5. Having heard theiiiilearnedvappearing for the
\nparties it is noticed that.A”o;n1.yf requires to be
\nconsidered in this appeal is with regfard itomeompensation that is<\/p>\n
payable in respectcifya Irinoidsideath who is aged 10 years.<\/p>\n
6.   Court in the case of LATA<\/p>\n

ii ‘-  as the award of compensation in case
\n“of ch_iidiieri’ are concerned, Shri Justice Chandrachud, has
\ndividvergi them into two groups, first group between the age<\/p>\n
it group of 5 to 30 years and the second group between the
\n‘age group of 10 to 15 years. In case of children between
\nthe age group of 5 to 10 years, a uniform sum of
\nRs.50’OOO\/– has been heid to be payabie by way of
\ncompensation, to which the conventiona! figure of
\nRs.25,000\/- has been added and as such to the heirs of<\/p>\n
 \/<\/p>\n
the 14 children, a consolidated sum of Rs.75,000\/\u00ab\u00bb each
\nhas been awarded. So far as the children in the age<\/p>\n
group of ‘E0 to 15 years, there are 10 such children, who\u00bb,<\/p>\n
died on the fateful day and having found their contriybdtiioltiiigi’:_x’2<\/p>\n
to the family at Rs.12,000\/~ per annum, 11 multiplier  “‘ <\/p>\n
been applied, particularly depending upon thee-ag_e”.of’th:e..<\/p>\n
father and then the conventional iicompensation._oVf”V”<\/p>\n
Rs.25,000\/- has been added to  ‘c;a_As”-e.._<\/p>\n
consequently, the heirs of each’, of the, deceasedA..a~boy;e
\n10 years of age, have been granted compensation  the
\ntune of Rs.1,57,000\/g~e.ach_ chas-e’VVof_.the death an
\ninfant, there may have\u00abbeen”.nof.,actiiaVE;’pectiniary benefit
\nderived by its parents d_u_r:i’r:g  eghild’slVi1’etirrie. But this
\nwill not net:eVsVs–ariiyA_  ti1eii”‘ii’p~a.rent?si claim and
\nprospective'”loseiwili  a’va.i’idfc!aim provided that the
\nparents    reasonable expectation
\nof ;\u00a7eeLl’nie.r”g.gi:eri’\u00a7i\u00e9,rii ifjithie: marred lived. This principle
\nwas”*.|_aid  ,|f4tiVC)i.l:e”e.__iOi’. Lords in the famous case
\nof Taiff=–V_’aii=.V Rail ‘ce.i.\\i;=,ielik;ns, 1913 AC 1, and Lord<\/p>\n
Ail:-inson said thus:\n<\/p>\n
 ” ………. .,ali that is necessary is that a
\n  reasonable expectation of pecuniary benefit
\nf~._S~hould be entertained by the person who
\n sues. it is quite true that the existence of<\/p>\n
A this expectation is an inference of fact —
\nthere must be a basis of fact from which the
\ninference can reasonably drawn; but I wish<\/p>\n
to express my emphatic dissent from the
\nproposition that it is necessary that two of
\nthe facts without which the inference cannot<\/p>\n
be drawn are, first, that the deceased
\nearned money in the past, and, second,
\nthat he or she contributed to the support of
\nthe plaintiff. These are, no doubt, pregnant
\npieces of evidence, but they are only pieces<\/p>\n
of evidence; and the necessary inference<\/p>\n
can i think be drawn from circumstances
\nother than and different from them.”\n<\/p>\n
At the same time, it must be held that a mere<\/p>\n
speculative possibility of benefit is not sufticientgvyg<\/p>\n
Question whether there exists a reasonable expect_ati.on*  <\/p>\n
of pecuniary advantage is always a mixed ques’tion,lg:ot,”‘ ll”.<\/p>\n
fact and law. There are several decided cesesdong <\/p>\n
point, providing the guidelines {for :deter’minatio:n’–.gVofy”iV<\/p>\n
compensation in such cases butfwe–._do not._tnEnl<\u00ab.  it<\/p>\n
necessary for us to advert,i_as__the clainiants hlajdv\u00ab-not<\/p>\n
adduced any materials on theireaisonablei expectation of
\npecuniary benefits, which theirtp'arentsuei:im’ation. Mrliilvariman, appearing for the TISCO on<\/p>\n
V  ,su,b’rnitted that the compensation determined for<\/p>\n
 2 ‘the chiVl’d’ren’g;_etaIl age groups could be doubled, as in his<\/p>\n
views” also, the determination made is grossly<\/p>\n
ina”deti.uate. Loss of a child to the parents is<\/p>\n
it ‘iii’:.recoupable, and no amount of money could<\/p>\n
VV”co’mpensate the parents. Having regard to the<\/p>\n
environment from which these children were brought,
\ntheir parents being reasonably well placed officials of the
\nTata Iron and Steel Company, and on considering the
\nsubmission of Mr.Nariman, we would direct that the<\/p>\n
compensation amount from the children between the age<\/p>\n
group of 5 to 10 years shoutd be three times. in other
\nwords, it should be Rs.1.5 takhs, to which the
\nconventionai figure of Rs.50,000f– should be added and<\/p>\n
thus the totai amount in each case would be Rs.2.00.___
\nlakhs. So far as the children between the age grou_pt.Vof\u00bb.._’ii~.._
\n10 to 15 years, they are alt student of Class VI to
\nand are chitdren of employees of TlSCO.\n<\/p>\n
itself has a tradition that every employee can”get’:o’i’ie’.’ofV’_’_r.V
\nhis child employed in the company.\n<\/p>\n
these facts, in their case, the \u00a2ont;;’g,u;j\u00a2_Q of 30:3\/.v\u00bb_’
\nper annum appear to us tolii\ufb01jony the.lov__ve’r.sid.e ‘and”‘in
\nour considered opinion, the”:Vic-o:ntri.butio.n’ ~sl_hv’ould:} be
\nRs.24,000\/– and insteadt~,.of   appropriate
\nmultiplier would be 15. ‘ JT.hereifo\u00bbi*’e;;’ theii’eornpe.nsation, so
\ncalculated on _trre_.afore’s’aid*   “worked out to<\/p>\n
Rs.3.80\/–_V?iakh1s;”_V tohwhicih  “additional sum or<\/p>\n
Rs:v5t}h;uO’O\ufb01;7\u00bbvhas’i;’fVtVo  making the total

 –reported.i1\u00e9V_2O(xJV8 ACJ 1405 by holding as foilowszm<\/p>\n
“4. Both the Tribunal and the High Court
\ncompletely ignored the factum of toss of life at a
\ntender age, the future prospect of young man and
\nmental agony suffered by the claimant. in our
\nview, the award of \u20ac50,000\/– on no fault liability in<\/p>\n
the case of death of a person is too meagre. in<\/p>\n
the pecuiiar facts and circumstances of this case,
\nwe award a lump sum compensation of
\n?2,50,000\/– to the cfaimant aiong with the interest
\nawarded by the Tribunal. The compensation shall___<\/p>\n
be paid by the respondents jointiy and severaiiy\ufb01f <\/p>\n
