SANKARAN, J.\n                     ---------------------------\n                     B.A. No. 6515 of 2009\n                 ------------------------------------\n           Dated this the 30th day of November, 2009\n\n                            O R D E R\n<\/pre>\n<p>     This is an application for anticipatory bail under Section 438<\/p>\n<p>of the Code of Criminal Procedure. The petitioners are accused<\/p>\n<p>Nos. 1 to 3 in Crime No.686\/2009 of Pandalam Police Station.<\/p>\n<p>     2.    The offences alleged against the petitioners are under<\/p>\n<p>Sections 452, 294(b), 427, 354 and 324 read with Section 34 of<\/p>\n<p>the Indian Penal Code.\n<\/p>\n<p>     3.    When the Bail Application came up for hearing on<\/p>\n<p>16.11.2009, the following order was passed:<\/p>\n<blockquote><p>                  &#8220;After having heard the learned<\/p>\n<p>            counsel for the petitioners and the learned<\/p>\n<p>            Public Prosecutor, I am of the view that<\/p>\n<p>            before disposing of the Bail Application, an<\/p>\n<p>            opportunity should be given to the<\/p>\n<p>            petitioners    to    appear     before    the<\/p>\n<p>            investigating officer.    Accordingly, there<\/p>\n<p>            will be a direction to the petitioners to<\/p>\n<p>            appear before the investigating officer at<\/p>\n<p>            9 A.M. on 23rd and 24th November, 2009.<\/p>\n<\/blockquote>\n<blockquote><p>                  Post on 30.11.2009.\n<\/p><\/blockquote>\n<blockquote><p><span class=\"hidden_text\">B.A. No. 6515 of 2009             2<\/span><\/p>\n<p>                     It is submitted by the learned Public<\/p>\n<p>               Prosecutor that the petitioners will not be<\/p>\n<p>               arrested until further orders in connection<\/p>\n<p>               with Crime No.686\/2009 of Pandalam<\/p>\n<p>               Police Station.\n<\/p><\/blockquote>\n<blockquote><p>                     The petitioners shall produce a copy<\/p>\n<p>               of the order before the investigating<\/p>\n<p>               officer.\n<\/p><\/blockquote>\n<blockquote><p>                     Hand over copy to both sides.&#8221;<\/p><\/blockquote>\n<p>       4. It is submitted by the learned counsel for the petitioners<\/p>\n<p>and the learned Public Prosecutor that the petitioners have<\/p>\n<p>complied with the direction contained in the order dated<\/p>\n<p>16.11.2009.\n<\/p>\n<p>      5.     Taking into account the facts and circumstances of the<\/p>\n<p>case, the nature of the offence and other circumstances, I am of<\/p>\n<p>the view that anticipatory bail can be granted to the petitioners.<\/p>\n<p>There will be a direction that in the event of the arrest of the<\/p>\n<p>petitioners, the officer in charge of the police station shall release<\/p>\n<p>them on bail on their executing bond for Rs.10,000\/- each with<\/p>\n<p>two solvent sureties for the like amount to the satisfaction of the<\/p>\n<p>officer concerned, subject to the following conditions:<\/p>\n<p><span class=\"hidden_text\">B.A. No. 6515 of 2009            3<\/span><\/p>\n<blockquote><p>         A) The petitioners      shall   report    before     the<br \/>\n             investigating officer between 9 A.M and 11 A.M.<br \/>\n             on alternate Mondays, till the final report is filed<br \/>\n             or until further orders;\n<\/p><\/blockquote>\n<blockquote><p>         B) The      petitioners  shall  appear     before    the<br \/>\n             investigating officer for interrogation as and<br \/>\n             when required;\n<\/p><\/blockquote>\n<blockquote><p>         C) The petitioners shall not try to influence the<br \/>\n             prosecution    witnesses   or   tamper    with   the<br \/>\n             evidence.\n<\/p><\/blockquote>\n<blockquote><p>         D) The petitioners shall not commit any offence or<br \/>\n             indulge in any prejudicial activity while on bail.<\/p>\n<p>         E) In case of breach of any of the conditions<br \/>\n             mentioned above, the bail shall be liable to be<br \/>\n             cancelled.<\/p><\/blockquote>\n<p>        The Bail Application is allowed to the extent indicated<\/p>\n<p> above.\n<\/p>\n<\/p>\n<p>                                     K.T.
