BASANT, J.\n\n                        - - - - - - - - - - - - - - - - - - - - - -\n\n                           B.A.No.  4510  of   2007\n\n                        - - - - - - - - - - - - - - - - - - - - - -\n\n                   Dated this the 31st day of   July, 2007\n\n\n                                     O R D E R\n<\/pre>\n<p>       Application for  anticipatory bail.  The petitioners are spouses.<\/p>\n<p>They face allegations  under Section 55(i)  of the Kerala Abkari  Act.<\/p>\n<p>The crux of the allegations is that when the Excise Party, on receipt<\/p>\n<p>of prior discreet  information    that  the  accused  were  carrying  on  the<\/p>\n<p>business  of sale of liquor  in  their residential  premises without  legal<\/p>\n<p>authority, went to the scene of the crime.  The first accused, who was<\/p>\n<p>present at the scene pointed out to them six litres of I.M.F.L., which<\/p>\n<p>was kept concealed in the premises.   Seizure was effected.  The first<\/p>\n<p>accused could not be arrested as the Excise Party did not consist   of<\/p>\n<p>any   woman   police   official.     Crime   has   been   registered.     The<\/p>\n<p>petitioners are accused 1 and 2.       Investigation  is in progress.   The<\/p>\n<p>petitioners apprehend imminent arrest.\n<\/p>\n<\/p>\n<p>       2.       The     learned   counsel   for   the   petitioners   submits   that   the<\/p>\n<p>petitioners   are   absolutely   innocent.     The   total   quantity   of   I.M.F.L.<\/p>\n<p>recovered is only 6 litres.   Each  of the accused is entitled to possess<\/p>\n<p>3 litres.   There is no contention that the liquor seized is spurious   or<\/p>\n<p>B.A.No.  4510  of   2007<\/p>\n<p><span class=\"hidden_text\">                                                2<\/span><\/p>\n<p>that   tax, rent, cess etc. payable in respect of the liquor has not been paid.<\/p>\n<p>In   these   circumstances   the   allegations   raised   against   the   petitioners   are<\/p>\n<p>unfounded.  They may be granted anticipatory bail, it is prayed.<\/p>\n<p>        3.   The  learned  Prosecutor  opposes  the  application.     The totality of<\/p>\n<p>circumstances eloquently suggest  that 6 litres of   I.M.F.L.  kept concealed<\/p>\n<p>in the premises was intended for sale and not for personal consumption of<\/p>\n<p>the petitioners.  It is impossible at this stage to come to the conclusion that<\/p>\n<p>possession of the liquor was bonafide for the personal consumption and not<\/p>\n<p>for   commission   of   the   offence   under   Section   55(i)     of   the   Abkari   Act,<\/p>\n<p>submits the Prosecutor.\n<\/p>\n<\/p>\n<p>        4.     I   have   considered   all   the   relevant   inputs.     On   an   anxious<\/p>\n<p>consideration of all  the relevant inputs, I find merit in the opposition raised<\/p>\n<p>by   the   learned   Prosecutor.       It   is   impossible   at   this   stage   and   with   the<\/p>\n<p>available   inputs   to   come  to   a   safe     conclusion   that   the   quantity   of   liquor<\/p>\n<p>concealed   in   the   premises   of   the   petitioners   and   recovered   &#8211;   from   an<\/p>\n<p>adjacent shed &#8211; was possessed bonafide and not for sale by the petitioners.<\/p>\n<p>At   any   rate,       I   am   satisfied   that   there   are   no   circumstances   which   can<\/p>\n<p>persuade this Court to invoke the extra ordinary equitable discretion under<\/p>\n<p>Section 438 Cr.P.C.   This   I am satisfied is a fit case where the petitioners<\/p>\n<p>B.A.No.  4510  of   2007<\/p>\n<p><span class=\"hidden_text\">                                            3<\/span><\/p>\n<p>must resort  to  the  ordinary and normal procedure  of appearing  before  the<\/p>\n<p>Investigator   or   the   learned   Magistrate   having   jurisdiction   and   then   seek<\/p>\n<p>regular bail in the  ordinary course.\n<\/p>\n<\/p>\n<p>       5.     This application    is accordingly dismissed.   Needless to say,   if<\/p>\n<p>the   petitioners   appear   before   the   Investigating   Officer   or   the     learned<\/p>\n<p>Magistrate and apply  for  bail  after  giving  sufficient  prior  notice to  the<\/p>\n<p>Prosecutor  in charge of the case,   the  learned Magistrate must  proceed to<\/p>\n<p>pass orders on merits, in accordance with law and expeditiously.<\/p>\n<p>                                                         (R.
