     Petitioner is a Sambathi under the first respondent Board<\/p>\n
and has been posted at the Thrippakkudam Devaswom since<\/p>\n
16\/7\/06. Ext.P2 is a show cause notice issued by the 2nd<\/p>\n
respondent, in which certain allegations of misconduct have been<\/p>\n
raised against th petitioner, based on a report of the Sub Group<\/p>\n
Officer. It is also stated that the Sub Group Officer has reported<\/p>\n
that in the circumstances narrated therein, petitioner should be<\/p>\n
immediately transferred from the Sub Group.              For the<\/p>\n
misconducts alleged, he was called upon to show cause why<\/p>\n
further action should not be initiated against him. On receipt of<\/p>\n
Exhibit P2, petitioner submitted Ext.P3 reply. In Ext.P3, he has<\/p>\n
made allegations against the Sub Group Officer and concluded by<\/p>\n
stating that it was on account of his refusal to obey the illegal<\/p>\n
demands of the Sub Group Officer that the illmotivated report<\/p>\n
was furnished by the Sub Group Officer. He therefore requested<\/p>\n

the authorities to exonerate him from the charges. Thereafter<\/p>\n
petitioner received Ext.P4 during May 2007, whereunder he has<\/p>\n
been transferred to Harippad Devasom. Against Ext.P4 order of<\/p>\n
transfer, petitioner submitted Ext.P5 appeal and during its<\/p>\n
pendency he was allowed to continue at             Thrippakkudam<\/p>\n
Devaswom itself. Later by Ext.P6, he was relieved from the post<\/p>\n
and thereafter he got Ext.P7 order dated 8\/6\/07, which is the<\/p>\n
proceedings of the Devasom Commissioner rejecting his appeal.<\/p>\n
Challenging Exts.P4 and P7 and to direct the authorities to allow<\/p>\n
him to continue at Thrippakkudam Devaswom for a period of<\/p>\n
three years from 16\/7\/06, this writ petition has been filed.<\/p>\n
      2.   The respondents have filed a statement. It is stated<\/p>\n
that the Sub Group Officer submitted a report containing serious<\/p>\n
allegations against the petitioner and on the basis of the report,<\/p>\n
Ext.P2 show cause notice was issued. It is also stated that it is<\/p>\n
on the basis of the report of the Sub Group Officer that the<\/p>\n
petitioner was transferred to Harippad Devaswom. According to<\/p>\n
the Board, the transfer norms, in particular Clause 3 thereof,<\/p>\n
empowers the authorities to transfer an employee on the basis of<\/p>\n

complaints and lapses. It is also stated that the appeal filed by<\/p>\n
the petitioner before the 2nd respondent has been rejected on the<\/p>\n
basis of the “aforementioned report of the 3rd respondent”, the<\/p>\n
Sub Group Officer.\n<\/p>\n
      3.   The learned counsel appearing for the writ petitioner<\/p>\n
submits that by Ext.P2 show cause, the petitioner was called<\/p>\n
upon to show cause on various allegations including as to why he<\/p>\n
should not be transferred from Thrippakkudam and that reply has<\/p>\n
been given. Before considering or taking a decision on the reply<\/p>\n
so given, Ext.P4 order of transfer was issued. According to him, it<\/p>\n
is only on the basis of the report of the Sub Group Officer, whose<\/p>\n
illegal demands were not acceded by the petitioner. The learned<\/p>\n
counsel submits that the transfer norms permit an employee to<\/p>\n
continue at a station for a minimum period of three years and<\/p>\n
that except in exceptional situation, the employees should not be<\/p>\n
disturbed before expiry of the period.\n<\/p>\n
      4.   I have considered the submissions of the learned<\/p>\n
counsel. On going through Ext.P2 show cause notice, I notice<\/p>\n
that it was issued calling upon the petitioner to show cause as to<\/p>\n

why disciplinary action should not be initiated against him. The<\/p>\n
allegations of misconducts based on which action is proposed,<\/p>\n
have been mentioned in the show cause notice. Show cause<\/p>\n
notice also mentioned that in the background of the allegations of<\/p>\n
misconduct, the report of Sub Group Officer requires that the<\/p>\n
petitioner shall be transferred from out of the Devaswom<\/p>\n
immediately. According to me, he was called upon to show cause<\/p>\n
only against the allegations of misconduct, and not against that<\/p>\n
part of Ext.P2, wherein it mentions about the report for<\/p>\n
transferring him from the Devaswom. Therefore, the contention<\/p>\n
of the petitioner that before a decision was taken in the light of<\/p>\n
the reply submitted by the petitioner, he has been transferred is<\/p>\n
without any substance.\n<\/p>\n
      5.   As regards the contention of the learned counsel for<\/p>\n
the petitioner for continuance of an employee at a place for three<\/p>\n
years and except in exceptional situation the employee should<\/p>\n
not be disturbed, that cannot be reason for retaining the<\/p>\n
petitioner at a station in the light of the allegations that are<\/p>\n
raised against him. In any case, such norms cannot bind the<\/p>\n

Devaswom in all circumstances and cannot be a foundation for<\/p>\n
continuance.    Therefore the contention that Ext.P4 has been<\/p>\n
issued without any application of mind does not survive.<\/p>\n
      6.   Ext.P5 appeal has been decided by Ext.P7.         Ext.P7<\/p>\n
does not contain any reason except that show cause notice has<\/p>\n
been given. The statement filed by the Board shows that the<\/p>\n
appeal was rejected on the basis of the report of the 3rd<\/p>\n
respondent, Sub Group Officer. In the light of the fact that the<\/p>\n
petitioner has raised allegations against the 3rd respondent, in the<\/p>\n
reply to the show cause notice and also in the appeal<\/p>\n
memorandum filed by him, the appellate authority ought not<\/p>\n
have confined its examination to the report of the 3rd respondent<\/p>\n
alone. Appellate authority should have independently examined<\/p>\n
the merits of the contentions, which has not been done.<\/p>\n
Therefore, Ext.P7, to the extent it rejects the appeal of the<\/p>\n
petitioner reflects non application of mind and requires to be<\/p>\n
quashed.\n<\/p>\n
      7.   Accordingly, Ext.P7, to the extent the petitioner’s<\/p>\n
appeal has been rejected, is quashed and the 2nd respondent will<\/p>\n

\n                               : 6 :<\/span><\/p>\n
reconsider Ext.P5 appeal of the petitioner, as expeditiously as<\/p>\n
possible and pass fresh orders thereon. This shall be done within<\/p>\n
a period of four weeks from the date of receipt of a copy of this<\/p>\n
judgment.\n<\/p>\n
     Writ petition is disposed of as above.\n<\/p>\n<\/p>\n
