Gupta, J.  <\/p>\n<p>1. This revision is directed against the judgment<br \/>\ndated 12.12.1991 passed by the Additional Sessions Judge,<br \/>\nKarnal vide which appeal filed by the petitioner was<br \/>\ndismissed and the judgment and order passed by the Chief<br \/>\nJudicial Magistrate, Karnal dated 17.5.1989 was<br \/>\nmaintained, vide which the petitioner was found guilty<br \/>\nunder Section 16(1)(a)(i) of the Prevention of Food<br \/>\nAdulteration Act, 1954 and was sentenced to undergo<br \/>\nrigorous imprisonment for six months and to pay a fine of<br \/>\nRs. 1000\/- and in default of payment of fine, he was<br \/>\nfurther sentenced to undergo rigorous imprisonment for two<br \/>\nmonths.\n<\/p>\n<p>2. Briefly (SIC)<br \/>\non 23.2.1981, PW-1 Kali Ram, Government Food Inspector in<br \/>\nthe presence of Dr. Om Pal, Medical Officer and Amrik Singh<br \/>\nson of Sucha Singh, intercepted the petitioner at about<br \/>\n7.00 P.M. He was found in his possession 12 kilograms of<br \/>\nCows&#8217; milk for public sale, contained in a drum. Kali<br \/>\nRam, Government Food Inspector disclosed his identify and<br \/>\nexpressed his desire to take sample of the milk for<br \/>\nanalysis. Thereafter he gave notice Ex.PA in Form No. VI<br \/>\nand purchased 660 mls. of Cows&#8217; milk after mixing the<br \/>\nwhole contents properly against payment of Rs. 1.50 paise<br \/>\nvide receipt Ex.PB. The milk so purchased was divided<br \/>\ninto three equal parts and was put in three dry and<br \/>\nclean bottles, which were duly sealed in accordance with<br \/>\nRules. One of the sealed bottle alongwith memo in Form<br \/>\nNo. VII was sent to the Public Analyst for analysis, while<br \/>\nthe other two bottles alongwith two memorandums in Form<br \/>\nNo. VIII were deposited with the Local Health Authority,<br \/>\nKarnal. On receipt of the report of the Public Analyst,<br \/>\nthe sample was found to be deficient to the extent of 40%<br \/>\nin milk fat of the minimum prescribed standard.<br \/>\nConsequently, the copy of the report of the Public Analyst<br \/>\nwas sent to the petitioner by the Local Health Authority.\n<\/p>\n<p> 3. After the completion of the necessary<br \/>\nformalities, the complaint was filed in the Court.\n<\/p>\n<p>4. After the appearance of the petitioner, the<br \/>\nFood Inspector examined himself for the purpose of<br \/>\npre-charge evidence. After having found a prima-facie<br \/>\ncase, the petitioner was charge-sheeted under Section<br \/>\n16(1)(a)(i) of the Prevention of Food Adulteration Act on<br \/>\n26.7.1988, to which be pleaded not guilty and claimed<br \/>\ntrial. After framing of the charge, the petitioner<br \/>\nfurther cross-examined PW-1 Kali Ram. The complainant<br \/>\nfurther examined PW-2 Dr. Om Pal and PW-3 Baldev Raj, Head<br \/>\nClerk.\n<\/p>\n<p>5. After the close of the prosecution evidence,<br \/>\nthe statement of the petitioner was recorded under Section<br \/>\n313 of the Code of Criminal Procedure, wherein he denied<br \/>\nthe allegations of the prosecution and pleaded false<br \/>\nimplication. He also stated that the milk was not meant<br \/>\nfor sale, but he was taking it to the hospital for a heart<br \/>\npatient. In defence, he examined four witnesses.\n<\/p>\n<p>6. After hearing the learned counsel for the<br \/>\ncomplainant and the learned defence counsel, the Chief<br \/>\nJudicial Magistrate, Karnal found the petitioner guilty<br \/>\nvide his judgment dated 17.5.1989 and sentenced him vide<br \/>\norder of the same date as stated above.\n<\/p>\n<p>7. Aggrieved by the said judgment and order, the<br \/>\npetitioner filed an appeal which was dismissed by the<br \/>\nAdditional Sessions Judge, Karnal vide judgment dated<br \/>\n12.12.1991.\n<\/p>\n<p>8. Still dis-satisfied, the accused has filed the<br \/>\npresent revision.\n<\/p>\n<p>9. I have heard Shri Shalu Bali, learned counsel<br \/>\nfor the petitioner, Shri Sudhir Nehra, AAG, Haryana, for<br \/>\nthe State and carefully gone through the record.\n<\/p>\n<p>10. Counsel for the petitioner vehemently contended<br \/>\nthat there is no evidence on file that the Food Inspector<br \/>\nbefore taking the sample had stirred the milk in<br \/>\naccordance with the Rules, but he simply stated that the<br \/>\nmilk was stirred and was made homogeneous before taking<br \/>\nthe sample. However, he had not stated that he had<br \/>\nstirred the milk with a clean stick or the milk<br \/>\nmeasurement and that too in a clockwise and anti-clockwise<br \/>\nin such a way that milk at the bottom was thoroughly<br \/>\nmixed. He further contended that the milk was not<br \/>\nproperly stirred and was not made homogenous in the<br \/>\nmanner stated above, so the report of the Public Analyst<br \/>\nwas defective and the petitioner was entitled to be<br \/>\nacquitted. For this contention, he placed reliance on an<br \/>\nauthority of this <a href=\"\/doc\/595020\/\">Court  Ram Kishan v. State of Haryana,<\/a><br \/>\n1997 (2) Recent CR 462, which supported the above<br \/>\ncontention of the learned counsel. There is also another<br \/>\nauthority on the same point, i.e.,  <a href=\"\/doc\/1180843\/\">State of Punjab v.<br \/>\nInder Singh,<\/a> 1984 (1) FAC 166.\n<\/p>\n<p>11. In view of the above mentioned authorities, it<br \/>\nis held that the milk was not properly stirred and the<br \/>\nreport of the Public Analyst cannot be relied upon to hold<br \/>\nthat the sample was found to be adulterated.<br \/>\nConsequently, the revision petition is accepted and the<br \/>\njudgments of the Courts below are set-aside and the<br \/>\npetitioner is acquitted.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Punjab-Haryana High Court Lal Singh Son Of Shri Baru Ram vs State Of Haryana on 22 January, 2003 Author: K Gupta Bench: K Gupta JUDGMENT K.C.
