioners shall not commit any offence or indulge<br \/>\n             in any prejudicial activity while on bail;\n<\/p><\/blockquote>\n<blockquote><p>       e)    In case of breach of any of the conditions mentioned<br \/>\n             above, the bail shall be liable to be cancelled.\n<\/p><\/blockquote>\n<blockquote><p>       The Bail Applications are allowed as above.<\/p><\/blockquote>\n<p>                                                         (K.T.SANKARAN)<br \/>\n                                                                 Judge<\/p>\n<p>ahz\/<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court C.M.Muhammed Sajad vs State Of Kerala on 8 January, 2010 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 7485 of 2009() 1.
