It is submitted at bar that the<br \/>\nhusband has served out his sentence as passed by the trial Court.<br \/>\nThe father has lived his life.  Now remains the mother ?  Maniben,<br \/>\nappellant No.3 herein, who has been convicted under Section 498A of<br \/>\nIPC and sentenced to undergo RI for one year.   She has remained for<br \/>\nsome period in custody and thereafter she was granted bail.\n<\/p>\n<p>\tLearned<br \/>\ncounsel for the appellant urges that in the facts and circumstances<br \/>\nof the case he would not dispute occurrence of the incident and<br \/>\nsubmits that it is a case where Section 498A of IPC has been invoked.<br \/>\n   The learned counsel for the appellant has not<br \/>\nchallenged the findings of the trial Court on his convicting under<br \/>\nSection 498A of the Indian Penal Code.\n<\/p>\n<p>\tHere<br \/>\nwe take note of the fact that at the present distance of time the<br \/>\nconviction  under Section 498A of IPC, it would not be appropriate to<br \/>\nsend a mother-in-law to serve out a small sentence.   Consequently,<br \/>\nwe affirm the findings of the trial Court and reduce the sentences<br \/>\nto such period which has already been undergone by appellant No.3.\n<\/p>\n<p>\tConsequently,<br \/>\nthe appeal is  allowed.
