Nigam, A.S.G.I.\n\nHon'ble Anil Kumar,J.\n<\/pre>\n<p>Matter has been taken in revised cause list.\n<\/p>\n<p>None appears on behalf of the petitioner to press the present writ petition.\n<\/p>\n<p>Heard Smt. Archana Singh, Advocate holding brief of Sri A.K. Nigam,<br \/>\nlearned counsel for respondents and perused the record, from which it<br \/>\ntranspires and clear that present writ petition relates to the Armed Forces, the<br \/>\nsaid fact has already been admitted by the learned counsel for the respondent.\n<\/p>\n<p>On 20th December,2007, the Parliament has enacted an Act known as &#8221; The<br \/>\nArmed Forces Tribunal Act,2007( hereinafter referred to as an &#8216;Act&#8217;) to<br \/>\nprovide for the adjudication or trial by Armed Forces Tribunal of Disputes<br \/>\nand Complaints with respect to commission , appointments, enrolment and<br \/>\nconditions of service in respect of persons subject to the Army Act, 1950, the<br \/>\nNavy Act, 1957 and the Air Force Act, 1950 and also to provide for appeals<br \/>\narising out of orders , findings or sentences of courts-martial held under the<br \/>\nsaid Acts and for matters connected therewith or incidental thereto.\n<\/p>\n<p>Further Section 34 of the Act provides (relevant portion) as under:-\n<\/p>\n<p>&#8220;34.Transfer of pending cases,-(1) Every suit, or other proceeding pending<br \/>\nbefore any court including a High Court or other authority immediately<br \/>\nbefore the date of establishment of the Tribunal under this Act, being a suit or<br \/>\nproceeding the cause of action whereon it is based , is such that it would have<br \/>\nbeen within the jurisdiction of the Tribunal , if it had arisen after such<br \/>\nestablishment within the jurisdiction of such Tribunal, stand transferred on<br \/>\nthat date to such Tribunal.\n<\/p>\n<p>(2)Where any suit , or other proceeding stands transferred from any court<br \/>\nincluding a High Court or other authority to the Tribunal under Sub-section<br \/>\n(1),-\n<\/p>\n<p>(a) the court or other authority shall, as soon as may be, after such transfer,<br \/>\nforward the records of such suit, or other proceeding to the Tribunal;&#8221;\n<\/p>\n<p>For the forgoing reasons, the matter in question is not adjudicated and decided<br \/>\non merit by this Court but transmitted to the Armed Force Tribunal, Lucknow<br \/>\nin view of the provisions as contained in Section 34 of the Act.
